8E IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WHEAT
R lUGE:
That following public hearing and pursuant to notice, the
following Findings of Fact and Conclusions are hereby adopted:
1. That the petition of Dwaine R. Richter requesting
the annexation to the City of Wheat Ridge, of the following des-
cribed territory, situate in the County of Jefferson, and State of
Colorado, to wit:
Beginning at the southeast corner of Lot 1, Block 1,
Applewood Gardens Subdivision, Jefferson County,
Colorado; thence N 00 48.2' W along the westerly
line of Lots 1,2, 3,4, 5, 6 and 7 of said Block 1 a
distance of 583.43 feet to the northeast corner of said
Lot 7; thence continuing N 00 48.2' W a distance of
50 feet to the northerly line of West 33rd Avenue;
thence S 890 39' W along the northerly line of West
33rd Avenue a distance of 92 feet to the southeasterly
corner of the West 30 feet of Lot 5, Block 4 of said
Applewood Gardens Subdivision; thence northerly along
the easterly line of the west 30 feet of said Lot 5, a
distance of 130 feet to the north line of said Lot 5;
thence westerly along the northerly line of said Block 4 a
distance of 211.03 feet to a point 1062.48 feet west of
the east line of Lot 15, Roxbury Gardens, Jefferson County,
Colorado; thence northerly parallel to the east line of
said Lot 15 a distance of 205 feet to the north line of said
Lot 15; thence easterly along the north line of said Lot
15 a distance of 728.38 feet to a point 334.1 feet west of
the northeast corner of said Lot 15, said point being on
the westerly right-of-way line of Interstate Highway No.
1-70; thence southerly along the westerly right-of-way
line of said Highway for the following four courses:
S 60 37.5' W a distance of 119.2 feet; S 00 3D' E a
distance of 266.70 feet; S 890 40'W a distance of 32.8
feet; and S 60 31w a distance of 547.63 feet to a point
70 feet north of the south line of the NW 1/4 of Section 29,
T 3 S, R 69 W; thence continuing S 60 31' W a distance of
70.50 feet to the south line of the NW 1/4 of said Section
29, thence S 890 43.5' W along the south line of the NW 1/4
of said Section 29 a distance of 297.72 feet; thence N 00
48.2' W a distance of 30 feet to point of beginning.
having been accepted and a resolution adopted that said territory be
annexed to the City of Wheat Ridge by Ordinance.
NOW, THEREFORE, BE IT RESOLVED, That by said Ordinance the
annexed property be zoned as follows:
(a) COMMERCIAL-ONE (C-l): Beginning at the southeast cor-
ner of Lot 1, Block 1, APPLEWOOD GARDENS SUBDIVISION, Jef~erson
County, Colorado; thence N 0048.2' W along the Westerly 11ne
of Lots 1 ,2,3,4,5,t alld 7 of said Block 1 a distance of 96;,.43
feet to a point on the ~orth line of Lot 15 ROXBURY GARDENS'

of 425 .3~ feet to a poi ,t 334.1 feet west (;t the northeast
corner of said Lot 15, ~aid point being on tilL Westerly
rigilt-of-vlay line of Interstate Highway No. I-iJ; tilence
southerly along the Westerly right-of-way line of said
Highway for the following four courses: S 60 37.5' W

tance of 547.63 feet to a point 70 feet north of the south
line of the NW 1/4 of Section 29; T 3 S, R 69 W; thence
continuing S 60 31' \.J a distance of 70.50 feet to the south
line of the NW 1/4 of said Section 29; thence S 890 43.5'
W along the south line of the NW 1/4 of said Section 29 a
distance of 297.92 feet; thence N 00 48.2' W a distance of
30 feet to point of beginning.
(b) RESIuENTIAL THREE A (R-3A): Beginning at a point on
the South line of Lot 15, ROX8UR, GARDENS, Jefferson County,
Colorado, said point being 409.8' West of the westerly
right-of-way of Interstate Highway No. 1-70 and said point
also being 92 feet East of the northeast corner of the West
30 feet of Lot 5, Block 4 of APPLEWOOD GARDENS SU8DIVISION:
thence westerly along the northerly line of said Block 4, a
distance of 303.03 feet to a point 1062.48 feet West of the
east line of Lot 15, ROX~URY GARDENS, Jefferson County,
Colorado; thence northerly parallel to the east line of said
Lot 15 a distance of 205 feet to the North line of said Lot
15; thence easterly along the north line of said Lot 15 a
distance of 303.03 feet; thence south and parallel with the
east line of said Lot 15 a distance of 205 feet to the point
of beginning.
(c) RESIDENTIAL ONE A (R-1A): Beginning at a point on the
South 1 i ne of Lot 15, ROXBURY GARDENS, Jefferson County,
Colorado, said point being 409.8' West of the westerly right-
of-way line of Interstate Highway No. 1-70 and said point also
being 92 feet East of the northwest corner of the West 30 feet
of Lot 5, Block 4 of APPLEWOOD GARDENS SUBDIVISION; thence
westerly along the South line of Lot 15, ROXBURY GARDENS, a
distance of 92 feet; thence south along the east line of the
west 30' of Lot 5, Block 4 a distance of 130' to a point on the
north right-of-way line of West 33rd Avenue; thence easterly
and parallel with the south line of Lot 15, ROXBURY GARDENS
along the north right-of-way of West 33rd Avenue a distance of
92 feet, thence N 00 48.2' West and parallel with the East line
of the West 30 feet of Lot 5, Block 4 a distance of 130 feet
to point of beginning.
inasmuch as the above zoning would constitute the highest and best use
of said property, and would be compatible with the existing development
within the neighborhood.
