TITLE:
RESOLUTION ADOPTING 1985 UNIFORM FIRE CODE IN THE FAIRMOUNT
FIRE DISTRICT
WHEREAS, the Fairmount Fire Protection District provides
fire protection services to several incorporated and unincorporated
areas within Jefferson County including parts of the City of
Wheat Ridge; and
WHEREAS, the Board of Directors of the Fairmount Fire
Protection District has previously determined the necessity of the
adoption of a fire code to provide for uniformity of requirements
within the District, to assist in the preservation of property and
lives, to clarify relations between this District and incorporated
cities within the District, and to promote the prevention of fire
and damage within the District; and
WHEREAS, the Board of Directors of the Fairmount Fire
Protection District has previously adopted and the City Council of
the City of Wheat Ridge has previously approved the 1982 version
of the Uniform Fire code; and
WHEREAS, the 1985 Uniform Fire Code includes several
changes from the 1982 Uniform Fire Code which are heneficial to
the public and which are necessary for the proper prevention of fires;
and
WHEREAS, a public meeting of the Board of Directors of the
Fairmount Fire Protection District was held on May 14, 1986, to con-
sider the adoption of a fire code, and no objections were raised by
the public at that time; and
WHEREAS, C.R.S. 32-1-1002(d) also requires that appropriate
City Councils approve all fire codes adopted by fire districts before
they hecome enforceable within these parts of the fire district which
are within city boundaries; and
WHEREAS, the City Council of the city of Wheat Ridge has
determined that it would be in the best interest of the citizens of
the City of Wheat Ridge residing within the Fairmount District boun-
daries that the 1985 Uniform Fire Code be adopted.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL FOR THE
CITY OF WHEAT RTDGE THAT:
1. The Uniform Fire code 1985 edition and accompanying
Uniform Fire Code Standards published by the International Conference
of Building Officials, Whittier, California, is hereby adopted
effective for the Fairmount Fire Protection District boundaries
lying within the City of Wheat Ridge.

2. From and after this date, said Code and Standards
shall be administered and enforced by the fire chief of the
Fairmount Fire Protection District or his authorized representative,
as required and provided for in Section 1002 of Title 32, Article 1
of the Colorado Revised Statutes.
3. The Fire Marshal of Fairmount Fire Protection District
for purposes of enforcing said Code and standards shall be con-
sidered an authorized representative of the Fire Chief. This
section shall not limit the designation of additional authorized
representatives of the Chief, with approval by the Fairmount Board,
deems it necessary for the effective enforcement of the Code and
Standards.
4. Nothing contained herein shall be construed as modi-
fying or limiting the powers, duties, and responsibilities of the
Fire Chief of the Fairmount Fire Protection District or his author-
ized representative to carry out and fulfill those powers and
obligations set forth and enumerated in Section 1002 of Title 32,
Article 1 of the Colorado Revised Statutes as amended.
s. Section of Fire Code 2.101 as amended by City of Wheat
Ridge will be applicable to Fairmount Fire District.
