MINUTES
January 19, 1975
The three hundred and fourteenth regular meeting of the Wheat Ridge
City Council was called to order by Mayor Frank Stites at 7 30 p. m.
at 4355 Field Street
Councilmen attending were Mary Jo Cavarra, Joseph Donaldson, Robert
Howard, Calvin Hulsey, Larry Merkl and Loui~e Turner.
Also attending were City Administrator John Jerman, City Attorney
Maurice Fox, City Clerk Elise Brougham, staff and interested citizens
Mayor Stites asked if there were objections or corrections to the
Minutes of 1/12/75 as published. Being none, the Minutes stood approved.
Case WS-75-05, Public Hearing on a final subdivisim plat by Ralph
Jacobson, Applewood Knolls 12th Filing at West 32 Avenue and Quail
Street which is zoned Residential-One was scheduled. Harold Lutz, attorney
represented the applicant who was also present. He stated that the
5 points raised in the memo from Forrest Smith which were contingent
upon approval by Council on the preliminary plat had been resolved
The Planning Dept. recommended that curb and gutter be installed only
on the cuI-de-sac and along West 32 Avenue due to topography, drainage
and size of Lot 5. The developer will escrow for the street improvements,
paving and sign a development agreement for the remaining improvements
and pay a $75/10t park fee. Wright-McLaughlin Engineer had reviewed
the drainage plan and found it generally acceptable and the developer
has accepted the flood limit line of the Lena Gulch flood study.
The Planning Commission recommended approval. The School District suggested
east-west pedestrian circulation around 33 Ave.
Mr. Ron Holley of 410 Hoyt water engineer gave testimony regarding
the drainage plan.
Opposition was as follows A letter from Ernestine Williams, Alan
Quick of 3423 Simms and Marilyn Repsher of 3358 Swadley who recommended
that Lot 5 should not be built on, and Wayne Olson of 11555 West 35
Avenue who questioned access to his land.
Motion by Councilman Merkl "I move we approve the final plan for Case
WS-75-05 for the following reasons
1. The applicant has agreed to accept the line of the new flood
plain map as designated by Wright McLaughlin and all other recommendations
of the Wright McLaughlin Engineering Firm.
2. Curb, gutter and sidewalk ~nstalle~ as stipulated by the staff,
and also that curb, gutter and sidewalk along W. 32 Avenue be placed
at the edge of the Right of Way." Motion was seconded by Councilman
Donaldson.
Motion to Amend by Councilman Turner "I move the City purchase Lot 1
for open space with the price to be worked out with Mr. Jacobson."
Motion was seconded by Councilman Cavarra and was DEFEATED 4-2.
Councilmen Donaldson, Howard, Hulsey and Merkl voted "nay."
Motion to Amend by Councilman Turner "I move the City purchase open
space easement to preclude development of more than 1 building on
Lot 5 with the price to be negotiated with Mr. Jacobson." MOTION WAS
NOT SECONDED AND DIED.
Motion to Amend by Councilman Turner "I move that there be an Bfuot
pedestrian access from the West between 2 and 3 of the subdivision
and Quail Street." Motion was seconded by Councilman Cavarra and
WAS DEFEATED 4-2. Councilmen Donaldson, Howard, Hulsey and Merkl
voted "nay."
Discussion followed and Councilman Merkl reworded his Motion as
follows and the second approved
Motion "I move that we approve the final plan for Case WS-75-05
for the following reasons

Question was called and MOTION TIED 3-3. Councilmen Howard, Turner
and Cavarra voted "nay." Mayor Stites voted "aye" and MOTION PASSED 4-3.
It was announced that a final plat for Moder Subdivision at Reed
Street between W. 31 Avenue and W. 32 Avenue was continued until
1/26/75 upon request of the applicant.
Application by Kipling 5000 for creation of a Special Assessment
District and recommendation for retention of a legal advisor and
financial advisor was scheduled. Dwight Griggs, attorney and
applicant for Kipling 5000 was present. It was discussed that the
area of Olympia Ridge would be included.
Motion by Councilman Merkl "I move the Council authorize Mr. Jerman
and the Mayor to retain Hanifen, Imhoff and Samfom Inc. for financial
cGnsultants and Willson and Lamm, attorneys at la~ as the professional
legal consultants for the MSID improvements for the Kipling 5000 Corp.,
for this one project only." Motion was seconded by Councilman Hulsey
and passed 4-2. Councilmen Turner and Howard voted "nay."
Motion by Councilman Merkl "I move the Council authorize the Mayor
to enter into the Indemnification Agreement with Kipling 5000 Corporation."
Motion was seconded by Councilman Donaldson and passed 4-2. Coundlman
Howard and Turner voted "nay." (This agreement included designating
Don Cowan of Cowan Engineering & Surveying Co. as the project engineer.)
A Public Hearing for the District will be scheduled in the future.
Motion by Councilman Merkl "I move we don't meet the week of February 15th."
Motion was seconded by Councilman Donaldson and passed 5-0. (Feb. 15th
is Washington's Birthday, a legal holiday for the City.)
Dr. Albert Burke, 911 Coordinator to Jefferson County was present who
stated the report dated 10/30/74 on the communication center had not had
the intent to centralize the dispatching or have storage of evidence
etc. in the building. He sta~tddit is now his understanding that
there is a proposal for a new w~t~ these ideas and in his opinion
it would be money wasted.
Motion by Councilman Merkl "I move the City of Wheat Ridge immediately
contact Lakewood and Arvada and announce that we are no longer going
to participate in joint effort for 911 and put all our efforts into
warking on a 911 system with Jefferson County on the Ralph White Study."
Motion was seconded by Councilman Hulsey and passed 5-0.
It was also suggested to have a meeting with Dr. Burke for further explanation
etc. of the 911 system.
A list of 11 engineering firms with their credentials had been
distributed who would be eligible to do the City's 1976 street work.
Motion by COIJncilman Cavarra "I move that the staff with the approval
of the City Council prepare a street improvement bid package for 1975
to be submitted to these firms with the intention of reviB~ng. the
lowest 3 proposals." Motion was seconded by Councilman Turner and
WAS DEFEATED 4-2. Councilmen Donaldson, Howard, Hulsey, and Merkl voted
"nay."

was seconded by Councilman Cavarra and passed 5-1. Councilman Turner
voted "nay."
Motion by Councilman Merkl "I move the proposed future roadway st.udy be
submitted to the 9 engineering firms as presented to us by Mr. Jerman
for bids." Motion was 8econded by Councilman Hulsey and passed 5-1.
Councilman Turner voted "nay."
Mr. Jerman stated the Director of Parks and Recreation had several
projects that he would also like to be engineered such as restrooms
at Prospect Park, tennis courts, parking areas etc.

Motion by Councilman Merkl "I move we suspend the Rules of Procedure
pertaining to the 11 o'clock adjournment of the meetings and have no
end set on tonight's meeting." Motion was seconded by Councilman
Cavarra and passed 5-0.
A report on the background and status of the proposed walkway along
West 32 Avenue had been distributed and also an estimated cost to
install curb, gutter and sidewal~ ~lBng West 32 Ave. from Youngfield
to Sheridan was included. It was~~~at the Federal Highway Administration
stated bikeways have to be 8' which was questioned. The question was
brought up what was the definition of a bikeway and sidewalk, and
due to cost, the possibility of an asphalt bikeway.
Motion by Councilman Cavarra "I move this item be tabled until
Mr. Jerman can secure information from the state Highway Dept.
regarding the requirements with the safety grant." Motion was seconded
by Councilman Merkl and passed 5-0.
City Attornev Fox stated he had prepared an amendment to the Subdivision
Regulations requiring public improvements and a drainage plan to be
shown on the plat, and an amendment to Ordinance No. 98 providing rules
for Public Hearings at the Planning Commission & Council level
It was stated that these would be placed on a future Agenda.
Council Reports were made by
Councilman Hulsev asked when the school limit signs would be
up and was informed due to a problem on the order, they would be
up in approximately 2 or 3 weeks.
Councilman Merkl reported that there will be a meeting with RTD, Wed.,
at 7 30 p.m. in the conference room in the Mayor's office on the
townrider bus, and bus schedules etc.
Mavor Stites sta~ed he would like to expedite the 1975 street program
for the City and named the following to a Street Improvement Committee
Larry Merkl,Chairman, Calvin Hulsey and Mary Jo Cavarra. He named
the following to be on the Community Development Committee to work with
the Comprehensive Plan Joseph Donald::on, Chrmn, Robert HOuJ8id and
Louise Turner.

Mr. Jerman otatBd thB developer h~d bEen exempted DV the City in

which is in the vicinity of the Sod House and suggested that the City
pay for this on the developer's bid package. The new Street
Committee is to look into this.
Councilman Cavarra recommended that the City pursue annexing the
enclave (Lee Sand & Gravel) on Youngfield. City Attorney Fox is
to pursue this.
Councilman Merkl reported that the City is deficient in many areas of
fire hydrants and suggested that ways be looked into setting up
special improvemnt districts for placemenr of the hydrants and also
looking into consolidating the fire districts.
Motion by Councilman Merkl

Motion by Councilman Merkl "I move we pay the dues to the Colorado
Municipal League in the amount of $4,355.59 to be charged to Account 410.50."
Motion was seconded by Councilman Howard and passed 5-0.
The meeting was adjourned at 11 30 p.m.
STUDY SESSION
Dennis Zwagerman was present to receive recommendations from Council
as to what they wanted in their packets on rezoning and subdivision
cases. It was suggested to have a simple map of the site showing
the surrounding zoning by means of the zoning symbols and the dimensions
of the lot in question etc., to have in the file a picture of the posting,
a check list of agencies granting approval and explanation if not.
He was also directed to update the blue zoning book and supply land
use maps in the books. He will formulate a revised packet proposal.
Mr. Z~8qerman also had a proposal of building division forms and the
permit fees. He recommended the condensation of 9 permit forms
into 2. He also recommended that the Mayor's signature not be on
the miscellaneous permit form and would only have to sign the permit
involving a new structure or addition. It was indicated that this was
in the realm of Mayor for decision. He also suggested changing the
fees to be in line with the type of construction and all fees would
be included in the one charge. The proposed fee for garages, carports,
patios etc. was questioned and the proposal was referred to the
Building Code Advisory Committee for their comments. The fee schedule
will be brought back in the form of an ordinance amendment.
A draft of Street Cut amendment was scheduled for discussion. City
Attorney Fox stated he included a section to allow emergency work,
a section for a $25 fee for each permit for water districts and companies,
a section requiring financial guarantee except water districts.
He stated a revised copy will be drawn and scheduled later for action.
Discussion on a revised penal code was scheduled. City Attorney Fox
asked for direction as to whether he should revise the Lakewood Code
to fit Wheat Ridge or only have cases in the code that are not
covered by the Colorado Criminal Code which would in turn hae the
cases tried at the County instead of the municipal court. The
concensus was to have the entire penal code brought in and that the
noise section could not be regulated and should be deleted.
An all day retreat for Council for a program by Dyna-Com Resources
in analyzing their role was tabled until a representative of the
company could come to explain the session. This was scheduled for
2/2/75.
Mavor Stites proposed that the Council try a consent Agenda format
where items are discussed beforehand and then at time of action
can be grouped together for adoption by a resolution~ He also .

between regular bU5inEbb nleeting5 and that the fifth Monday would
be for additional business. It was agreed to trv this proposal.
Renewal of an agreement with the Town of Mountain View for the City
to maintain certain streets and be reimbursed was scheduled.
It was suggested by the Public Works Director to limit this to
snow and ice removal and salt and sanding. It was agreed to notify
Mountain View that the City was not in a position to continue
the agreement and that the City would provide backup help in
case of an emergency.
Council agreed to participate in the DRCOG minority internship program
and Mr. Jerman recommended Charlene Gonzales. There is no cost to
the City.
Council declined to join the United Stated Conference of Mayors
at a cost of $500 annual dues.
Discussion on city policy regarding unpaved and half-paved streets
was referred to the new Street Improvement Committee.
An executive session was held after the meeting.
The Study Session adjourned at 1 05 a.m.

PROPOSED WORK PROGRAM
CITY OF WHEAT RIDGE, COLORADO
FUTURE ROADWAY CAPACITY STUDY
Introduction
The City of Wheat Ridge is currently developing a Comprehensive
Master Plan to guide future development of the City
A critical
input into the preparation of the ~1aster Plan is the traffic
planning element involving roadway travel lane requirements based
on future traffic volumes and land use planning.
On the basis of a need for a traffic planning element, the City
is planning to obtain the services of a traffic engineering con-
sultant to undertake a work program with the following objectives:
1 Determine future traffic volumes on specific roadways in
the City for the year 2000.
2. On the basis of the future land use and traffic volumes,
determine physical and operational roadway characteristics
which will function at an acceptable level of service.
Scope of Work
The roadways included ~n this proposed project are as follows:
A. Youngfield Street from West 32nd Avenue north to West 44th
Avenue
B. West 32nd Avenue from Youngfield Street east to Sheridan
Boulevard

Work Program Major Elements
In order to satisfy the needs of this study, the selected con-
sultant will prepare the following documents:
1. A Traffic Flow Map indicating future average daily traffic
(ADT-year 2000) on the roadways outlined above.
2. Roadway travel lane requirements and minimum rights-of-
way to accommodate the projected traffic volumes at an
acceptable service level. Typical cross-sections will
be prepared of each roadway under study.
3. For each roadway, a general identification and description
of traffic control devices such as
a. Traffic signals
b. Special turning lanes
c. Center Median and/or divider
d. Type of access control
e. Signing
f. Channelization and pavement markings

consultant must be determined with due consideration of:
a. Traffic volumes as projected by the State Department
of Highways
b. City's projected land use planning
c. The review and approval of appropriate City officials
