HomeMy WebLinkAboutResolution-1979-0651 INTRODUCED BY COUNCILMEMBER CAVARRA RESOLUTION NO. 651 Series of 1979 TITLE: RESOLUTION AUTHORIZING THE APPRAISAL AND PURCHASE OF THE VAN HOOSER PROPERTY CONSISTING OF APPROXIMATELY 9.84 ACRES OR SOME PORTION THEREOF, LOCATED EASTERLY OF KIPLING STREET ADJACENT TO CLEAR CREEK FROM WHEAT RIDGE'S SHARE OF THE JEFFERSON COUNTY PARKS AND OPEN SPACE FUND. WHEREAS, the City will require a portion of the Van Hooser property, con- sisting of approximately 9.84 acres or some portion thereof, located easterly of Kipling Street adjacent to Clear Creek for the construction of flood control improvements on Lena Gulch, and WHEREAS, the City will also require a portion of this property for access to a footbridge over Clear Creek as an extension of Independence Court, and WHEREAS, the City's appraiser has reported that the acquisition of separate portions of the Van Hooser property may be more costly than the acquisi- tion of the entire parcel due to severance damages, and WHEREAS, this property qualifies for acquisition under the Jefferson County Parks and Open Space Program, provided the Open Space Fund is reimbursed for any specific sections of the property which will be used for other than Parks and Open Space purposes, such as flood control. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Wheat Ridge that the Van Hooser property, consisting of 9.84 acres, or some portion thereof, be appraised and acquired under the Jefferson County Open Space Fund, subject to the Fund being reimbursed by the City and Urban Flood Control and Drainage District for the portion used for flood control; BE IT FURTHER RESOLVED that the appraisal report include market values for (1) the portion to be utilized for Lena Gulch improvement only; (2) that portion to be used for Lena Gulch improvement plus Open Space; and (3) the entire parcel of 9.84 acres; BE IT FURTHER RESOLVED that the Jefferson County Board of County Commissioners be requested to acquire the property as soon as possible under the conditions outlined in this Resolution; BE IT FURTHER RESOLVED that the cost of the appraisal for the property be taken from Wheat Ridge's attributable share of the Open Space Fund.
