HomeMy WebLinkAboutOrdinance-2007-1386 CITY OF WHEAT RIDGE, COLORADO INTRODUCED BY COUNCIL MEMBER WOMBLE Council Bill No. 05-2007 Ordinance No. 1186 Series of 2007 TITLE: AN ORDINANCE APPROVING THE DISPOSITION OF CITY- OWNED PROPERTY LOCATED NEAR THE INTERSECTION OF 38TH AVENUE AND HIGH COURT. WHEREAS, the City owns certain property within the City near the intersection of 38th Avenue and High Court, more particularly described as the South 85 feet of the North 115 feet of the West 59.2 feet of the East 1306.5 feet of the Northeast % of Section 26, Township 3 South, Range 69 West of the 6th P.M., County of Jefferson, State of Colorado, also known as street address: 7172 W. 38th Avenue, Wheat Ridge, Colorado (the Property"); and WHEREAS, Section 16.5 of the Charter authorizes disposal of City-owned real property by ordinance approved by three-fourths of the entire City Council; and WHEREAS, the Council finds and determines that the Property is not needed for any municipal purpose and may be disposed of as permitted by the Charter; and WHEREAS, the Council wishes to approve the conveyance of the Property to Wheat Ridge 2020 for nominal consideration, the Council finding that conveyance serves a public purpose by facilitating redevelopment of the Property. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO: Section 1. Conveyance of Prooerty aooroved. The City Council hereby approves the conveyance of the above-described Property within the City of Wheat Ridge to Wheat Ridge 2020 for ten dollars (10.00) and other good and valuable consideration. Section 2. Deed authorized. The City Council hereby authorizes and directs the Mayor and City Clerk to execute a good and sufficient warranty deed, in form approved by the City Attorney, to complete the conveyance of the Property as authorized hereby. Section 4. Safety Clause. The City Council hereby finds, determines, and declares that this Ordinance is promulgated under the general police power of the City of Wheat Ridge, that it is promulgated for the health, safety, and welfare of the public C:IDocuments and SettingslkfieldlLocal SettingslTemporary Internet FileslOLK5Blordinance approving sale of property.DOC 1 and that this Ordinance is necessary for the preservation of health and safety and for the protection of public convenience and welfare. The City Council further determines that the Ordinance bears a rational relation to the proper legislative object sought to be attained. Section 5. Effective Date, This Ordinance shall take effect immediately upon adoption, as permitted by the Charter. INTRODUCED, READ, AND ADOPTED on first reading by a vote of L-to ---D-on the 23rd day of April, 2007, ordered published in full in a newspaper of general circulation in the City of Wheat Ridge and Public Hearing and consideration on final passage set for May 14, 2007, at 7:00 o'clock p.m., in the Council Chambers, 7500 West 29th Avenue, Wheat Ridge, Colorado.
