RESOLUTION NO. 710
Series of 1980
TITLE: RESOLUTION AUTHORIZING THE CITY TO INITIATE CONDEMNATION
PROCEEDINGS IN ORDER TO ACQUIRE PORTIONS OF THE WELLER
PROPERTY LOCATED AT 10105 WEST 38TH AVENUE IN WHEAT RIDGE.
WHEREAS, the City requires the acquisition of land for dual
public uses of open space and storm drainage along Lena Gulch; and
WHEREAS, the City Council in Resolution 702, Series of 1980,
authorized negotiations for the acquisition of portions of property
at 10105 West 38th Avenue needed in order to complete this project; and
WHEREAS, said negotiations have failed to produce a result
satisfactory to the needs of the City in connection with this project;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Wheat Ridge that the City Attorney be authorized to initiate
immediate action in the condemnation of the following parcels of
land located at 10105 West 38th Avenue:
1. As permanent easement, a parcel described In the attached legal
description: Lena Gulch Drainageway Acquisition No. 1.105.1 (Exhibit A).
Said easement shall be used for storm drainage and Jefferson County
Open Space purposes.
2. In fee title, a parcel described in the attached legal description:
Lena Gulch Drainageway Acquisition No. 1.105.2 (Exhibit B).
3. As a temporary construction easement, a parcel described In the
attached legal description: Lena Gulch Drainageway Acquisition
No. 1.105 C (Exhibit C).

of Beginning;

thence on a deflection right of 590-00', 32.0 feet;
thence on a defl ect ion left of 610-10', 67.0 feet;
thence on a deflection right of 500-00' , 47.0 feet;
thence on a deflection right of 300-40' , 180.0 feet;
thence on a deflection left of 280-10' , 53.0 feet;
thence on a deflection left of 480-40', 74.0 feet;

County, Colorado, described as follows:
Commencing at the Southeast corner of the West 1/2 of the East 1/2 of the
Southeast 1/4 of the Southeast 1/4;
thence Northerly 30.0 feet along the East line of the West 1/2 to the True
Point of Beginning, said, point lying on the North right-of-way I ine of West
38th Avenue;
thence Northerly 296.4 feet more or less along the East line of said West
1/2;
thc~cc C~ ~ deflection left 990 30',20.28 feet to a point which lies 20.0
feet West of said East line;
thence Southerly parallel to said East line, 293.0 feet more or less to a
point on the North right-of-way line of West 38th Avenue;
thence Easterly 20.0 feet along said North right-of-way line to the True
Point of Beginning containing 5,894 square feet or 0.135 Acres more or less.
Said acquisition is a portion of the property described in Book 656 Page 208 of
the Jefferson County Records.
