HomeMy WebLinkAboutResolution-1980-0675 INTRODUCED BY COUNCILMEMBER MERKL RESOLUTION NO. 675 Series of 1980 TITLE: RESOLUTION AUTHORIZING NEGOTIATIONS FOR THE ACQUISITION OF A PORTION OF THE PROPERTY LOCATED AT 3975 KIPLING STREET IN WHEAT RIDGE, ALSO KNOvVN AS 1'HE BLEVINS PROPERTY FOR PARKS AND OPEN SPACE PURPOSES UNDER THE JEFFERSON COUNTY OPEN SPACE PROGRAM AND LENA GULCH STOIDl DRAINAGE PURPOSES IN CONJUNCTION WITH THE URBAN DRAINAGE AND FLOOD CON~ROL DISTRICT. WHEREAS, the City is interested In the acquisition of land for dual public uses of open space and storm drainage along Lena Gulch; and WHEREAS, the City shows in the Comprehensive Development Plan a trail along Lena Gulch which also connects to Clear Creek in the vicinity of Kipling Street; and WHEREAS, the City Comprehensive Development Plan shows a green Parks and Open Space designation on the Future Land Use Map for the total Lena Gulch corridor and Clear Creek corridor; and WHEREAS, the City is working with the Urban Drainage and Flood Control District to construct storm drainage improvements along Lena Gulch, which improvements contain a trail and a grass lined channel, wherever possible, to maintain the open character of the gulch area; and WHEREAS, the City has retained Ivilliam Woolford and Associates to expedite land acquisition schedule for this project; and WHEREAS, the City has need for the expeditious donation or purchase of this land so that the construction of trails and drainage improvements can be started; and WHEREAS, Jefferson County Open Space Funds can be used for buying open spaces and providing trails; and WHEREAS, the Urban Drainage and Flood Control Funds can be used for the purpose of buying structures; and WHEREAS, the City desires to encourage the donation of land whenever possible; and WHEREAS, the completion of this project will require the donation or purchase of land ,in fee or the donation or purchase of easements of portions of the property at 3975 Kipling Street; and WHEREAS, a qualified appraisal has already been completed on the above property; and WHEREAS, In the event a donation is not agreed to by the owner, then it will be necessary to negotiate a fair and equitable prlce based on qualified appraisals for the property needed by the City; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Wheat Ridge, that City Staff be authorized to request from the owner of the property at 3975 Kipling Street the donation in fee of one 4,569.44 sq. ft. portion of this land and another 50 sq. ft. portion of this land, and the donation of a temporary easement comprising 3,102.44 sq. ft.; and BE IT FURTHER RESOLVED that the City is authorized to negotiate a purchase, if necessary, and may utilize the services of William Woolford and Associates at the discretion of the Mayor; and BE IT FURTHER RESOLVED that Jefferson County Open Space start Open Space purchase approval procedures through the Open Space Committee and County Commissioners for property to be purchased in fee. When such approval is received the Jefferson County Open Space through its Executive Director shall take over the negotiation and purchase of the above mentioned portions of the property from the City at a logical and cost effective point. Any purchase will be made in the name of the County if the proper County approvals have been secured. If it is necessary to purchase in the name of the City, prior to the completion of the County Open Space approved purchase, the property will be transferred to Jefferson County Open Space to allow for the normal Open Space purchase procedures; and BE IT FURTHER RESOLVED that Jefferson County Open Space be requested to approve the use of Open Space funds for all of the proper expenses involved in the acquisition of the property including but not limited to an appraisal, real estate negotiation, and the preparation of needed legal documents for the property transfer.
