RESOLUTION NO. 883

TITLE: RESOLUTION AUTHORIZING THE MAYOR TO SIGN THE INTERGOVERNMENTAL
AGREEMENT ENTITLED REQUEST FOR PAYMENT AND CERTIFICATION OF
USE OF FUNDS FOR THE ROOF REPLACEMENT ON THE BRICK MUSEUM
LOCATED IN THE WHEAT RIDGE HISTORICAL PARK.
WHEREAS, the citizens of Jefferson County passed an Open
Space Resolution on November 7, 1972; and
WHEREAS, the citizens amended said Resolution on November 4,
1980 to allow for maintenance and development of Open Space lands
and property; and
WHEREAS, the City of Wheat Ridge wishes to replace the roof
of the brick museum; and
WHEREAS, this brick museum is to be used for Parks and
Recreation purposes; and
WHEREAS, it is in the best interest of the city of Wheat
Ridge to enter into the Intergovernmental Agreement which is attached
to this Resolution; and
WHEREAS, Section l4.2 of the Home Rule Charter of the city of
Wheat Ridge authorizes the City of Wheat Ridge, by Resolution, to
enter into Intergovernmental Agreements.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Wheat Ridge that the Intergovernmental Agreement entitled
Request for Payment and Certification of Use of Funds, attached to
this Resolution be approved, and the Mayor be authorized to sign said
Intergovernmental Agreement.

REQUEST FOR PAYMENT AND
CERTIFICATION OF USE OF FUNDS
The City of Wheat Ridge hereby requests from the Board
of County Commissioners of Jefferson County, State of
Colorado, payment from the Jefferson County Open Space
fund in the amount of Forty-Nine Thousand Four Hundred
Ninety Six Dollars and No Cents ($49,496.00), payable
100% from its attributable share of Open Space funds, but
not to exceed the present portion of its attributable
share received subsequent to January l, 1981.
This request constitutes a certification by the
City Council of Wheat Ridge, Colorado to the Board of
County Commissioners of Jefferson County that the City
of Wheat Ridge entered into a contract with C & R
Electrical Contractors on March 13, 1984, a copy of
which is attached as Exhibit "A", for the sum of
Forty-Nine Thousand Four Hundred Ninety Six Dollars and
No Cents ($49,496.00), for the sports lighting project
at Prospect Park all of which constitute purposes which
are authorized by the Jefferson County Open Space
Resolution as adopted by the voters on November 7,
1972 and amended on November 4, 1980.
In the event the total cost of the contract work
is less than Forty-Nine Thousand Four Hundred Ninety
Six Dollars and No Cents ($49,496.00), the City of
Wheat Ridge, Colorado will refund the unexpended funds
to Jefferson County within 30 days after the final cost
under the contract is determined, to be credited to
the City of Wheat Ridge's attributable share of the
Jefferson County Open Space Fund.
In accordance with the Jefferson County Open Space Resolution,
the County, or its designated representative, may, if it
so desires, audit the work papers and audit utilized by
the City of Wheat Ridge, Colorado to determine the final
cost under the contract. This certification and request
has been duly authorized by Resolution # 886
adopted
by the City Council of Wheat Ridge, Colorado on March 12,
1984, a copy of which is attached, by which the City Council
of Wheat Ridge certlfies to the Board of County Commissioners
of Jefferson County that the Open Space funds specified
herein will be expended only for the purposes stated and
authorizes the Mayor of the City of Wheat Ridge, Colorado
to sign this Request for Payment and Certification of Use
of Funds.
