HomeMy WebLinkAbout01/30/1975 lVlINUIES January 30, 1975 rhe two hundred and seventy-~hird regular meeting of the Wheal Ridge CiLy Council was called ~,o order by Mayor Homer Roesener at 7 3ll p.m. a~ 4355 Field Street. Aldermen aLtending were Mary Jo Cavarra, Joseph Donaldson, Robert Howard, Calvin Hulsey, Larry Merkl and Louise Turner. Also attending were City Administrator John Jerman, City Clerk EJ.ise Brougham, City Treasurer Ja~es Malone, staff and interested cil.izens. Motion by Alderman Turner "I move that the Minutes of January 15, 1975 be approved as presented, and tha. the Minutes of January 23, 1975 be deferred until next week." Motion was seconded by Alderman Donaldson and passed 5-1. Alderman Howard voted "nay." Treasurer's Budget and Appropriation Repor~ was presented by Citylreasurer James Malone. The report was for the month of December 1974. He stated t-he budget had been underestimated for the year bV $111,592.93 which had been compensated for. He sta ed the financial picture looked be+ter for Januarv Ulan i' did one month ago, and that f-,he receipts were up from January 1974. Mayor Roesener presented a placque to the Parks and Recreation Commission commemorating the joint City Council-Commission Efforts in successfully culminating the redevelopment plan for Prospect Park. Members present were Bob Vidick, Felix LePore, Bob HarLung, Bud Williams and Wendell Lynch. Introduction of the Committee for a Better Wheat Ridge (for distributing information regarding the sales tax and bond election) was made. Ihose present were Clare iraylor and Bill Cornelison - both Co-Chairmen, Peter Comack, Ed Hester, Joseph Healey John Lockridge, Shannon Geis, Ellen Runyan (Absent), LloVd PascalI, Orville Neeley, Elizabeth Peligren, Ann Herbert, Glen Owen, Dr. Dennis Floyd, Bonnie Scoma, Tom Woodford, Dwight lrickler, Don Ruterbories and ~r. and Mrs. Egan. The Committee adjourned to another building for a meeting after the following Motion. Motion by Alderman Hulsey "I move that Council give a vote of confidence to this Committee (for a Better Wheat Ridge.)" Motion was seconded by Alderman Merkl and passed 6-0. It was noted two students were in the audience from Mary Crest High School who were observing a City Council for a class. Mayor Roesener read a letter received from Van Schaack & Company commending the Wheat Ridge Fire Department for their response to a fire at Lakeside Shopping Center on 1/15/75. Mayor Roesener also stated that a Mr. Lockley of 3250 Gray Street had called him praising the Fire Dept 's response on a medical call to his home. Alderman iurner asked if city employees were slill allowed to answer calls. Mayor Roesener staled that employees could answer fire calls but thai many calls are for the Rescue Unil. and when the unit leaves it is fully manned which would then not be necessary for the employees to answer, and thai they can tell whar kind of call it is from the radio. Public Comment was made by Ben Thies, Chairman of the Public Works Commi 1ee read statements as follows He stared in general, the Committee fell i+ was advisable to work cooperatively with +he Ci'~ of Lakewood on projects in regards to the West 25 Avenue project. Also, the Commitlee recommended an orverlay for Wes+ 25 Ave. from hipling ~o Oak He requested further informalion as follows Delailed plan of "he area indicating a t-raffic MINUTES - January 30, 1975 - Con t inued -2- control plan for the area of the street adjacent 10 the Paramount Shopping Cenr.er. 2. More prBcise plans on the location of the walkway-bikeway west of the shopping centBr. 3. Specific cost figures of the City and the Denver Water Boardls contribution to the overlay. He also stated tha t regarding street paving, "In general, the commi j- tee is opposed to development agreements. If at all feasible the work should be done and paid for at the tim2 if development." It was sLated that Mr. Jerman would get them their requested information. Mr. Thies also asked what the source of funding was for the street lighting on Kipling. Mr. Jerman stated there was no cash outlay because the lights are attached to rhe existing poles, and that, the cost to the City would be electricil.y. Mr. Thies commented tha1- in the fut.ure he hoped that all projects would be referred to the Committee for their recommendation. Mr. James Stone, 3445 Garland stated he was speaking for Mr. Richard Ondrussk, Chairman of the Building Code Advisory Board -- and that the Board was a Board of appeals, and they were disappointed that Ihey had been bypassed regarding the recent action taken by the City regarding the Chief Building Inspector Jack Prose, and they wanted an explanation why they were bypassed. Mal,!T Roesener stated j-his was internal problem, and the action was felt necessary by I.he Mayor, Council and Cil.y Administrator. Alderman Turner stated the Ordinance which pertains to the Board specifies that complaints on the department go the the Board. It was a~reed that more items will be forwarded to the Board in the future. An Executive Session was scheduled for a presentation by Robert Johnson, bond attorney for the City regarding the bond and sales tax election. Nancy Snow of ~SS West 40 Avenue objected that this would be an executive session. Alderman Cavarra agreed. Alderman Howard objected to an Executive Session now, and suggested that it be later on the Agenda. It was stated that all of the Public Hearings would not be heard as itemized Rezoning Case WZ-74-31 was presently withdrawn, Rezoning Case WZ-74-26 was tabled indefinitely until the amendments to Ordinance No. 98 have come up, Rezoninq Case WZ-74-20 was cancelled because legal counsel was not available, and Application for change of ownership of Carefree Lounge was deferred upon req~est of the Chief of Police for further investigation. There was comment as to why public hearings are continually deferred. Motion by Alderman Merkl "I move that we go on with the Agenda, and that the requested Executive S~ssion (by Mr. Bob Johnson) be scheduled under the Councilor Mayor Report." Motion was seconded by Alderman Donaldson and passed 5-1. Alderman Cavarra voted "nay." Resolution No. 367 was introduced by Alderman Cavarra and was read. Said Resolution commended Mike Sipes for being selected as Teac~r Of the Year for the State of Colorado. Motion by Alderman Donaldson "I move that Resolution No. 357 be adopted." Motion was seconded by Alderman Turner and passed 6-0. Resolution No. 358 honoring Frances J. Laue, Curtis R. Hahn and David R. Shirley who were High School students at Jefferson H.S. for appearing on a television quiz show "It's Acsdemic" was introduced by Alderman Hulsey and was read. Motion by Alderman Merkl "I move that Resolution No. 368 be adopted." Motion was seconded by Alderman Turner and passed 6-0. Resolution to have City of Wheat Ridge give consent to the Lakewood Board of Wdter Sewer Commission for acquisition and operation of the Consolidated Mutual Water Co. lines in Wheat Ridge was scheduled. Mayor Roesener st-aled he would allow discussion of this Resolution and that as there were people in the audence interested in this mat tel', they would be allowed to speak. Mr. Hugh Henry, attorney for the Lakewood BOclrd of Water & Sewer Commissioners stated there was a problem of consolidation, and they wanted to find a solution for the citizens of both cities-Lakewood and Wheat Ridge. He recommended that the City designate someone to work with them. He also stated if Consolidated was taken over by them, it would be permissible to cut off the water to the Wheat Ridge residents if a solution was not worked out. Alderman Merkl commented that HB 1092, if passed, would need to be considered. Alderman lurner asked if it was legal 10 take over a company with bonded indebtedness, and if equitable distribution of the total assets of the company would be made for all st.ockholders, and if there was a chance I:hat, the company would notbe taken over un I:il 1982 whefl t-he bonds are paid off. Mr. Henry stated that presently no proposal had been made regarding stockholders. Alderman Turner also asked if it had been considered that Consolidated Mut.ual Water Co. take over the water districts. Mr. Henry stated that consolidation also involved the sewer lines. Rlderman Howard mentioned that here had been a study made on how to consolidate special districts, and that the Resolution should be compared to see if it needs some changes. Mr. Henry stated that they would need the consent of Wheat Ridge to serve the Wheat Ridge residents. Mr. Jerman noted there were two different Resolutions that h~d been distributed. Alderman Cavarra recommended that this item be taken up at the March Study Session. Mr. Ralph Johnson, City Engineer stated that perhaps other options should be considered that might be available and that action at this time might be premature, ~ in answer to a question he stated the water could not be I:urne~on Whec1t Ridge residents and t-hat the Denver Water Board would not tolerate such action. Virgil Hill, President and Manager of the Consolidated Mutual Water Co. stated that there are oti1er options to the unification problem which he personally favored, and at the beginning of the autonomous board approach idea it was understood that the consolidation would be on a voluntary basis. He stated Consolidated is unique because it has a responsibility to their stockholders, it is a complex problem, that. the only equitable way of distribution is through condemnation. He stat:ed the Consolidated Board is taking a positive approach, and in May at the stockholders meeting they will ask permission to expand their services which should relieve some of the water problems the City of Lakewood has. The proposal would broaden the contractural capabilities, and establish a new class of stockholders. Ordinance roo 167 was scheduled for second reading and the title was read. Said Ordinance authorized a long term lease of land al Prospect Park from Coors. Motion by Alderman Howard Works Commit~ee (for their Hulsey, and passed 6-0. "I move Iha t this be defeIlEd to the Public comment)." MOl.ion was seconded by Alderman Ordinance amending Ordinance No. 84 concerning special conlractor licenses was scheduled for first reading. Motion by Alderman Turner "I move that this be deferred to the Building Code Advisory Board for their commen~." Motion was seconded by Alderman Howard and passed 6-0. Ordinance amendinq Ordinance No. 109 concerning speed limits in school zones was scheduled for first reading. Mr. Jerman announced this would be deferred for the new City Attorney to draft. Motion by Alderman Howard "I move we defer Item 4 D. (Ordinance amending Ordinance No. 109.)" Motion was seconded by Alderman Hulsey and passed 6-0. Mayor Roesener stated he would like to see the City purchase more comfortable chairs for the city officials at the Council Meetings. Alderman Hulsey E'tated these chairs would be used by all commissions, boards and court. This was to be brought up 2/6/75. An Executive Session was held with Mr. Bob Johnson, legal bond counsel for the City. The chambers were cleared. After the Executive Session, it. was noted ihat the Ordinance and/or resolution calling for the election would be scheduled for 2/5/75. Motion by Alderman Merkl "I move we finish thai the meeting not go past 12 midnight." Alderman Donaldson and passed 6-0. the Agenda items, but Motion was seconded by Mr. Jerman's revenue report for the month of December 31, 1974 was distributed and no additional comment was made. Special report of the Public Works Director Glen Taylor concerning curb and gutter drainage design at W 38 Avenue and Lee Street was given. Mr. Taylor stated there was an overlay of West 38 Avenue done previously. He stated no changes were necessary on the engineering and the curb and gutter has been put in on W. 38 Avenue and the grade and field conform with the plan. West 38 Avenue has to be reconstructed at a future date, and the south half will then have to be rebuilt by the developer to remove sufficient amount of pavement along 38th and the adjacent street to match a projected cross-section for W. 38 Ave. which would reflect a 2% crown across the street from I;he center line. $16,000.00 has been paid and a development agreement was signed by the developer for these improvements which the City cannot require to be done before August 22, 1975. No escrows have been returned to date to the developer. He stated the escrow is for drainage work also except the portion adjacent to Lee Street. Alderman Turner asked whether the placement of curb and gui.ter is lower than the st-reet. Mr. Taylor stated it is lower than the slreet because"the sl-reet as it exists now is cons rllcted to a design standard ...and generally speaking, the cross-road is 2% from the centerline across to the flow line, and now (on W. 38 Avenue) the configuration of the sl.reet is more like Ihis (gesture). So in order to put the curb, guiter and sidewalk in at a projected future typical cross-section, it is necessary for us t,o have him 1-0 lower it, and at the "ime hat h8 paves i' 10 r8move sufficient pav8ment to allow Ih8 lowering of the street on rhe south.... MINU ITS - January 30, 1975 - Con ~inued -5- Mr. Taylor, in anSW8r to a q~estion stated the flow line (of 'he curb) is approximately b inches below +he centerline of the street. Preliminary application for block grant under Federal Community Development Act of 1974 was explained by Bob Richman, Planning Dept. He stated if ~h8 money is received many ~hings could be done with the money such as acquire land, restore buildings, lend money for repair of older houses with the interest 0 go to the City, rehabilitation of areas detrimental to health, establish child care centers etc. Alderman Merkl objected to sewage sys~ems being included since they are privately owned and part of the area being referred as a "slum area." Alderman Cavarra stated she felt federal money should be sought with caution and that perhaps this could be an encroachment on Revenue Sharing Funds which have no strings attached. Alderman Turner stated the application has to stretch the point to prove this is a poverty area, and that the funds ar8 intended for a truly poverty area. She questioned if there were matching funds from the City and Mr. Richman stated "No." Dennis Zwagerman, Director of Community Development stated the funding would be used to analyze and study the area for the need of recreational, cultural, environmental and housing improvements etc. Motion by Alderman Howard "I move that the City Administrator be authorized to proceed post haste for this application for federal assistance." Motion was seconded by Alderman Donaldson and passed b-O. Alderman Howard range planning. to ihe Planning is granted that stated that this is what the City needs, i.e. long Alderman Turner sLated she would like this referred Commission and Mr. Zwagerman stated that if approval public hearings are required at that time. The revised Shops and Yards Foreman classification specification had been distributed and had been previously discussed on 1/23/75. Motion by Alderman Merkl "I move we accept the revised Classification of Shops and Yards Foreman as presented by Mr. Jerman." Motion was seconded by Alderman Donaldson and passed 6-0. Alderman Turner requested that an evaluation of time lost, if any, driving the vehicles to the Public Works yard be made in 3 months. A reporr from the City Attorney William McCarthy was noted that the Colorad~ C~urt of Appeals had upheld the lower court's decision that JohnsonH~as in fact property of the City and an heir to the late Judge Samuel Johnson could not regain title and possession. A letter from Columbia Gardens Assoc. stating they were not apposed to the Lakewood Board of Water and Sewer Commissioners serving customers of Consolidated Mutual Water Ca. within the City of Wheat Ridge was acknowledged. A complete review of the Engineering Plans for street improvements previously approved on February 16, 1974 and inspection of those improvements completed to date indicates no revisions are necessary to the plans previously approved. 2. The contract P.W. 73-2 for W. 38th Avenue between Lee and Kipling was for an overlay only, due to the deterio- rating condition of the street surface and was not done in the light of reconstructing the street grade. The street improvements were designed at grades and crOss slopes (crown) to meet the required future typical section and to adequately provide for drainage. 3. It is recognized the portions of the existing pavement may have to be removed and the new pavement between the gutter and the existing pavement will be feathered into the existing pavement to provide approximately a 2% crown. 4.
