Tha two huntired and forty-ninth regular meeting of the Wheat RilJge
City Council was called to order by Mayor Frank Stites at 7 30 p m
at 4355 Field Street.
Councilman present were
Hulsey, Larry Merkl and
absent
Mary Jo Cavarra, Joseph Donaldson, Calvin
Louise Turner. Councilman f10bert Howard was
Also present were City Administrator John Jerman, City Attorney
Maurice Fox, City Treasurer James Malone, City Cler~ Elise Brougham,
staff and interested citizens.
There being no corrections or delptions to the Min~tes of 12/27/76,
the Mayor declared them approveG as written.
Item 1. was a decision scheduled for Case MS-76-o3 an application
by Raymond J. Johnson requesting approval of a Minor Subdivision
locaten at 9201-05 W. 44 Ave. A report From the Director of
Community Development had been distributed on the status of the accessory
building use on the property.

be tabled a minimum of 3D days until 2/14/77 and at that time the
case is to be reviewed by the City Attorney." Motion was seconded
by Councilman Donaldson and passed 5-0.
Item 2. was approval of the cost of the Valley Water District
Project Conduit 119 For street reconstruction and for soil tests
to be performed at City expense. Mr. Cochrel, attorney, Mr. Howard
Bunger, engineer and Mr. Roach, President of the Board of Directors
of Valley Water District were present. Mr. Cochrel stated they
desired to cooperste with the City fully and would save trees and
replant in the Clear Creek area as necessary, the driveways would
be finished to the property line etc. Councilman Merkl brought the
possibility of correcting the crown and grade of streets if necessary
and Mr. Cochrel sct~d this had not been discussed previously. Mayor
Stites stated the cguld chec~ the grade and crown of the streets
to see if there would be a foreseeable problem.
Motion by Councilman Cavarra "I move Council approve the agreement
proposed by Valley Water District set forth in the letter from Robinson-
Robinson attorneys at law dated 12/15/76 and authorize the Mayor to
enter into the agreement recognizing that the amoun~ set forth are
estimates only to be charged to Account 31-504-840." r~otion was
seconded by Councilman Turner and passed 5-0. Councilman Donaldson
voted "aye", Councilman Hulsey voted "aye", Councilman r~erkl voted "aye",
Councilman Turner voted "aye" and Councilman Cavarra voted "aye."

Motion by Councilman Cavarra "I move Council authorize the Mayor
to enter into an agreement for soil testing in connection with
Conduit No. 11q in an amount not to exceed $1500 to be charged to
Account 31-504-840." Motion was seconded by Councilman Donaldson and
passed 5-0.
Item 3 was Resolution No. 486 introduced by Councilman Merkl commending
the city employees for their achievements during 1976. The Resolution
was read in full.

Item 4. was the Mayor's appointment to replace a vacancy on the
Planning Commission which was Robert L. Reischman residing at
37QO Depew.
Motion by Councilman Merkl "I move that Council ratify the
appointment of Bob ReiEchman to the Planning Commission." Motion
was seconded by Louncilman Hulsey and passed 5-0.
Mr. Jerman had distr buted to Council the information given to
each architectural firm for design of the new city hall Council
agreed to half hour interviews with each firm on 1/11/77
in the evening and if needed a final meeting would be on 1/14/77.
Mr. Jerman is to make the arrangements.
Councilman Merk~ stated that there was ~ ~roblem at Lehrer's Flowers
at W. 2q Ave. and Lamar due to water running from the greenhouse
onto the street and building up a large icy area. City Attorney Fox
stated they are responsible for the discharge of water. It was stated
that the City had to send out equipment to correct the problem and
Councilman Merkl requested that the cost to the City be recovered.
Motion by Councilman Merkl "I move that the Ci ty direct Lehrer's
Flower located at W. 29 Ave. and Lamar to cease discharge of water
from the property boundary into the property of the City or other
private property, said discharge (stoppage) is to be completed within
48 hours. Should Lehrer's Flowers fail to follow this directive, I
further move that the City seek injunctive or retraining relief in
the District Court." Motion was seconded by Councilman Donaldson and
passed 5-0.
Councilman Hulsey questioned how long W. 44 Ave. would be closed
due to a sewer project and stated that the agreement had not mentioned
that the street would be closed. Mr. Jerman stated due to faulty ground
structure there had been an emergency situation and the contractor had
had to close the street. City Attorney Fox agreed to contact the
sewer district to urge them to take action as quickly as possible.
Councilman Cavarra recommended that an ordinance be written or it
be written in each contract that whenever a major street is closed,
the contractor be required to work 7 days a week to prevent undue
inconvenience.
Meeting was adjourned at 8 30 p.m.
STUDY SESSION
Item 2. was a representative from hKBNA to explain cost for additional
work on Drainage Projects. Mr. Browning from tho firm was present
and Clyde Hobbs Director of Public Works was present. A report from
the Public Works dept. was distributed and is attachod to the Minutes.
Councilman Merkl felt the 7 day extension for the crosspans at 34th
and 35th was excessive and that the repair at 35th and Newland was
the contractor's fault since the first job had to be redone, and that
the City should not be charged for this.
Mr. Drowning stated the contractor had been given a 45 day extension
to fi ni sh the work un ti 1 12/3/76 and Ile sti 11 wasno t fi ni shed. He
also stated their bill overrun was caused because their initial
cost was not based on any extension of work and also the approval of
Council to do the alternate design work was the bulk of the increase.
He stated he personally delivered the preliminary design report and
a cover letter giving the cost to the Public Works Dept. on 5/19/75.
Mr. Hobbs states that this was not received at that time. Council
felt the work had been done and authorized and the bill should be
paid. This was placed on the 1/10/77 Agenda.

Item 3. was a report from Galbraith & Green Inc. to report on health
insurance bi ds. f oi f' tri buted an 8xtensi V8 report. He recommended
Prudential Plan 2 anc! nolee! that this was not as extensive coverage
as Blue Cross such as Ilaving a denuctible and less materni tv benefi ts
etc. and it also required a chanj~ov8r for the life insurance etc
However, the premium was less than Blue Cross. The next plan
he recommended was Prudential Plan 1 and then the 8lue Croffi plan
and rJropping pr8ferrRd services. lie is to look into the coverage
difference regardin1l outpatients and the decision on the insurance
is scheduled for next week's Agenda.
Item 1. was a report from Richard Andrews, Director of Adm~nistrative
Services on the meetings with the Civil Service Lommission, Personnel
Commission and employees regarding the pay incentive proposal. The
report was distributed. He also gave corrections for various positions
regarding their pay and parity range
Mr. Malone stated the two Accounting Clerks in his office had been
compared with Account Clerks in other cities and that as a result
the parity study was not correct for these two positions and they
should have a reclassification of their jobs. Council felt that
a review of the job descriptions etc. should be done.
City Attorney Fox stated the increase in salaries is not funded
and the funds should be transferred from the Unallocated Reserve
by resolution before the increase is granted. Councilman Cavarra
requested a listing of the total cost to the city for employees
in wage increases, health insurance, life insurance and existing
wage. Councilman Merkl felt that increasing the outpatient
and maternity benefits should be looked at to see what the additional
cost would be for this also. Council agreed to place this on the
1/17/77 Study Session.
Item 4. was a report from the Public Works Engineer, Jesse Russell
recommending that no left turn lane be placed at the intersection
of W. 38 Ave. and Kipling.
Item 5. was a revision of the Security Guard Ordinance prepared
by City Attorney Fox giving an age limit, uniform restrictions
and a gun proficiency testing requirement. This was placed on
1/10/77 Agenda for first reading.
Item 6. was discussion of recruitment procedure for replacement
of the City Clerk. A list of applicants had been distributed.
Council agreed to interview the applicants on 1/5/76 starting at 7 DO p.m.
in the Mayor's Office. The City Clerk is to set up the interview
schedule.
Meeting was adjourned at 11 30 p.m.
An Executive Session was held afterwards.

gutter, at 35th 4venue and Marshal.
3. Approx 1 ~Eek (7 cays) for 2ddit_ona1 curb, gUGter and
sidewalk at 35th A~e. and Nswland.
4. Approx 1 WB=Y (7 days) for addit_snal cross pan at 34th Place.
5. Approx 1 ~eek l7 days) for additional asphalt swals along
North side of 4ath, ?iercB to Saulsbury.
Above additions were all cone on extra work o~dErs, over and above
original cont~act. With move in a~d clsan up time, I estimated the
45 days extension that I approved.

We feel thet your request is Gxcessive in that curb, gutter

ccntract time extension item.
Besso on our records we believe a more realistic time extension
to be 45 days This ~ou1d extend the com~letion date from
October 23 to December 3, 1976.
