TITLE:
A RESOLUTION DETERMINING THAT COUNCILMEMBERS SHALL BE
INDIVIDUALLY INDEMNIFIED FOR AND AGAINST DAMAGES SOUGH'f
IN CIVIL ACTION NO. 86-CV-0767, AND DETERMINING THAT
SAID iNDEMNIFICATION IS IN THE PUBLIC INTEREST.
WHEREAS the City of Wheat Ridge, and the individual members
of the city Council thereof, have been named as Defendants in
Civil Action No. 86-CV-0767 wherein Randolph G. Currier and Clyde
C. Currier are Plaintiffs, and wherein monetary damages are
sought against the City and the individual members of the City
Council;
WHEREAS any actions taken by individual members of the city
Council for which damages are sought were undertaken in the sole
and exclusive role of legislatures or quasi-judicial arbiters for
and on behalf of the citizens of the City of Wheat Ridge, and no
such actions were taken in any personal capacity whatsoever;
WHEREAS it is in the public interest that members of Council
who are called upon to act as legislators or deciders of matters
which are denominated as quasi-judicial in nature should be
indemnified from personal judgments, or the threat of personal
judgments, where actions are taken in furtherance of their
legislative and quasi-judicial functions;
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
C I'n: OF WHEA'r RIDGE, COLORADO, AS FOLLOWS:
1. The city of Wheat Ridge shall indemnify and hold
harmless the individual members of the City Council of the City
of Wheat Ridge, and their successors, for and on account of any
damages which may be assessed against the City or the individual
Councilmembers by virtue of Civil Action No. 86-CV-0767;
2. The City of Wheat Ridge shall provide legal defense for
said Councilmembers in defense of said civil action;
3. Such indemnification as specified herein is consistent
with the provisions of the Colorado Governmental Immunity Act,
specifically C.R.S. 24-10-118(5) and is specifically deemed to be
in the public interest in that the same removes from the
consideration of the members of Council any concern as to
personal financial detriment and allows said members of Council
to perform their public duties free from said concern.
