fhe two hundred and seventieth regular meeting of the Wheat Ridge
City Council was called to order by Mayor Homer Roesener at 7 35 p.m.
at 4355 Field.
Aldermen artending were Mary Jo Cavarra, Joseph Donaldson, Robert
How~rd Calvin Hulsey, Larry Merkl and Louise Turner.
Also attending were City Administrator John Jerman, City Attorney
William McCarthy, City Clerk Elise Brougham, staff and interested
cit.izens.
Motion by Alderman Merkl "I move that the Minutes of January 2, 1975
be deferred one week." Motion was seconded by Alderman Turner and
passed 6-0
Motion by Alderman Turner "I move that the Minutes of December 25,
1974 be approved with the minor changes which were submitted by
the City Clerk. The changes are on Page 2. seventh paragraph the
words 'HP-35 and HP-25' should be changed to 'HP-45 and HP-35'
res~ectively, and on Page 5. sixth paragraph the word 'west' should
be changed to 'east.'" Motion was seconded by Alderman Merkl 2nd passed
6-0.
Public Comment was made by
Gene Harlow of 4660 Estes, Chairman of the Mass Transit Committe8
stated that itBre are going to be 5 buses for Arvsda and Wheat Ridge
area, and there will be planning meetings regarding the routes. He
also stated there are some members who do not attend the Com~ittee
meetings, and that due to other commitments he is going to resign
the Chairmanship but will still be a committee member.
Alderman Cavarra asked if any attempt had been made to adjust the
fares of certain buses. Mr. Harlow stated RTD feels the express is
a service so they charge more, but he stated the committee would like
to see the fairs reduced. Alderman Cavarra recommended that Council
pass a Resolution for fair fares.
Alderman Turner asked if Council and the Mass Transit Committee would
have a chance to give input regarding the routes, and Mr. Harlow said
"Yes", meetings would be arranged.
Phyllis Lalcaster of 4076 Everette Street stated that she felt the
guardrail on the new bridge on West 44 Avenue was a hazard, and that
she felt a small child could be pushed through the open s~ace and
could fall into the creek, and that this was an access to the park
and playground. Mayor Roesener stated this had been a concern of
his and also mentioned the low height of the inner guard rail.
Motion by Alderman Cavarra "I move that Mr. Jerman authorize the
Public Works Department to look into the safety problem on the bridge
(pertaining to guard rails), and take whatever appropriate remedial
action is necessary." Motion was seconded by Alderman Turner and
passed 6-0.
Mr. Jerman stated that perhaps this coulG be consictered a change
order approved by the State due to safety, snd could be termed a
design defect. Alderman Turner st6ted it was her understanding
that when this was presented to the Council, it was stated to be the
accepted stand2rd design.
Mrs. Lancaster also asked the Mayor about 3 letter she had sent
to him regarding signs and had not yet received an answer. ~IRY~~
Roesener said a letter had recently been written, but that it is
a matter of priorities of what is handled first. Alderman Turne~
stated she felt this matter was important, and it is in the zoning
law of the City, and some signs do violate federal law also.

Mr. J.E. Morrison of 3820 Route Stre8~ stated his residence had been
on a water well for 19 years but now wanted to convert to Denver
Water, but has had difficulty getting a contractor ~o do the job.
He sta~ed contractors either won't do the job, or will charge him
$700 to cut a hole in the street, and he has to put up an additional
$250 bond. He now wants to do t-~e job himself and he is an engineer
and will be responsible for the work
Alderman Turner stated when Ordinance No. 131 was passed there were
numerous complaints by contractors with the main objection being
it would not be feasible to do little jobs, but only large ones.
She stated it had been determined that the ordinance would be rewritten
by a consulting firm, but to date nothing had been turned in.
Discussion followed, and it was determined that Mr. Jerman and Mr.
Morrison work out a solution the following day.
Report by the City Attorney concerning damages to the Dictaphone 4000
recorder incurred during the move to the Police Building was scheduled.
City Attorney McCarthy stated he had nothing new to report, and the
insurance company had not committed themselves.
Decision on installation of 4' walkway on W. 4~ Avenue was scheduled.
Mr. Glen Taylor, Public Works Director stated that far concrete to
be put on both sides of West 41 Avenue would cost $14,600.00, and
for asphalt it would cost $17,900.00. He estimated that High Court
would cost $2,800.00 and West 32 Avenue would cost $15,700.00 making
a total for all projects $33,000.00 for concrete, so there would be
enough money to buy the forms.
Alderman Merkl recommended putting in a walkway at the high rise on
West 38 Avenue for about 40'. Alderman Cavarra recommended instead
of putting walkways on both sides of a street, that it be on one side
and the money left over be used for other areas.
Alderman Howard stated Council is faced with the decision of putting
in improvements along people'S property, and questioned whether public
money should be spent for this. He stated it is the responsibility of
the property owner, and if this is started, people allover the City
will also want sidewalks. Alderman Donaldson stated the walkways
are needed for the school children for their public welfare, health
and safety.
Motion by Alderman Cavarra "I move we authorize the Public Works
Department to construct concrete walkways on one side of West 41
Avenue as determined by need, by use of the children walking to
school." THERE WAS NO SECOND AND MOTION DIEU.
Motion by Alderman Merkl "I move that the City of Wheat Ridge
authorize the construction of concrete walkways anywhere that walkways
are planned in the coming year for school children as follows
West 41 Avenue from Reed Street to Sheridan Blvd. on one side,
High Court from West 38 Avenue to West 35 Avenue on one side,
West 32 Avenue from Youngfield Street to Holland Street on one side,
and in other areas that may be decided such as on West ,8 '~venue in
front of the high rise." Motion was seconded by Alderman Lav2rr~.
Alderman Turner stated that the question was safety and that the
walkways should be separated, but that she was against a real estate
improvement and felt it would be hard to explain to people who had paid
for their own walkways. She stated the Engineering Dept. had added
extras such as radii and that there was still no itemization of retaining
walls which will be neBded. Alderman Hulsey stated in the past the
City had paved streets which were an improvement and that West 41
Avenue had !'BBn a top priority of the Planning Commission.

Motion to Amend by Alderman Cavarra "I move that the radii be
installed where it joins existing walkway, and that radii not
be installed in areas that have been developed without curb, gutter
and sidewalk." Motion was seconded by Alderman Donaldson and
WAS DEFEATED 4-2. Aldermen Hulsey, Merkl, Donaldson and Howard
voted "nay."
Alderman Howard stated that the City should have curb, gutter and side-
wllk, but that it was unwise to put only in special areas, and he
recommended a general improvement district.

Case WZ-74-29 a request far rezoning from Agricultural-On8 to Commercial-
one at 4855 Miller Street by Victor E. and Parcia J. LyrBfII'ln was heard.
Dennis Zwagerman, Director of Community Developement stated I-he
Land Use Plan recommends Industrial and that any commercial 8 i
allowable in industrial. He stated the Planning Department and PI ning
Commission recommend approval.
Mr. Maurice Fox, attorne~ for the applicants stated

have a plan

Commercial-Ore District or Commercial-Two District (is allowed) if

Motion by Alderman Merkl "I move that Case WZ-74-2Q (a request far
rezoning from Agricultural-One to Commercial-One) be approved for the
following reasons
1. It is in accordance with the Land Use Plan.
2. There is no opposition.
Motion was seconded by Alderman Hulsey and passed 4-2. Aldermen Turner
and Howard voted "nay." Alderman Turner stated she felt the rezoning
was not in keeping with the Land Use Plan, there is residential use
in the area and that this would be commercial encroachment.
Rezoning Case WZ-74-2b at 5530 West 38 Avenue from Commercial-One to
Proposed-Commercial-Two by Victor N. and Joel V. Prehn was scheduled
for Public Hearing and it was announced that the applicants had requested
that the case be continued until January 30 1975. Alderman Hulsey
requested reposti g of the property.
Request by the doard of Water and Sewer Commissioners of the City of
Lakewood that Wheat Ridge give consent that said Board can serve
Wheat Ridge residents if and when the Board acquires Consolidated
Mutual Water Company was scheduled. Mr. Jerman stated he had met
with the parties involved and there are some legal problems such
as whether the Compan\! can be acquired without condemnation. He
stated there is a State law ihal; a Cit~ can only serve citizens
of another City with permission of that City. The proposed Resolution
is to be redrafted a~d brought back to Wheat Ridge asking the Cit~'s
permission.
Discussion fallowed with the following comments That ~ire Chief
Jack Willis should be contacted for his comments, that there should
be a clause tating that the rates to the Wheat Ridge residents would
be no dilferBnt than for Lakewood residents, an explanation of what

from the water districts and associations within Wheat Ridge on
this matter. Mr. Ralph Johnson said he would check into this.
It was also asked if this would be a profit making plan for Lakewood.
Decision on two proposed parkinq plans at the Prospect Park redevelopment
was scheduled.
Motion by Alderman Cavarra "I move that we accept the parking plan
showing the double row of parking which has been approved by the
Parks and Recreation Commission, and for the reason that the original
plan did not provide adequate parking." Motion was seconded by Alderman
Donaldson and passed 4-2. Aldermen Howard and Hulsey voted "nay."
It was suggested that angle parking be looked into.
Motion by Alderman Merkl "I move that the City of Wheat Ridge approve
the payment of the estimated premium billing for State Workman's Compen-
sation in the amount of $10,378.00 to be distributed to the appropriate
Budget Code (as follows 409.11-$23.00, 411.11-$20.00, 412.11-$29.00,
413.11-$75.00, 415.11-$59.00, 416.11-$33.00, 417.11-$52.00, 418.11-$ i61.00,
419.11-$480.00, 420.11-$63.00, 422.11-$2,822.00, 423.11-$904.00, 424.1~-
$1,018.00, 4~5.11-$139.00, 440.11-$63.00, 441.11-$444.00, 450.11-$1, 05.00,

Alderman Turner and passed 6-0.
Ordinance No. 165 establishing new classifications, salary ranges, pay
grades and pay steps for 1975 was scheduled for second reading.
Alderman Turner asked if there were any job whose pay would be raised
by this Ordinance. Mr. Ralph Bartholomew, Personnel Officer stated
"Yes" that the City Service Worker II would be upgraded to City Service
Worker III in lieu of the automatic 6 month increase that City Service
Worker II received before. He also stated the two 'mechanics' which
are City Service Workers IV and V would keep the same graBs and be
designated Light Equipment and Heavy Equipment Operators, and at
future date could be upgraded to Automotive and Equipment Mechanic I
and II per Ordinance No. 165.
Alderman Turner also questioned the section that pertains to reclassifying
to a class at a lower pay grade if this was normal procedure and if
it could be done at anytime at the perogative of the Administrator and
the Mayor and Mr. Jerman answered "Yes."
Motion by Alderman Turner "I move that Grade 39, Police Sergeant
have the '(E)' dropped (for the exemption of overtime.)" Motion
was seconded by Alderman Merkl and WAS DEFEATED 4-2. Aldermen Cavarra,
Donaldson, Howard and Hulsey voted "nay."
Motion by Alderman Turner "I move that on Page 3. Section 3.(e)
be deleted." Said section pertained to reclassifying to a lower pay
grade. MOTION DIED FOR LACK OF A SECOND.

grades, and pay steps shall remain in effect hereafter until changed."
Motion was seconded by Alderman Hulsey and passed 5-1. Alderman Turner
voted "nay."

Motion by Alderman Cavarr8 "I move that Ordinance No 165 be
adopted as amended on second reading (and be ordered published
and posted.)" Motion was seconded by Alderman Donaldson and passed
5-1. Alderman Turner voted "nay."
Ordinance No. 167 authorizing a long term lease for parkland at Prospect
Park from Adolph Coors Co. was introduced by Alderman Merkl and
was read.
Motion by Alderman Merkl "I move that Ordinance No. 167 be
adopted on first reading (and be ordered published and posted.)"
Motion was seconded by Alderman Turner and passed 6-0.

Motion ~o Amend by Alderman Turner "I move we adjourn following
discussion of the Bauer Bill matter." Motion was seconded by Alderman
Howard and passed 5-1. Alderman Cavarra voted "nay."
Question was called on Amended Motion and passed 5-1. Alderman
Cavarra voted "nay."
Mr. Walt Grande, Finance Officer stated the bill from Everett Bauer
for repair work at the former Police Bldg. was over $1,000.00 without
Council approval. He stated that he told Mr. Bauer to keep the job
at $500.00 and Mr. Bauer didn't think it could be done at that price,
and after he had begun work he called Mr. Grande and told him of
ather expenses, and Mr. Grande gave his OK over the phone. He
stated the total bill was $1007.69, and recommended payment.
Mr. Jerman stated that this was slightly less than original bill and
that the original billing had been sketchy.
