RESOLUTION NO. 276
Series of 1974
WHEREAS, the City of Wheat Ridge is to receive revenue from
Mountain Bell which represents unclaimed refunds due to customers of
Mountain Bell, and
WHEREAS, such revenue is to be kept separate from all other
revenue;
NOW, THEREFORE, BE IT RESOLVED that the City Treasurer be
authorized to establish in the name of the City of Wheat Ridge a
separate banking account and savings account at the Wheat Ridge National
Bank, Wheat Ridge, Colorado.
BE IT FURTHER RESOLVED that the City Treasurer be authorized,
in the name of the City, to collect, discount, negotiate, endorse and
assign all checks, drafts, notes and other negotiable or non-negotiable
instruments payable to this City, or in which this City has an interest,
and to draw, sign and deliver, in the name of this City, checks or
drafts ~gainst the funds of this City on deposit in Wheat Ridge National
Bank, Wheat Ridge, Colorado 80033.
BE IT FURTHER RESOLVED that for the purpose of deposit in the
account or accounts of this City with Wheat Ridge National Bank, Wheat
Ridge, Colorado, any officer of this City may endorse, sign or deliver
on behalf of this City, any checks, orders or other evidence of
indebtedness for the payment of moneys payable to the order of this City.
BE IT FURTHER RESOLVED that this authority revokes and super-
cedes all prior authority and the authority of the aforesaid officers
to perform each and all of the powers conferred by the foregoing
resolution shall continue until notice in writing, terminating such
authority, shall be served upon Wheat Ridge National Bank, Wheat Ridge,
Colorado, and shall be noted upon the certified copy of such resolutions
dolivered to said bank.

Gentlemen:
Enclosed is a check which represents the unclaimed refunds due customers of Mountain
Bell whose last known address was in your jurisdiction.
By order dated April 6, 1973 the Colorado Public Utilities Commission ordered Mountain
Bell to make refunds to its customers in Colorado in the amount of $3,196,488, with
interest, on their telephone service furnished during the period July 19, 1969 to
March 25, 1971. The Commission also ordered the Company to make distribution of any
amounts due customers who the Company was unable to locate prior to December 31, 1973,
to the municipality or county where the last known address or service address of the
customer was located. From our records we have compiled a list of the names of the
customers and amounts of refunds which remain unclaimed in your area and enclose a
copy of that list for your use. You will note that the amount of our check agrees
with the total from that list.
The Commission's order was made pursuant to C.R.S. 1963, Article 8 of Chapter 115
which states in substance, that where the rights to refunds of the amount overcharged
by a public utility have accrued to any municipality or county or the inhabitants
thereof, and a part of such refund has not been made because of the utility company's
inability to find the persons entitled thereto within the time limit fixed, any such
undistributed balance must be turned over to the municipality or county.
In addition, these statutes require that the municipality or county will be liable
to the unlocated subscribers for three years from the date of receipt of the funds
and shall pay the funds out to any person entitled thereto who can prove a claim in
any method satisfactory to the municipality or county. At the end of the three-year
period, any funds remaining unclaimed shall become the property of the municipality
or county.
