MINUTES
Sep tember 5, 1974
The September Study Session was called to order at 5 30 p.m. by
Mayor Paul B. Abramson at 4355 Field Street.
Aldermen attending were
Hulsey Larry Merkl and
absent.
Mary Jo Cavarra, Joseph Donaldson, Calvin
Loujse Turner. Alderman Robert Howard was
Also attending were City Administrator John Jerman City Attorney
William McCarthy, City Clerk Elise Brougham, and staff.
Mr. Jerman stated he had asked for a policy for paving all unpaved
streets in the City by means of a revolving fund, and that City Attorney
McCarthy had researched the question and had ruled that according
to State Satute 88-2-1 that it is illegal for a statutory city to
use general fund money to pave unpaved streets, That any improvements
except sidewalks cannot be done without a petition, that if a majority
of the people petition for paving etc., ~hen a special improvement
district may be set up by ordinance, but that the people are the ones
who pay for the improvement.
Mr. Jerman stated his idea had been that a revolving account could be
set up and that the City could do the work and then bill the citi7ens
and then if they didnot pay, the charge could be put on their taxes
and there would be no expense for a bonding attorney etc., but that
now it appears this is not possible.
Alderman Hulsev stated that the City'S policy in the past had been
to pave streets only in developed areas, and that some improvement
districts had been formed in the past, and that it would have cost
more to sell bonds etc., so the City went ahead and paved the streets.
Alderman Cavarra stated the county does all the preliminary work up to
paving the street, and that she felt the City'S policy should be no
less service than the county's.
Alderman Merkl asked Mr. McCarthy to research if widening streets and
putting in improvements such as bridges etc. would fall under this
statute also.
A report on 100% federal funding for clerical positions was presented
by Mr. Bartholomew, Personnel Director who stated the city had money
allocated from EEA which will run out in March 1975, and that in his
opinion there might be other funding available at that time. That if
the City does not use the money it will lose the money, and that EEA
prefers full-time employment but that possibly they would go along
with part-time Mr. Jerman stated that if the EEA money is used through
March, then the positions could be continued full-time, and would not
go over the 1975 budget. Also, if the funding ends, then the city could
use these people to fill permanent vacant positions, or try to place them.
Alderman Hulsey stated that at the Council's budget hearing they had
determined to cut the additional help to part-time, and to use students.
Alderman Turner asked if this money had to be for just clerical help,
or are there other full-time positions that are vacant at the present
time that could be used in this program. Alderman Donaldson recommended
using the EEA program since the money is available. It was determined action
could be taken during the regular meeting this evening.
REGULAR MEETING
A regular meeting of the Wheat Ridge City Council was called to order
by Mayor Paul B. Abramson at 7 45 p.m. Those attending have been stated
previously, and there were interested citizens present.
Motion by Alderman Turner "I move that the approval of the Minutes
be continued (until next week)." Motion was seconded by Alderman
Merkl and passed 5-0.
Mr. Maurice Fox, attorney representing Brannan Sand & Gravel Co. expressed
willingness to renegotiate with the City on their Prospect Park proposal
and staLed they needed 3 weeks to gain information that Council had pre-

viously indicated they wanted, and he asked Council to call his office
regarding anyi'hing they were concerned about so that they would be
prepared, and that they WJuld begin to negotiate the contract with
the City and Coors. He stated his office would send a letter to each
Councilman reqJesting their input.
Motion by Alderman Hulsey "I move that Council approve the concept
presented by Brannan Sand & Gravel (regarding Prospect Park), and
if the concept is approved, that this be scheduled an the Agenda
in 3 weeks (Sept. 25, 1974.)" Motion was seconded by Alderman Merkl
and passed 5-0.
Motion by Alderman Cavarra "I move if a Motion is passed to suspend
the rules to allow the meeting to continue past 11 00 p.m., the remaining
Agenda will be reviewed at that time, and only those items which are
of concern to many citizens present, or those in which a decision must
be rendered immediately for the good of public health, safety or welfare
will be considered. All other items will be postponed until the following
meeting. Under no circumstances will the meeting be allowed to lastv1 a.m."
Motion was seconded by Alderman Donaldson. past
Motion to Amend by Alderman Turner "I move that Public Hearings previously
scheduled be included in the Motion." Alderman Cavarra agreed to change
her Motion and the second agreed.
Question was called and passed the Motion 4-1. Alderman Merkl voted
"nay."
Motion by Alderman Merkl "I move that Minar Subdivision Case MS-73-13
(application by Martha Mader at Reed Street between West 31 and 32 Avenues)
be continued ~ntil September 12, 1974 upon request of the applican~"
Motion was seconded by Alderman Donaldson and passed 5-0.
Alderman Turner stated an applicant should be told all the requirements
when he comes in, and not be given new requests later. Mr. Jerman
cautioned the Council to be careful about asking the staff to do work
that is a requirement of the subdivider.
Mavor Abramson announced he had received a letter of praise from Mr.
Willis Alderman an the fast service of Rescue 5 in getting him to the
hospi tal.
Mr. Jerman reminded the Council to attend the interview session for
Director of Community Development and Director of Parks and Recreation.
He also stated the Comprehensive Plan notice of meetings had a mispelling
of the ward "Whea t Ri dge " and that due to the short time to print the
notices the City did not thoroughly check the copy
Mr. Jerman stated he had retained the same man who had done the study
on the building department in Lakewood for the Wheat Ridge Building Dept.
end that he would be here before October 24, 1974 and would have a written
report by approximately November 15, 1974.
Alderman Turner reported she had attended a meeting with Consolidated
Mutual Water Company, and that Lakewood had passed an ordinance to take
aVer the water districts, and that 15% of the water users of Wheat Ridge
are an Consolidated lines but. that this will not affect their supply.
Meeting was adjourned at 8 10 p.m.
Motion by Alderman Turner "I move that we reconvene the regular meeting."
Motion was seconded by Alderman Cavarra and passed 3-2. Aldermen Hulsey
and Merkl voi;ed "nay."

Motion by Alderman Turner "I move that the personnel Director determine
what positions which are regularly aJthorized positions for 1974 and
which are currently vacant a~d which can be filled by WINN or EEA funds
until March 1975, and present this information to Council for approval
on September 12, 1974." Motion was seconded by Alderman Cavarra and
passed 3-2. Aldermen Merkl and Hulsey voted "nay."
Regular meeting was adjourned at 8 15 p.m. with Alderman Merkl voting
"nay."
STUDY SESSION
The revised Purchasinq Manual was distributed to the Council. Mr.
James Malone, City Treasurer made some comments on the revisions.
Page4 no. 9 he qJestioned the word evaluate, Page 5 no. 11 regarding
purchase without bidding if there was a single supplier, Page 6 the
wording "under direction of the City Administrator", Page 8. requisitions
not included in the budget should be taken to Councilor perhaps
the City Council should be notified of such items over $100, Page 13
where it states final determination of nbject codes shall be made by
the Purchasing Officer, he objected to this and recommended that it
be subject to the review of the City Treasurer and City Council. Study
of the ~anual was scheduled for September 12, 1974.
Alderman turner told resigning Mayor Abramson he would be missed and
wished him well.
Study session was adjourned at 8 40 p.m.
