TITLE
AN ORDINANCE REPEALING AND REENACTING CHAPTER
17 OF THE CODE OF LAWS, CONCERNING PARKS AND
RECREATION, AND IN CONNECTION THEREWITH,
AMENDING CODE SECTION 16-64
WHEREAS, the Parks & Recreation Department has caused to be prepared a
comprehensive revisIOn of Chapter 17 of the Code of Laws, concerning parks and
recreation, and
WHEREAS, the revIsion has been reviewed by the Parks and Recreation
Commission, which recommends adoption thereof
NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WHEAT RIDGE, COLORADO
Section 1. Chapter 17 of the Wheat Ridge Code of Laws, entitled "Parks &
Recreation" is hereby repealed and reenacted in its entirety, to read as set forth on
Exhibit A, attached hereto and fully Incorporated herein by this reference
Section 2. Section 1 6-64 of the Code of Laws IS hereby amended as
follows
· Amend subsection (c)(2) to read: Wild animal includes any animal
native to the state, but does not include rattlesnakes, fish or ~n'y'
GpocioG of ~mphibi~n, Norway rats or common house mice
· Add new subsection (h) to read (h) It is unlawful to feed fox and
coyote
Section 3. Safety Clause The City Council hereby finds, determines, and
declares that this Ordinance is promulgated under the general police power of the
City of Wheat Ridge, that it is promulgated for the health, safety, and welfare of
the public and that this Ordinance is necessary for the preservation of health and
safety and for the protection of public convenience and welfare The City Council
further determines that the Ordinance bears a rational relation to the proper
legislative object sought to be attained
Section 4. Severability; Conflictinq Ordinances Repealed If any section,
subsection or clause of this ordinance shall be deemed to be unconstitutional or
otherwise invalid, the validity of the remaining sections, subsections and clauses
shall not be affected thereby. All other ordinances or parts of ordinances In conflict
with the provisions of this ordinance are hereby repealed
Section 5. Effective Date. This Ordinance shall take effect fifteen days after
final publication, as provided by Section 5 11 of the Charter

Park Rules and Regulations
ARTICLE t. IN GENERAL
Sec. 17-1. Definitions.
The followmg words, terms and phrases, when used m this chapter, shall have the meanmgs
ascribed to thcm m this section, except whcre the context clearly mdlcates a dJttcrent meanmg.
Animal Park Code Officer (APCOj mcans an agent of the CllIef of Police. and an officcr of the
Police Departmcnt cmpowered by the City to enforce the proVisions oftl1lS chapter
Department means the Department of the Parks and RecreatIOn of the Ctty
Director means the Director of Parks and RecrcatlOn of thc CIty or designee.
Conservation Area means all area south of Clear Creek bctween Klplmg St. to Y oungtield St..
excludmg the paved trail from Wcst Bndge (located between West and Tabor Lakcs) to
Young field.
Park, park-wav, trail, pathwav, recreationalfclcility or recreational huilding means reference to
anyone park, traiL recreatIOnal area or recreational bUlldmg and shall mclude all such parks,
parkways, trails, open space, recreatIOnal arcas and recrcatlOnal bUlldmgs wtthm the City
Pedestrian pathways, hicycle pathwav~ and e(luestrian pathways shall mean any hard surfacc
or natural surface trail that tS publicly mamtamed and that has bcen desIgnated for use by
bicycles, pedestnans, horses, or any combmatlOn thereof by a traffic control device or other
signage or by regulation and that is separated hom the roadway by open space or other barner
Sec. 17-2. Violations and penalties.
Any person found to be m vtolatlOn of the provIsions of thiS chapter shall be guilty of an
unlawful act. and upon conVictIOn shall be pUl1lshable by a fine of not less than twenty-fivc
dollars ($25 00) and not cxccedmg one thousand dollars ($ lOOO (0), or by Impnsonmcnt not
excccdmg one hundred clghty (180) days, or by both such fine and Impnsonment, prOVided.
however. that no person undcr the age of elghtcen (18) years shall be subjected to impnsonment
for VIOlation of any provIsion of thiS chapter

Sec. 17-3. Authority.
The Ctty Council of the Ctty does hereby authonze the Chief of Poltce and the Director of
Parks and RecreatIOn to enforce the rules and regulations set forth 111 tillS chapter and all future
rules and regulations adopted by the Clty CouncIl for the proper management operatIOn and
control of the parks. traIls and other recreatIOnal facilities WIthin the Clty The APCOs shall be
authonzed to Issue, sign and serve summons and compla111ts m order to enforce the provIsIOns of
this chapter
ARTICLE II. PARK RULES
Sec. 17-4. Scope.
ThiS article applies to parks. open space, trails. parkways. pathways, recreatIOnal faCilities and
recreational bulld111gs.
Sec. 17-5. Restriction of use.
The Director may restnct the hours, days and weeks of use of any recreatIOn center or bUlldmg.
facthtles. parks, open space or trails. and the Director or an APCO may restnct or remove any
user. 111dlvldual or group for VIOlatIOn of any of the rules and regulations set forth 111 this article
Sec. 17-6. Permits.
The Director IS hereby authonzed to Issue permits relat111g to any use or accommodation of any
park. or recreatIOn faclltty of the City The Director shall establtsh rules for the use of park
property by any licensee. which rules shall become a condItIOn of any permtt. No permit shall be
tssued until any required fee or depOSit IS paid. The Director shall have the power and authonty
to cancel any permIt for VIOlatIOn of the reqUirements of the permit or for vIOlatIOn of any of the
proVISIOns of thiS article
Sec. 17-7. Group use.
Any group of more than twenty-five (25) persons shall obtam a permit Signed by the Director
allow111g such a group to assemble 111 the park. Groups shall be orderly and law-abld111g

Sec. 17-8. Hours.
(a) Parks shall normally be open dally from 5'00 a.m. until 10'00 p.m. and normally be closed
from 10'00 pm. to 5 00 a.m., except for activIties and evcnts sponsored by the departmcnt or
authonzed by pen11lSSlOn of the Dlrcctor Any park or recrcatlonal faciltty may bc declared
closcd to the public by the Dlrcctor or by thc Chief of Police at any time and for an) mterval of
time, wtthin a temporary or stated mterval as the Dlrcctor or Chief ofPol1ce shall find reasonably
necessary m ordcr to protect the publ1c, and mdlvldual members thereof, from dangerous
persons, conditions or situations. It shall be unlawful to go mto or upon any area or part of any
park or recreatIOnal facility of the City when It has been decIarcd to be closed to the public under
thiS prOVISIOn.
(b) All grccnbelt areas. Johnson Park and Wheat Ridge I-lJstorical Park, shall normally bc open
datly from sunnse to sunset, and normally be closed !i'om sundown to sunnse, except for
acttVltles and events sponsorcd by the Department or authonzed by pCn11lSSlOn of the Dlrcctor
Sec. 17-9. Advertising.
Advertlsmg shall not be permitted m any manner unless authonzed by the Director 111 wntmg
or m concessIOnaire contracts for goods sold on the premises. No Items are to be placed. taped,
dnlled or strung on signs, benches, planters. light or telephone poles. build111gs. fences or trees.
Sec. 17-10. Alcoholic beverages.
(al Thc storage or consumption of any alcoholic liquor. as defined by the Colorado Liquor
Code, IS prohibited m any park. rccreatlOn area or recreatIOn bUlldmg wlth111 the City except as
specifically provided herem. The consumptIOn and/or storagc of fermcnted malt beverage
contaml11g not more than three and two tcnths (3.2) pcrcent of alcohol by vYelght IS penl1lttcd 111
any park or rccreatlOn area wlthm the City so long as, and only so long as. such fermentcd malt
beverage has been purchased m a manner authonzcd, and tS bemg consumed by pcrsons
pcrmltted, by applicablc State la'-" It shall be unlawful to sell any fermented malt bevcrage
withm any park or recreation area wlth111 the City unless such sales are made pursuant to a
license or permit granted by the City Council and unless such sales are made 111 accordance WIth
the Colorado Beer Code
(b) Storage and consumptIon of fermented malt and vinous I1quor ts pcn11ltted at the Wheat
Ridge Semor/Commumty Center, the Whcat Ridge RccreatlOn Ccnter and thc Richards-Hart
Estatc 111 conjunction With an event sanctIOned and authonzed by the Dlrcctor; and proVided
further that such alcoholic beverages are neither sold to, scrved to, or consumed by any person
not authorized by thc Colorado Liquor Codc or the codc of Laws of the City of Wheat Ridge to
posscss or consume such alcoholic beverages. The Dtrector IS hereby authonzed to establish
rules for servmg and consumption of alcoholic beverages at the Richards-Hart Estate. the Whcat
Rldgc Semor/Commumty Ccnter. and the Wheat Ridge Recreation Ccnter

Sec. 17-11. Amplification systems.
Public addrcss or other ampltficatlOn devICes may be used m a park, trail or recreatIOnal area
only by special permIt obtamable from the Director
Sec. 17-12. Animals.
(a) All ammals must be under control by mcans of a leash, cord or cham not to exceed SIX (6)
feet m Icngth.
(b) It shall be unlawful for the owner or custodian of any annnal to allo\\i such ammal to
defecate m any park, trail. recreational faCility or other public place wlthm the cily, and to Elll to
clean up and remove from such park, trail, recreatIOnal faCility or other publtc place such
excrcment or feces.
(c) Horseback ndmg shall bc permitted only upon arcas specIfically deSignated by thc
Director Ilorseback nding IS prohibited m all turf areas.
Sec. 17-13. Athletic fields.
(a) The Director, or an APCa, shall enforce all rules and regulatIOns pcrtammg to actIVities
upon any athlctlc ficld m any park or recrcatton faCIlity of the City The Director shall have the
power to issue rules and regulations govermng such athletic fields, and copies of such rules and
regulatIOns shall be on file With the Department of Parks and Recreation and the Ctty Clerk.
(b) All tcams or mdivlduals shall relmqUlsh play on any athletic field to any mdlvldual or
teams to whom pen11lts for use of such facility shall have been Issued by the Director
(c) The Director or an APea may rcstrict or remove any playcr, players, teams or league from
all public fields for a speCified tune for a VIOlation of rules and regulatIOns set forth m thiS article
or Issued by the Director under the authority of thiS chapter
(d) The Director or an APCO shall have the authonty to elose any or all public fields or play
areas when usc of such area shall create maintenance problems or when use would or could
constitute a danger to any pcrson, as a result ofweathcr or other conditIOns.
(c) Artificially lighted athletiC tields in the parks shall have the lights turned off as follows
Randall Park and Wheat Ridge Middle School. 10'00 p.m., Anderson Park. Creeksidc Park and
Prospect Park, no inmng Will start after 10 30 p.m.
Sec. 17-14. Begging, soliciting.
It shall be unlawful for any person to bcg or SOltClt wlthm any park or recreatIOn arca.

Sec. 17-15 Boating.
(a) All nonmotonzed watercraft designed to be used as a means of transportatIOn on wateL
other than single-chambered alr-mt1ated devIces, shall be allowed on any waters m the park and
recreation arcas of the City as out1l11ed 111 thts section except for Bass Lake Boating]s
prohibited on Bass Lake
(b) In ordcr to boat on any water m the Parks and Rccreation areas of the City of Wheat Rldgc
the following reqUlremcnts shall be met:
( I ) The watercraft shall be nonmotonzed, propelled solely by means of oars and paddles or by
the usc of sails. Any watcrcraft which has a motor-dnven means of propulsIOn shall he
clasSified as motorized and shall be prohibited upon thc water of the City
(2) Any Sailboat must he properly reglstercd With the Colorado Dlvtslon of Parks and Outdoor
RecreatIOn.
(3) All alr-int1ated devices, mcluding mtlatable canoes, kayaks, rafts and belly boats, must
have a mtmmum of two (2) scparate and distmct chambers. Inner tubes, air mattresses and
other snmlar beach toys are not pcrmltted at any tlmc
(4) The watercraft shall be m seaworthy condition as defined by thesc rulcs and regulations
and determmed by the APCOs.
(5) The \vatercraft shall have one ( 1) personal tlotatlon deVice of a type currently approved for
use by the lTmted States Coast Guard on board for cach person occupymg the craft and onc
( 1 ) throw flotatIOn deVice.
(6) The watercraft shall havc at least one (1) oar or paddle which shall be carried on board
when the craft tS muse
(7) The watercraft shall bc labeled With the namc, address and phonc number of owner or WIth
the Iiccnse number Issued by the Colorado DIviSIOn of Parks and Outdoor RecreatIOn
(S) Motonzed radIO/rcmote control watercraft shall be prohibltcd.
(9) Smlboards are not allowed.
(10) With respcct to v.atercraft reqUired to bc regIstered by the Colorado Statc DIVISion of Parks
and Outdoor RecrcatIOn, all applicable laws shall apply
(c) Open boating shall be permitted from 700 a.m untIl one-half hour past sunset.
(d) No person shall dock an) boat upon. phYSIcally go upon. or sWim from any island 111 any
lake wlthm the City.

(e) No group activIty, orgamzed racc, regatta, or any other type of orgamzed boatmg activity
shall be allowed unless approved m advance m wrItmg by the Director
(f) An APCO may order operators from the water when, m the APCO's Judgment, such
operators constitute a safety hazard to themsclves or other operatIOns. APCOs may also order
from the water persons or crafts operatmg in a reckless or careless manner or m disregard of or m
vIOlatIOn of any Department of Parks and Recreation rule or regulatIOn. APCOs shall have the
authOrIty to close the lake becausc of mclcment weather or any other unsafe condition which, in
the Judgmcnt ofthc APCa, constitutes a dangcr to the health and safety of the public.
See. 17-16. Camping.
It shall be unlawful to camp overnight, or to park any vehicle, trailer or campcr for ovcrmght
campmg purposes.
Sec. 17-17. Cleats, spikes.
Cleats or spikes on shocs are prohlbltcd except m those speCially designated athlctlc areas
where program rules specifically pCrI11lt their use.
Sect. 17-18. Commercial activity.
It shall be unlawful to conduct any commercial acttvlty. or sell or otTer for sale any servtcc,
product or activity for whtch a fee IS charged, on any park or open space lands, except where
such activity IS authorized m wrItmg by the Director ThiS mcludes commercial photography,
film-makmg and vendmg
Sec. 17-19 - Conservation area.
Roller blades, roller skates, skateboards, and bicycles are not allowed III the conservation area.
Sec. 17-20. Dances.
Orgamzcd dances m a park, trail or recreatIOnal area shall be permitted only by WrItten pen11lt
Issued by the DIrector
Sec. 17-21. Disturbing the peace.
It shall be unlawful wlthm any park or recreatton area of the City to disturb the peace of others
by commlttmg any act prohIbited m SectIOn 16-103 ofthe Code of Laws.

Sec. 17-22. Fires, personal barbecues.
Fires are pen11ltted only 111 enclosed personal gnlls or park fireplaces or gnlls provIded for tillS
purpose under such rules and regulatIOns as may be prescnbed by the Director, and any such
tires shall be extinguished before leavmg any park or recreation area of thc City If a tire ban IS
m effect, all fires and gnlls are prohibIted.
Sec. 17-23. Fishing.
(a) It shall be unlawful for any person sixteen (16) years of age or over to fish Without being 1ll
nnmedtatc phYSIcal possessIOn of a current valid state fish111g liccnse Any pcrson 111 violatIOn of
thiS provIsion shall be deemed guilty of a vIOlation ofthls Code of Laws.
(b) Methods of takmg The follow111g fish or other water wIldlife may be taken by the
methods indicated.
(1) No fish shall be taken or killed except by the usc of hook and lme With no more than three
(3) hooks attached to any Ime (For the purpose of these regulatIOns multiple hooks havmg
a common shank, t c treble hooks, shall be conSidered as one (1) hook.)
(2) Thc taking of crayfish, salamanders and turtles is prohibited.
(c) An addItIOnal rod may be used 111 all waters when a second rod stamp IS properly signed
and attachcd to the tishmg license
(d) Any rod or Ime that ts used for fishing must be pcrsonally attended.
(e) Snaggmg (snatchmg With hooks, gang hooks, or SImIlar devices to catch tish), archery and
spearfishmg are prohibited.
(f) Placmg fish, parts of fish, or other matenal upon which fish might feed m the waters for the
purpose of attractmg (ish to a partIcular area m ordcr that they may be taken (chummmg) IS
prohibited.
(g) All largemouth or small mouth bass (black bass) under fjfteen (15) 111ches m length which
are taken shall be returned to the water Immediately
(h) Fislllng m Bass Lake and West Lake is restricted to thc use of artifiCial fllcs and artiliclal
lurcs.
(I) Any person tishmg is cntltled to the numbers of fish as established m thc then current

Cll Fishmg shall be allowed from the shorelme and dock area excludmg boat dock areas and
boat launch areas. FIshmg from boats IS allowed except wherc posted as prohibited.
Sec. 17-24. Flying objects.
It shall be unlawful to throw, strike, propel or otherWise operate t1ymg or propelled objects of a
potentially dangerous nature, mclud1l1g by way of example, without limitatIOn, such thmgs as
model airplanes, rockets, horseshocs. arrows, golf balls. rocks or pamtballs, except m arc as
designated for such use, or as part of any authonzed sport or recreatIOnal activity, or by a wntten
penmt of the Director
Sec. 17-25. Glass containers.
It shall be unlawful for any person to bnng. or to have 111 his/her posseSSIOn, any glass beverage
bottle m any park. lake. or other recreatIOnal area or faCIlity of the Clty
Sec.17-26 Littering.
It shall be unlawful to dump, depOSit. discard. tlml\\< or leave any branches. grass clippmgs.
bottlcs. cans. broken pieces of glass. papers, boxes. dirt. rubbish, waste, garbage. refuse or trash
upon or wlthm any park. lake, or other recreatIOnal area or faciltty of the City It shall be
unlawful for any person utlllZlng the faCility of any park. lake. open space, or recreatIOnal area
or facility of the City to leave such area or faCility wlthout tirst havmg completely extmguished
tires, or before all trash. waste. or garbage IS placed 111 the disposal receptacles where provided.
If no receptacle IS provided, such persons shall remove all trash, waste, or garbage from the park.
It shall not be necessary for the person dumping, depOSiting. discarding, throw1l1g. or leavmg any
of the Items described above to depart from the Immediate vlclmty m order to constitute a pnma
factc violatIOn of this sectIOn.
Section 17-27. Pavilions/Shelters
ReservatIOn ofpavtllOns may be obta1l1ed by pernut Issued by thc Director Othcrwlse. all use
of pavilIOns shall bc on a first-come, tirst-served basis.
Sec. 17-28. Reserved.
Sec. 17-29. Protection of natural resources.
(a) No minmg of any type, mcluding gold pannmg, metal detection or geocache sItes of any
type are allowed except as authorized by the Dm:ctor 111 any City park.

(b) It shall be unlawful to willfully remove, destroy, harvest. cut down or otherwise destroy
any livmg trees, shrubbery, wild f10wers or natural f1ora. planted annuals or perennials WIth any
City parks, open space or recreatIOnal faCllit)
(c) In this sectIon.
Noth1l1g 111 thiS section shall prevent the staff or volunteers of the City of Wheat Rldgc m then
performance of rcsource management or parK ma1l1tenance or the normal executIOn of their
duttes.
Sec. 17-30. Swimming.
SWtmmmg IS allowed only as part of a scheduled and supervised recreatIOnal program
sponsored by the department or authonzed by department permit, or 111 connection With
launching a boat when necessary SWImming from a boat IS expressly prohibited unless engaged
m as part of a legitimate rescue attempt.
Sec. 17-31. Tennis.
(a) TenniS courts shall be rcserved only b) wntten penl1lt, except for department-sponsored
programs.
(b) I )se of tenms courts shall be subJect to speCIfic rules and regulatIOns promulgated by thc
Dlrcctor and conspicuously posted on such courts.
(c) Rollcrbladmg and skateboardmg are not allowed on tennis courts.
Sec. 17-32. Tents.
No tents, canopies. or mf1atable deVices shall be erected upon any park, open spacc or
recreation facility except as part of a department-sponsored actIvit), or unless a permit
authorumg the same tS issued by the Director Stakes may not be driven mto the ground.
Sec. 17-33. Trails/Parkways/Pathways.
The DIrector of Parks & RecreatIOn or his/her agent or the Police Chief or an APCa shall
enforce all rules and regulatlons pcrtaInll1g to actlvttles upon any trail/parkway/pathway of the
Ctt) The Dtrector of Parks and RecreatIOn or Policc Chief shall have the authonty to
promulgate rules and regulatIOns govermng such trmls/parkways/pathways and copies of such
rules and regulations shall he on file with thc Department of Parks and RecreatIOn. the Police
Department and the City ClerK.

Sec. 17-34. Vandalism.
It IS unlawful to remove, destroy, damage or deface any park or open space property, or any
structure, or any vegetatIOn therem or to plant/harvest pieces/parts of such vegetatIOn.
Sec.17 -35. Vehicles.
(a) It shall be unlawful for any person operating a motorized vehicle of any descnption
whatsoever in any park (\r recreation area (\f the City to fail or refuse to obey any and all traffic
signs, or other traffic-control deVices regulating the operation, stopping or parkmg of vehIcles It
shall be unlawful for other than authonzed personnel to park or dnve on lawns, fields or any
other places other than upon roadways and parking arcas clearly constructed and established for
such purposes withm the parks, trails or other recreational factl1t1es of the City Laws pertaming
to strccts and highways pertam also to park roads, except that pedestnans shall have the nght-of-
way over vehicles m park areas.
(h) Parking wlthm or upon parks, open space, trails, parkways or recreation arcas shall not bc
penmtted at any time a park is closed, or in any area ordered closed by the Director. It shall be
unlawful to park so as to obstruct access roadways and parkmg areas or areas deSIgnated by sIgn
for emergency vehicles usc only Vehicles may bc parked 111 park and recreatIOn arcas only if the
occupants arc engaged 111 an activity connected with the areas.
(c) Washmg or seTvlcmg ofvchlclcs m any park or rccrcatlOn area m the CIty tS prohibited.
(d) All bicycle ndcrs shall obey tratlic signs and laws regulating the operatIOn, stoppmg or
parkmg of vehicles. Bicycle ndmg Will be governed further by safe ndmg practices and
consideratIOn for the use of park and recreation arc as and trails by others. Bicycle nding IS
prohIbited on playgrounds, tenms courts and game courts, m pavilions, m the conservatIOn area
or in any arca where other activltlcs are m progress. (Sec Sec 17-33)
Sec. 17-36. Weapons.
It ts unlawful to display, brandish, carry illcgally or to discharge or use wlthm any park or
recreation arca wtth m the City, any BB guns, pellet guns, and air guns, bows and arrows,
slingshots, pamtball guns etc., or any explOSive dcvtce or substance including fireworks.
Sec. 17-37. Winter sports.
(a) No ice skatmg or icc fishmg IS permittcd on any water body owned or managed by the City
or on any water body supcrvlsed by the Department or mcluded 111 any park or recreatIOn
faciltty unless thc specific area to be used IS so posted or public announcement has been made
by the Dtrector allowing such acttvtty When such areas are open for use, they are subject to

rules and regulatIOns on program and safety as Issued by the Duector
(b) lee hockey shall not be pCrImtted except m desIgnated areas as part of a Department

parkway or recreational area wlthm the City
Sec. 17-38. Workers, work areas.
The use of any park or recreatIOn area shall be relinqUIshed to any CIty or park employee
carrymg out work asslgnmcnts. Public use of areas m which mamtenance or othcr work
