Series of 1980 ~1E RKL 719 TITLE: A RESOLUTION ENDORSING PASSAGE OF THREE SEPARATE AMENDMENTS TO THE JEFFERSON COUNTY OPEN SPACE SALES TAX RESOLUTION TO BE SUBMITTED TO THE VOTERS OF JEFFERSON COUNTY BY THE BOARD OF COUNTY COMMISSIONERS. WHEREAS, the Jefferson County Board of Commissioners has passed Resolutions CC 80-841, CC 80-712, and CC 80-879 providing for the submissions to the registered electors of Jefferson County at the next general election of three separate questions amending the Jefferson County Open Space Sales Tax Resolution; and WHEREAS, the questions to be submitted to the voters of Jefferson County at the next general election as set forth above are as follows: Question No.1. Shall the proposal of the Board of County Commissioners of Jefferson County, Colorado, to amend the Jefferson County Open Space Sales Tax Resolution to authorize the use of fifty per cent of the existing one- half of one percent open space sales tax for the purpose of paying the acquisition costs of a Jail and Sheriff's Facility, including without limitation the pledge of any revenues derived therefrom to the payment of bonds, leases and other obligations incurred in connection therewith, such authorization to terminate on December 31, 1996, or such earlier date as such costs are satisfied, as more particularly provided by Resolution No. CC 80-840, be approved? Question No.2. Shall the proposal of the Board of County Commissioners of Jefferson County, Colorado, to amend the Jefferson County Open Space Sales Tax Resolution to provide that after deduction of Jefferson County Administrative expenses, fifty-five percent of the sales tax proceeds which are available for open space acquisitions and other open space purposes, be deemed attributable to those municipalities which are located wholly or partly in Jefferson County, as more particularly provided by Resolution No. CC 80-711, be approved? Question No.3. Shall the proposal of the Board of County Commissioners of Jefferson County, Colorado, to amend the Jefferson County Open Space Sales Tax Resolution to provide that the proceeds of the tax which are available for open space acquisitions and other open space purposes may also be spent for the construction, acquisition, and maintenance of park and recreational capital improvements, as more particularly provided by Resolution No. CC 80-711, be approved? WHEREAS, the United States District Court for the District of Colorado has ordered Jefferson County to pursue the financing of the Jail and Sheriff facility by submitting to the voters a question diverting one-half of the open space sales tax for that purpose; and WHEREAS, the proposed diversion of one-half of the open space sales tax will not result in an increased tax to the residents of this city; and WHEREAS, the United States District Court for the District of Colorado has further ordered that if the election for diversion of one-half of the open space sales tax fails, that the county will be obligated to impose a substantial tax increase upon the property owners in the county including those residing in this city; and WHEREAS, the City Council does not favor the imposition of any additional property taxes upon the citizens of this city; and WHEREAS, the City Council, therefore, favors the diversion of the open space sales tax as proposed so as to maintain taxes at the same level; and WHEREAS, the City Council favors an increase in the percentage of the sales tax proceeds available for open space purposes which may be expended at the Cities' request be increased from 35% to 55%; and WHEREAS, the City Council favors the expenditure of the Jefferson County Open Space Funds for the construction, acquisition, and maintenance of park and recreational improvements. NOW, THEREFORE, be it Resolved by the City Council of the City of Wheat Ridge, Colorado, that it endorses all of the proposals hereinabove set forth which are to be separately submitted to the registered electors of Jefferson County at the next general election, and urges approval thereof.
