ANNEXATION INFORMATION (Follow-up)
1. Effective date of annexation, required filings. Territory annexed
to a municipality as hereinbefore provided shall be annexed upon
the effective date of the annexing ordinance, except for tax pur-
poses, as provided in this section.
2. Within thirty (30) days after the effective date of such annexing
ordinance, the annexing municipality shall:
a. File one copy of the annexation map, if any, with the original
of the annexation ordinance in the office of the Clerk of the
annexing municipality.
b. File one certified copy of the annexing ordinance and one copy
of the annexation map, if any, with the Secretary of State.
c. File for recording one certified copy of the annexation ordinance
and one copy of the annexation map, if any, with the Clerk and
Recorder of the County in which the land was located prior to
annexation.
d. File same with the Clerk and Recorder of the County in which the
land is situated after the annexation is completed.
In any action attacking the validity of an annexation proceeding,
failure of the annexing municipality to have made the filings required
by the section shall not be deemed to invalidate the annexation
where good cause for such failure is shown.
3. The annexation shall be effective for the purpose of general taxation
on and after the first day of January the next ensuing year.
4. Check Colorado Municipal League Book for information on annexations
changing county lines.
5. Also, file one certified copy of the annexing ordinance and one copy
of the annexation map, if any, with the Division of Local Government.

TERRITORY IN THE COUNTY OF JEFFERSON
STATE OF COLORADO, TO nlE CITY OF WHEAT RIDGE
STATE OF COLORADO
TO THE MAYOR AND THE CITY COUNCIL OF TilE CITY OF WHEAT RIDGE,
COLORADO:
The undersigned, in accordance with the Municipal Annexation
Act of 1965, Chapter 303, Session Laws of Colorado 1965, herehy
petition the City Council of the City of Wheat Ridge for annexation
to the City of Wheat Ridge of the following descrihed unincorporated
territory, located in the County of Jefferson, State of Colorado,
to wit:
^ part of the West one-half of Section 15, Township 3
South, Range 69 West of the Sixth Principal Meridian,
County of Jefferson, State of Colorado, more parti-
cularly described as follows:
Commencing at the Northwest corner of the Northeast
one-quarter of the Southwest one-quarter of said Sec-
tion 15, sald point lying on the centerline of Inde-
pendence Street as platted in Vada Heights, a sub-
division recorded in Jefferson County, Colorado;
thence S. 0002'00" E. along the centerline of Inde-
pendence Street and along the Westerly boundary of
said Vada lIeights subdivision 654.43 feet to the Point
of beginning; thence S.73006'OO"[;. and along the South-
erly boundary of said subdivision 172.63 feet; thence
N. 65047'00"E. and algng said Southerly boundary 451.
24 feet; thence N. 54 19'00"E. and along said Southerly
noundary 338.69 feet; thence N.70044'OO"E. and along
said Southerly boundary 175.46 feet; thence N.23007'

point on the North-South centerline of said Section 15,

erly right-of-way line of the former D & I.M.R.R. land
(presently Public Service Co. of Colo.); thence on an
angle to the right of 85022'00" and along said North-
erly right-of-way line and along a curve to the left
having a radius of 5786.88 feet, a central angle of
1l014'Ol" and an arc length of 1134.57 feet to a point
of tangent; thence S. 74009' OO"W. along said tangent and
along said Northerly right-of-way line 215.23 feet;
thence N.OOo02'OO"W. along the centerline of said Inde-
pendence Street extended 272.10 feet to the Point of
Beginning, containing 10.840 acres more or less.
In support of the said Petition, your Petitioner alleges that:
1. It is desirable and necessary that the above described
terri tory be annexed to the City of Wheat hidge..
2. Not less than one-sixth of the perimeter of the area pro-
posed to be annexed is contiguous with the City of Wheat Ridge.
3. A community of interest exists bptween the territory pro-
posed to be annexed and the City of Wheat Ridge.
4. The territory proposed to be annexed IS urban or will be
urbanized in the near future.
5, The territory proposed to be annexed is integrated or IS
capable of being integrated with the City of Wheat Ridge.
6. The territory proposed to he annexed will not result in the
detachment from any School District nor will it attach to any other
School Vistrict other than which it is now located.
7. No land held in identical ownership, whether consisting of
one tract or parcel of real estate or two or more contiguous tracts
or parcels of real estate:
(a) is divided into separate parts or parcels without the
written consent of the landowner or landowners there-
of, unless such tracts or parcels are separated by a
dedicated street, road or other public way;
(b) comprising twenty acres or more and which together
with the buildings and improvements situated thereon,
has an assessed value in excess of Two Hundred
Thousand Dollars for ad valorum tax purposes for the
year preceding the annexation is included within the
territory proposed to be annexed without the written
consent of the landowner or landowners;
8. The signers of the Petition comprise the landowners of more
than fifty percent of the territory included in the area proposed
to be annexed, exclusive of streets and alleys.
9. The mailing addresses of the signers, the legal description
of the land owner by each signer, and the date of signing of each
signature are all shown on this Petition.
10. Attached to this PetItion is the affidavit of the circular
of this Petition that each signature hereon is the signature of the
person whose name it purports to be.
Your Petitioners further request that the City of Wheat Ridge
approve the annexation of the area proposed to be annexed.

BEFORE THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE
STATE OF COLORADO
FINDINGS OF FACT AND RESOUJTION
The City council of the City of Wheat Ridge, State of Colorado,
having examined the filings, considered oral testimony of counsel
and petitioned for annexation of certain real estate more fully des-
cribed in said Petition, said Petition having heretofore been filed
with the City Clerk of the City of Wheat Ridge, State of Colorado,
by Steven Burry, .Jr., Ilelen (;. Baumert, and Fred .J. Fairchild,
FINDS AS POLLOWS:
1. That the petition contains the following:
a. An allegation that the requirements of Section 139-21-3
and Section 139-21-4 exist or are met;
b. An allegation that the signer of the petition comprIses
the landowner of more than fifty percent of the terri-
tory included in the area proposed to be annexed, ex-
clusive of streets and alleys;
c. A request that the annexing municipality approve the
annexation of the area proposed to be annexed;
d. The signature of such landowner;
e. The mailing address of such signer;
f. The legal description of the land owned by such sIgner;
g. The date of signing of such signature;
h. The affidavit of the circulator of each petition, whether
consisting of onr or more sheets, that each signature
therein is the signature of the person whose name it
purports to be.
2. That accompanying said petition having been filed four (4)
prints of an annexation map containing the following information:
a. A written legal description of the boundaries of the
area proposed to be annexed;
b. A map showing the boundary of the area proposed to be
annexed;
c. Next to the boundary of the area proposed to be annexed
is drawn the contiguous boundary of the City of Wheat
Ridge, and that the dimensions of the contiguous bound-
ary are shown on the map.
3. That no signature on the petition is dated more than one
hundred eighty (ISO) days prior to the date of filing the Petition
for annexation w1th the City Clerk of the City of Wheat Ridge, State
of Colorado.
4. That the petition is signed by the Owner of 100% of the pro-
perty proposed to be annexed, exclusive of streets and alleys.

lowing described territory, situate in the County of Jeffer-
son and State of Colorado, to wit:

The City Council of the City of Wheat Ridge, State of Colorado,
having examined the filings, considered oral testimony of Council
and Petition for Annexation of certain real estate more fully described
in said petition, said petition having heretofore been filed with the
City Clerk of the City of Wheat Ridge, State of Colorado, by Steven
Burry, Jr., Helen G. Baumert, and Fred J. Fairehild,
FINDS AS FOLLOWS:
1. That the petition contains the following:
(a) An allegation that the signers of the petition comprise
the landowners of more than fifty per cent of the territory included in
the area proposed to be annexed, exclusive of streets and alleys.
(b) A request that the annexing municipality approve the
annexation of the area proposed to be annexed.
(c) The signatures of such landowners.
(d) The mailing address of each such signer.

residential, additional ROW would be acquired at the time of subdivision,

vision and it is the best use of the land.

Alderman Abramson asked what the height was above Clear Creek, and
Mr. Deorio stated that the property was not in the Flood Plain.
Mavor Anderson stated that since the surrounding area was all single
family use and if granted this would be spot zoning, and if this
property were rezoned then there would be a trend for multiple family
use but that he didn't see the trend now.
Mr. Deorio stated that he felt the area was developing toward multiple
family use and on Jellison Street there are apartments, that they would
"keep up" the property and are homeowners in Wheat Ridg themselves.
Alderman Cavarra asked if the land could be developed as Residential-One-A
or Residential-Two. Mr. Oeorio stated that they had an extensive investment
in the land and that duplexes are the most profitable.
Alderman Howard asked how long they had owned the property, and the
answer was 7-8 months.
Motion by Alderman Abramson: "I move that Case WZ-73-07 pertaining to
a proposed rezoning from Residential-One-A to Residential-Two-A located
at 4242 Jellison be tabled for one week for d decioion to be made during
the normal course of the meeting on May 31, 1973." Motion was seconded

ANNEXATION INFORMATION t (Follow-up)
1. Effective date af annexatian, required filings. Territary annexed
ta a municipality as hereinbefare pravided shall be annexed upan
the Effective date of the annexing ordinance, except fDr tax pur-
poses, as pravided in this section.
2. Within thirty (30) days after the effective date Df such annexing
ordinance, the annexing municipality shall;
a. File Dne copy Df the annexation map, if any, with the original
of the annexatian ordinance in the affice of the Clerk of the
annexing municipality.
b. File Dne certified CDPy of the annexing ordinance and one copy
of the annexatian map, if any, with the Secretary of State.
c. File for recarding ane certified copy af the annexation ordinance
and one copy Df the annexatian map, if any, with the Clerk and
RecDrder of the County in which the land was lacated prior to
annexation.
d~ File same with the Clerk and RecDrder af the County in which the
land is situated after the annexation is completed.
In any action attacking the validity of an annexatiDn proceeding,
failure Df the annexing municipality ta have made the filings required
by the sectian shall nat be deemed tD invalidate the annexatian

3. The annexatian shall be effective fDr the purpDse Df general taxatian
