TITLE: RESOLUTION AUTHO!UZING THE NEGOTL\TION AND .\CQUISITION
OF THE PROPERTY LOCATED A.T THE SOUTHtvEST CORNER OF \vEST
41ST }WENUEI\ND KIPLEJG STRE:CT IN lJHEAT RIDGE, ALSO
KNO\m l\S THE JENS:CI1 PROPERTY.
WHEREAS, the City is interested in the acquisition of
land for dual public uses of open soace and storm drainage along
Lena Gulch; and
WHEREAS, the City is working with the Urban Drainage and
Flood Control District to construct storm drainage improvements
along Lena Gulch, which improvements contain a trail and a grass
lined channel, wherever possible, to maintain the open character
o~ the gulch area: and
WHEREAS, the completion of this oroject will require the
donation or purchase of land in fee or the donation or nurchase
of easements of portions of the Jensen Droperty; and
WHEREAS, in the event a donation is not agreed to by the
owner, then it will be necessary to negotiate a fair and equitable
Drice based on a qualified aDnraisal for the property needed by
the City;
NOH, THEnEFORE, BE IT RESOLVED by the City Council of
the City of Wheat Ridge, that City Staff be authorized to request
from the owner of the Jensen property the donation in fee or in
easements, as required, of property needed by the City at the Jensen
pro?erty; and
BE IT FURTHER RESOLVED by the City Council of the City of
Wheat Ridge, that City Staff be authorized to negotiate a purchase
prlce for easements or fee title ownership, purchase and Drepare
documents for closin~ the Jensen oroperty, if necessary, subject
to final aDproval by Council of the purchase price.
