HomeMy WebLinkAboutOrdinance-2006-1380 INTRODUCED BY COUNCIL MEMBER GOKEY Council Bill No. 30-2006 Ordinance No. 1380 Series of 2006 TITLE: AN ORDINANCE AMENDING SECTION 5-84 OF THE WHEAT RIDGE CODE OF LAWS PERTAINING TO THE PRESCRIPTIVE ENERGY CODE. WHEREAS, the City Council of the City of Wheat Ridge finds it in the public interest to encourage energy conservation; and WHEREAS, the City Council adopted a Prescriptive Energy Code in December 2004 which went into effect in January 2005; and WHEREAS, the City Council desires to amend said Prescriptive Energy Code. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO, THAT: Section 1. Section 5-84(b) of the Wheat Ridge Code of Laws is hereby amended as follows: (b) Amendments. The energy conservation code adopted by this section is hereby amended. . . . . Chapter 1. Administration 101.2 Scope Exception: 1. Builder may use the City of Wheat Ridge Prescriptive Energy Code as adopted by the City of Wheat Ridge instead of the 2003 Energy Conservation Code. The Prescriptive Energy Code requirements for the City of Wheat Ridge are listed below. In lieu of compliance with the Prescriptive Energy Code, energy calculations provided by a registered Colorado Engineer demonstrating compliance with the International Energy Code will be accepted prior to issuance of a building permit. Space Heating System Performance Gas Furnaces Gas boilers (including snow melt boilers) 90% .~ Sized according to ACCA/ANSI Manual J. 90% AFUE required for all new construction, unless REScheck or COMcheck indicates 80% AFUE will meet IECC. All replacement furnaces may be 80% AFUE. The City Council hereby finds, determines, and declares that this ordinance is promulgated under the general police power of the City of Wheat Ridge, that it is promulgated for the health, safety, and welfare of the public and that this ordinance is necessary for the preservation of health and safety and for the protection of public convenience and welfare. The City Council further determines that the ordinance bears a rational relation to the proper legislative object sought to be attained. Section 3. Severabilitv: Conflictinl! Ordinances Reoealed. If any section, subsection or clause of this ordinance shall be deemed to be unconstitutional or otherwise invalid, the validity of the remaining section, subsections and clauses shall not be affected thereby. All other ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. Section 4. Effective Date. This ordinance shall take effect 15 days after final publication.
