HomeMy WebLinkAboutResolution-1977-0505 INTRODUCED BY COUNCILMAN HULSEY RESOLUTION NO. 505 THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE STATE OF COLORADO FINDINGS OF FACT AND RESOLUTION The City Council of the City of Wheat Ridge, State of Colorado, having examined the filings, considered oral testimony of council and Petition for Annexation of certain real estate more fully described in said Petition, said Petition having heretofore been filed with the City Clerk of the City of Wheat Ridge, State of Colorado, by West Aspen Company, FINDS AS FOllOWS: 1. That the Petition contains the following: a. An allegation that the signers of the Petition comprise the landowners of more than fifty per cent of the territory included in the area proposed to be annexed, exclusive of streets and alleys. b. A request that the annexing municipality approve the annexation of the area proposed to be annexed. c. The signatures of such landowners. d. The mailing address of each such signer. e. The legal description of the land owned by such signer. f. The date of signing of each signature. g. The affidavit of the circulator of each petition, whether consisting of one or more sheets, that each signature therein is the signature of the person whose name it purports to be. 2. That accompanying said Petition have been filed four (4) prints of an annexation map containing the following information: a. A written legal description of the boundaries of the area proposed to be annexed. b. A map showing the boundary of the area proposed to be annexed. c. Next to the boundary of the area proposed to be annexed is drawn the contiguous boundary of the City of Wheat Ridge, the contiguous boundary of the City of Lakewood, which two cities surround the subject territory on approximately three-fourths of the proposed boundary, with the remaining one-fourth boundary being abutted by the unincorporated Jefferson County. RESOLUTION 505 3. That no signature on the Petition is dated more than one hundred eighty (180) days prior to the date of filing the Petition for Annexation with the City Clerk of the City of Wheat Ridge, State of Colorado. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, STATE OF COLORADO, That the Petition for the annexation to the City of Wheat Ridge of the following territory, situate in the County of Jefferson and State of Colorado, and fully described in Exhibit A attached hereto and incorporated herein, is found to be valid and in substantial compliance with the requirements of the 1973 Colorado Revised Statutes, as amended, 31-12-107. BE IT FURTHER RESOLVED, That the City Council of the City of Wheat Ridge will hold public hearings to determine if the proposed annexation complies with and is in accordance with the 1973 Colorado Revised Statutes, as amended, 31-12-107, or such parts thereof as may be required to establish eligibility for annexation under the terms of the Municipal Annexation Act of 1965, and that said hearings will be held on the 20th day of June , 1977, at the hour of 7:30 o'clock P.M., at 4355 Field Street, City of Wheat Ridge, State of Colorado. BE IT FURTHER RESOLVED, That the City Clerk of the City of Wheat Ridge give notice as required by the 1973 Colorado Revised Statutes, as amended, 31-12-108, and as may be required by any other applicable laws of the State of Colorado.
