HomeMy WebLinkAbout09/20/1976 MINUTES Sept.ember 20, 19~5 The St.ud, 6e8sior of ~he Wheat Ridge City Council was called to order by Mayor pro tem Joseph Donaldson at 7 30 p.m. at 4355 Field Street founcilmen present were Mary Jo Cavarra, Robert Howard, Calvin Hulsey, Larry Merkl and Louise Turner Also present were City Administrator John Jerman, City Attorney Maurice Fox, City Clerk Elis~ Brougham, staff and interested citizens Mayor Frank Stites was absent. Item 1 waa a presentation by Brannan Sand and Gravel at 6 30 p.m. at Prospect Park on the park development and gravel extract.ion. The Council, Planning Commission and Park am Recreation Commission were invited to attend. Mr. Warren Cruise of Brannan Sand & Gravel and Mr. Langdon gave a presentation with aerial photos of a proposed development for a bikepath and reestablishment of growth. They stated they will work with Coors and that this area is an exploratory conceptual, pilot approach to determine if it is satisfactory to all parties. Mr. Cruise requested permission from Council to mine the North and West slope of the east lake. It was agreed to place these items on the 9/27/75 Agenda. Item 2. was a joint discussion with the City Council and Planning Commission on the Comprehensive Plan. Dennis Zwagerman, Director of Community Development read a policy statement from the Planning Commission regarding revisions in the Transportation Plan as adopted by Council. The statement is attached to the Minutes. He stated they would like 2 additional street standards adopted regarding collector streets that have 50' ROW, and where major streets intersect 60' ROW is needed for a third lane with a distance of 200' approximately. He stated wherever possible the sidewalks would be detached. The majority of Council reject,ed the extension of Simms Street from W 38 Ave. to W. 44 stating that it would be built over a bluff and would be in the middle of the greenbelt. The extension of Simms from W. 38 Ave. to W. 32nd was considered feasible. It was stated this could be brought up at a future meeting by anyone who voted in the affirmative of passing the adoption of the existing Street Design Standards of the City as the Transportation Plan portion of the Comprehensive Plan. Dennis Zwaqerman also read a policy statement from the Planning Commission on the Land Use Plan and on zoning. This is attached to the Minutes. City Attorney Fox stated the total Comprehensive Plan goes from the Planning Commission to the City Council and any major change on the plan is prepared and adopted by the Planning Commission and is then approved by the Council. He stated the zoning map shows what use could be on the land, the Land Use map shows the actual use, and the Future Land Use Plan shows future land use and in itself does not change the zoning. Regarding the zoning policy, Councilmen Hulsey and Turner objected to rezoning land without the owners consent and that rezoning of an area could be initiated by the owners and then could be acted upon. Councilmen Merkl and Cavarra felt it was justified to rezone certain property to match the use. It was agreed that adoption of the Future Land Use Plan ,ihould be scheduled and the zoning matter would be handled in the future. Item 3. was a discussion of Councilman Merkl's idea of installing curb and gutter city-wide. He stated the curb and gutter is needed to tie in with the drainage projects the City is doing. He stated he would like this studied by the City Attorney as to forming districts selling bonds and excluding areas where there is existing sidewalk. It was suggested that an engineer discuss the efficiency and need of curb and gutter for drainage areas etc. It was agreed to have the engineer discuss curb and gutter who is doing the present drainage projects. MINUTES - 9/20/75 - Continued -2- Item 4. was a request by Councilman Merkl for an ordinance requiring the removal of snow, ice and debris from curb, gutters and sidewalks. City Attorney Fox stared the Code Enforcement Officer would enforce this ordinance A citizen asked if instead of passing an ordinance, that public information be encouraged for the safety of the pedestrians and school children. The majority of Council agreed to place the Ordinance on the 9/27/75 Agenda for action Item 5. was a discussion of the vote requirements for the passage of ordinances and resolutions. City Attorney Fox stated the revised Rules of Procedure state "All ordinances, and all resolutions and orders for the appropriation of money shall require for their passage or adoption the concurrence of a majority of all the members elected to the governing body." He stated the revised state law has omitted the comma after the word "ordinances" but that it would be advisable to follow the policy of requiring all ordinances to require the majority vote. He stated Ordinance No. 201 passed 3-2 on first reading and 4-2 on second reading and that this could be included in a future amending ordinance on Ordinance No. 98 he will prepare regarding Section 21., and that this is the only Ordinance with a problem back to March 1974 when the Rules of Procedure were adopted. The question was brought up if a Councilman could leave a vote on an ordinance. Councilman Cavarra suggested that if there was no public comment or amendment of second reading the written vote should count. City Attorney Fox stated resolutiorn appropriating money need the majority vote but this did not include resolutions transferring funds already appropriated within the City'S budget. He stated state law requires the Mayor to vote on all matters involving a tie vote except on Ordinances. Councilman Cavarra requested that the Street Committee consider the need for shaping the shoulders of the roads because the gravel and sand accumulates and water runs between the edge of the asphalt and in many areas is destroying the edge of the asphalt. The Committee members agreed this should be done and Mr. Jerman is to take care of this project. Councilman Hulsey requested that a Resolution be placed on the 9/27/75 Agenda protesting the closing of grade schools in Wheat Ridge. The sch ols involved are Martensen, Columbia Heights and Mountain View. Mr. Jerman announced that September 22nd is the Council's Study Session on the Budget and September 27th is the PublE Hearing on the Operating Budget. {I' .A ."
