TITLE:
A RESOLUTION SETTING A PUBLIC HEARING ON THE
PROPOSED ASSESSMENT ROLL FOR CITY OF WHEAT
RIDGE, SPECIAL IMPROVEMENT DISTRICT NO. 1987-1
IN THE CITY OF WHEAT RIDGE, COLORADO.
WHEREAS, the total cost of constructing and installing
certain street paving, curb and gutter improvements, and storm
drainage improvements, together with necessary incidentals within
City of Wheat Ridge, Special Improvement District No. 1987-1, in
the City of Wheat Ridge, has been reliably ascertained and is
based on the petition for organization and on the estimates of
cost prepared by the project engineer; and
WHEREAS, the city Council of the City has determined to
assess a portion of the cost of the improvements against the real
property included within the District and specially benefited by
the construction and installation of improvements, and has,
concurrently with the passage of this Resolution, considered on
first reading an ordinance levying such assessments; and
WHEREAS, a statement showing the whole cost of the
improvements, the portion to be paid by the City, and an
assessment roll showing the amount of each assessment have been
prepared and filed in the office of the City Clerk; and
WHEREAS, the city Council has considered the special
benefits accruing to each lot or tract of land in the District by
reason of the making of the improvements and has determined that
the apportionment of the assessments for said improvements is in
accordance with such benefits; and
WHEREAS, Section 10-10 of the Municipal Code provides
that prior to the final passage of the assessment ordinance, the
city Council shall, by resolution, set a time and place for a
public hearing;
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WHEAT
RIDGE, COLORADO:

1. That the city Clerk shall give notice of a hearing
on the assessment roll and the proposed ordinance of the city
levying such assessments. The notice shall be published once each
week for three consecutive weeks in the Wheat Ridge Sentinel, a
newspaper of general circulation in the city. The date of the
hearing shall not be less than thirty (30) nor more than sixty
(60) days after the date of the first publication of the notice,
in accordance with section 10-10 of the Municipal Code. In
addition, the same notice shall be mailed by first-class mail to
each property owner to be assessed for the cost of the
improvements who is included within the District. Such mailed
notice shall be made on or about the date of the first publication
of the notice of hearing. The notice of hearing shall be in
substantially the following form:

SPECIAL IMPROVEMENT DISTRICT NO. 1987-1, IN
THE CITY OF WHEAT RIDGE, COLORADO, AND OF A
HEARING ON THE PROPOSED ASSESSMENTS.
TO ALL PERSONS INTERESTED GENERALLY and to the owners of
real property to be assessed with the cost of improvements within
the City of Wheat Ridge Special Improvement District No. 1987-1,
notice is hereby given:
(a) That the total cost of constructing and installing
improvements within the District has been reliably ascertained,
and is based on the petition for organization and on the estimates
of cost prepared by the proj ect engineer. The total cost is
$1,510,000; the portion to be paid by the City is $260,000, and
the balance of such cost in the amount of $1,250,000 will be
assessed according to the following schedule of assessments;
provided, however, to the extent that the actual cost of the
project is less than the estimated total cost set forth above, the
amount of the assessment against each lot shall be decreased
accordingly f at a later date by an amendment to the assessment
ordinance.

(b) That any complaints or objections which may be made
in writing by the property owners or any citizen to the city
Council, and filed in writing in the office of the City Clerk on
or before the date of the hearing, will be heard and determined by
the city Council before the final passage of an ordinance
assessing the cost of said improvements. The amount of the
assessment will be due and payable within thirty days after the
final publication of the assessing Ordinance and an allowance of
five percent (5%) shall be made on all payments made during such
period, but not thereafter. However, all such assessments may be
paid, at the election of the owner, in ten (10) amortized annual
installments of principal and interest, as more particularly set
forth in the assessment Ordinance.
(c) Complaints or objections to the proposed assess-
ments will be heard by the City Council on Monday, April 25, 1988,
at 7:30 P.M., at the Municipal Building in Wheat Ridge.

2. That after the hearing on the assessment roll, the
City Council will consider on final passage an ordinance levying
assessments against the real property specially benefited and
included within the District, and providing for the collection and
enforcement of such assessments.
3. That if anyone or more sections or parts of this
Resolution shall be adjudged unenforceable or invalid, such
judgment shall not affect, impair or invalidate the remaining
provisions of this Resolution, it being the intention that the
various provisions thereof are severable.
