RESOLUTION NO. 222

TITLE: THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, STATE OF COLORADO
FINDINGS OF FACT AND RESOLUTION.
The City Council of the City of Wheat Ridge, State of Colorado,
having examined the filings, considered oral testimony of Council
and Petition for Annexation of certain real estate more fully described
in said petition, said petition having heretofore been filed with the
City Clerk of the City of Wheat Ridge, State of Colorado, by Steven
Burry, Jr., Helen G. Baumert, and Fred J. Fairchild,
FINDS AS FOLLOWS:
1. That the petition contains the following:
(a) An allegation that the signers of the petition comprise
the landowners of more than fifty per cent of the territory included in
the area proposed to be annexed, exclusive of streets and alleys.
(b) A request that the annexing municipality approve the
annexation of the area proposed to be annexed.
(c) The signatures of such landowners.
(d) The mailing address of each such signer.
(e) The legal description of the land owned by such signer.
(f) The date of signing of each signature.
(g) The affidavit of the circulator of each petition, whether
consisting of one or more sheets, that each signature therein is the
signature of the person whose name it purports to be.
2. That accompanying said petition have been filed four (4)
prints of an annexation map containing the following information:
(a) A written legal description of the boundaries of the
area proposed to be annexed.
(b) A map showing the boundary of the area proposed to be
annexed.
(c) Next to the boundary of the area proposed to be annexed is
drawn the contiguous boundary of the City of Wheat Ridge, and that the
dimensions of the contiguous boundary are shown on the map.
3. That no signature on the petition is dated more than one hundred
eighty (180) days prior to the date of filing the Petition for Annexation
with the City Clerk of the City of Wheat Ridge, State of Colorado.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WHEAT RIDGE, STATE OF COLORADO, that the Petition for the annexation
to the City of Wheat Ridge of the following territory, situate in the
County of Jefferson, and State of Colorado, to wit:

A part of the West one-half of Section 15, Township 3 South,
Range 63 We5t of the Sixth Principal Meridian, County of
Jefferson, State of Colorado, more particularly described
as follows: Commencing at the Northwest corner of the North-
east one-quarter of the Southwest one-quarter of said Section
15, said point lying on the centerline of Independence Street
as platted in Vada Heights, a subdivision recorded in Jefferson

County, Colorado; thence S. 0 02' 00" E. along the center-
line of Independence Street and along the Westerly boundary
of said Vada Heights subdivision 654.43 feet to the Point
of beginning; thence S. 730 06' 00" E. and along the Southerly
boundary of said subdivision 172.63 feet; thence N. 650 47'
00" E~ and along said Southerly boundary 451.24 feet; thence
N. 54 19' 00" E. and along said Southerly boundary 338.69 feet;
thence N. 700 44' 00" E. and along said Southerly boundary 75.46
feet; thence N. 230 07' 00" E. and along said Southerly boundary
180.62 feet; thence N. 590 17' 00" E. and along said Southerly
boundary and said Southerly boundary extended 271.95 feet to a
point on the North-South centerline of said Section 15, said
point being 31.75 feet Northerly of the center of said Section
15; thence S. 000 01' 00" W. along said North-South centerline
707.47 feet to a point on the Northerly right-of-way line of
the former D. & I. M. R. R. land (presently Public Service Co.
of Colo.); thence on an angle to the right of 850 22' 00" and
along said Northerly right-of-way line and along a curve to the
left having a radius of 5786.88 feet, a central angle of 110
14' 00" and an arc length of 1134.57 feet to a point of tangent;
thence S. 740 09' 00" W. along said tangent and along said
Northerly right-of-way line 215.23 feet; thence N. 000 02' 00"
W. along the centerline of said Independence Street extended
272.10 feet to the Point of Beginning, containing 10.840 acres
more or less.
is found to be valid and in substantisl compliance with the requirements
of the 1963 Colorado Revised Statutes, as Amended, 139-21-6(1).
BE IT FURTHER RESOLVED, that the City Council of the City of
Wheat Ridge will hold a hearing to determine if the proposed annexation
complies with and is found to be valid and in accordance with the 1963
Colorado Revised Statutes, as Amended, 139-21-3 and 139-21-4 or such
parts thereof as may be required to establish eilgibility for annexation
under the terms of the Municipal Annexation Act of 1965, and that said
hearing will be held on the 24th day of May , A. D.,
1973 at the hour of 7:30 o'clock p.m., at the Council Chambers located
at 7390 West 38th Avenue in the City of Wheat Ridge, State of Colorado.
BE IT FURTHER RESOLVED, that the City Clerk of the City of Wheat
Ridge give notice as required by the 1963 Colorado Revised Statutes,
as Amended, 139-21-7(2), and as may be required by any other applicable
laws of the State of Colorado.
