WHEREAS, the property located in Wheat Ridge, Colorado, consi sting of approximately fifteen and eight tenths acres more or less, and WHEREAS, this property is located in an area of Wheat Ridge where the Parks and Open Space Plan recommends that additional land be acquirec]; and WHEREAS, the City desires to investigate the value of tllis property under the Jefferson County Open Space Program; and WHEREAS, the City of Wheat Ridge has sufficient funds In its share of the Jefferson County Open Space Fund to appraise this parceJ of land; and NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Wheat Ridge, that the Jefferson County Open Space officials be hereby authorized and requested to secure a professional appraisal on the property located at 4171 Kipling Street, as referenced in this Resolution, and to determine its fair market value. Section 24-75-601 and 701, et seq., as amended and C.R.S, Section 24-75-702, et seq. as amended, any local government entity (including cities, towns, school districts, special districts or counties) is authorized to pool any moneys in its treasury, which are currently surplus funds and not immediately required to be disbursed, with similar moneys from other local government entities, in order for these entities to take advantage of short-term investments and maximize net interest earnings. CSAFE is formed as a common law trust under the laws of the state of Colorado. WHEREAS, the governing body of City of Whpat Ridgp desires to participate in CSAFE formed in accordance with the aforesaid statues, in order to pool its surplus funds with other local government entities, it has passed, by majority vote the following resolution: NOW, THEREFORE, it is hereby RESOLVED as follows: RESOLVED, that, the goveming body of City of Whea t Ri doe has reviewed C.R.S, Section 24-75-601, as amended and CRS. Section 24-75-701, et seq, as amended, of the Colorado Revised Statutes and the merits of investing in a trust as permitted by CRS. Section 24-75-601, as amended and C.R.S, Section 24-75-701, et seq, as amended, including the trust's liquidity, risk diversification, flexibility, convenience and cost compared to the alternative direct purchase of comparable investments and fmds it is in the best interest of the local government entity and therefore hereby approves and adopts, that certain indenture of trust entitled CSAFE dated September 1,1988 which shall be amended from time to time and thereby joins as a participant with other local government entities in the trust for the purposes of pooling surplus funds, The terms of the above mentioned trust indenture shall be incorporated herein BY this reference and a copy filed with the minutes of the meeting at which this resolution is adopted; and the 1 ty acknowledges and agrees that no warranties, either express or implied, are part of the agreement between CSAFE and r: ity of WhPn t Ri r1np unless as set forth in the Indenture of Trust, but that CSAFE shall use its best efforts to accomplish these goals. RESOLVED, further, that James O. Malone ,who is the local government official empowered to invest funds of Ci ty of Wheat Ri doe orhis/her successor in function, is hereby authorized and directed to executed the trust indenture and any other docwnents necessary to establish an account with CSAFE. James O. Ma lone is hereby designated the "Treasurer" as that term is defined in the trust indenture and is therefore authorized to invest money from the r: i t Y n f \~ h P n t Rid '1 e treasury, from time to time, which are not immediately required to be disbursed, by purchasing shares ofCSAFE with those available funds and is authorized to redeem, from time to time, part of all of those shares as funds are needed for other purposes.
