RESOLUTION NO. 637

TITLE: RESOLUTION AUTHORIZING EMINENT DOMAIN PROCEEDINGS FOR THE ACQUISITION
OF THE CROWN HILL PROPERTY
WHEREAS, the Cities of Wheat Ridge and Lakewood and County of Jefferson
have jointly agreed to acquire the Crown Hill property for Parks and Open Space
purposes to be purchased from the Jefferson County Open Space Fund with each
jurisdiction paying an agreed upon share of the total price, and
WHEREAS, sufficient funds are available in the Jefferson County Open Space
Fund to complete this purchase, and
WHEREAS, it may be necessary to file a proceeding in eminent domain to
acquire the property, and
WHEREAS, the Board of County Commissioners of Jefferson County authorized
initiation of eminent domain action, and it is the desire of the City of Wheat
Ridge to join in such action with the City of Lakewood and Jefferson County.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Wheat
Ridge, that eminent domain proceedings be authorized immediately for the
acquisition of the Crwon Hill property, and
BE IT FURTHER RESOLVED that the City of Wheat Ridge reaffirms that its
share of the total purchase price, as determined through eminent domain pro-
ceedings, shall not exceed 25% of the total purchase price, and
BE IT FURTHER RESOLVED that Joseph M. Montano, Attorney at Law, of the
firm of Gorsuch, Kirgis, Campbell, Walker and Grover, is authorized to rep-
resent the City of Wheat Ridge as special legal counsel in the eminent domain
proceedings and that all costs and expenses of the proceeding be paid from the
Jefferson County Open Space Fund in the same proportion as the purchase price.
DONE AND RESOLVED this 9th day of April, A.D. 1979, by a
vote of 6 to 0
