MINUTES June 6, 1977
The 3b6th regular meeting of the Wheat Ridge City Council was called to
order by Mayor Frank Stites at 7 30 p m at 4355 Field Street following
the showing at 7 00 P m of the film "THE TIME HAS Cm1E" The film dealt
with urban blight and the rehabilitation of homes and neighborhoods in
various cities around the nation It was brought out that people do want
to stay in the core cities and rehabilitate their homes since facilities
such as parks, museums, cultural events, etc , are cloaer They like being
close to their place of employment Utilities, police/fire protection and
other services are already in place and paid for, whereas new area sub-
divisions need to have these things amortized into the cost of building a
home Denver homes rehabilitated were shown A discussion of obtaining
financing to accomplish the renovation was included with the optimism that
perhaps financing will become easier since there have been so many successful
projects Some areas in Wheat Ridge are logical places for rehabilitation
It was suggested that Denver be contacted to see how to proceed on these
projects
Councilmen present were Mary Jo Cavarra, Joseph Donaldson, Robert Howard
Calvin Hulsey, Larry Merkl, and Louise Turner Also present were City Adm
John Jerman, City Atty Maurice Fox, Dept heads, Clyde Hobbs, Robert Vidal,
Dennis Zwagerman, Richard Bredt, Edward Pinson, staff and interested citizens
1 Approval of addition of W 35th Ave (Sheridan to Wadsworth) as a contract
extension item to the 1977 Street Overlay Program (estimated cost $35,000)
Appropriation is adequate to cover cost MOTION by Councilman Merkl, seconded
by Councilman Donaldson, I move that W 35th Avenue be included in our 1977
Street Improvement Program to be charged to Account 31-504-840 Passed 6-0
2 Approval of Home Rule Charter Expense Council asked for clarification of
what this bill was for
3 Authorization to modify the Greenbelt Lease with Coors This is a 25 year
lease with 19 years left Mr Fox said the lease needs to be amended to include
the property known as the Mobil Pre Mix extension MOTION by Councilman Donaldson
seconded by Councilman Hulsey "I move that the Mayor of the City be authorized
to execute a modification of the greenbelt lease with Coors to include the prop-
erty known as the ~10bile Pre Hix extension to the t~est Lake of Prospect Park"
Passed 6-0
The Regular meeting was then adjourned and the Study Session was convened
1 Was a request by the Architects for the new City Hall complex for additional
fees due to an "increase in scope" of the project The Architects stated
that $156,000 additional items had been agreed to by Council above the
original contract and felt that their fees should be increased accordingly
Councilman Cavarra suggested that Mr Zwagerman and the Architects get
together and compile figures on what is being increased
Plans for City Hall were reviewed including drainage into and exit of water
out of the retention pond Further discussion of the plans included change
in location of the Equipment Room/ Reproduction Room, location of video
camerasin the future, City Council seating, sound recording system for City
Clerk's use, seating for press, staff and audience Mr Zwagerman is to
meet with the Architects to itemize which items are the Architect's responsibility
and which are the City's Regarding glass in the Police Building, the
Architect said that it would be bid for regular glass or resistant glass
Councilman Cavarra requested a special Study Session to go over the plans
before it goes out to bid The Architects presented a roof sample showing
two shades of brown and suggested the medium brown They also showed a
sample of the bronze hardware and stated that interior woodwork would be
oak
2 Parks and Recreation Commission Matters
A Notice of Grant Award from BOR re Swimming Pool and discussion
of (1) Pool Architect selection, and (2) Site Designer for landscaping
and circulation pattern for entire site, including City Hall The pool
will be in the approximate location of the Retallack house Mr Bredt
said that the design fees and site plan fees are not a part of the grant,
that the grant is for contruction only There was a discussion as to
whether there should be two Requests for Proposal (one for the pool
design and one for the site plan) or one Request for Prosposal to cover
both The decision was for one Request for Proposal with one contractor,

who would hire a Landscape Planner for both the Pool area and the City Hall
Complex Regarding "noise" at the Swimming Pool area, it was suggested that
a berm or vegetation should be considered on the north (nearest the Mortuary)
and also noise control in consideration of the people on Vance Street
r"ayor Stites suggested that there might be people who would like to donate a
certain tree for a certain spot, with some recognition A program of this
type to be set up
2B Consideration of Installation of Fencing (chain link) to enclose property
at 29th and Wadsworth pursuant to lease with Frank Hayward as a condition
of acquisition, and also requires removal of chicken coop structure, estimated
cost $1600 There was discussion re buying out the lease which has four
years to run Mr Fox said it would probably cost about $7000 - $8000 The
Haywards would prefer to continue living there ~r Hayward does not want
the Chicken Coop taken out Decision - to put up the fence, bring the item
back to City Council
2C Proposal by Henry Zarlengo for sale of land to city located on Clear
Creek at Kipling (west side), for Park and Open Space purposes Authorization
necessary to secure appraisal Parcel is identified on Adopted Parks and
Open Space Plan of the City Mr Henry Zarlengo said that he has a piec e
of property and would like to sell it He would rather sell it all rather
than just a portion Councilman Howard said that he remembered Mr Zarlengo
coming to Council about seven years ago to have an error in zoning corrected,
and stated at that time that he would give a portion to the city if a trail
were to be constructed at some later time Mr Zarlengo said that he does
not believe that he had said he would give the land, but had said that he
would give an easement He also said there had been some correspondence
on the subject which he would try to find It is believed that the easterly
250' of the property is in the flood plain, and that all of the property
is in the Park Plan A review of the minutes was requested to see what
was said, and then bring the subject back for discussion Notify Mr Zarlengo
2D Park Rules and Regulations pertaining to dogs in Parks, and Authority of
Park Rangers for enforcement powers Mr Dodd said that the Parks and
Recreation Commission favors Sections 1,2,4, and 5, but not 3 Councilman
Merkl said that he had requested Number 3, that people should have to
clean up after their animals After discussion regarding horses and other
animals, it vias decided to change the word "animals" to "dogs" in Section
3 and put the item on the June 13, Agenda

2F Sky-worker truck Repair problem Mr Bredt said that the truck had
been sent in for testing and it was found to be in need of repair The
discussion involved contracting out the tree work as against repairing the
truck and continuing to do the work in-house The program costs the city
$45,000 per year at this time Mr Bredt said that we could not get comparable
work at the price The costs work out to $14 00 per hour and would be $35 00
per hour (estimate) on contract It was suggested that Mr Bredt draw up
what they did last year and then go out to bid and see what it would cost
Mr Dodd said that the Parks Commission favor having the truck refurbished
and that no one should take chances with a boom truck because of injury
Mr Bredt was asked to bring in a definite figure on the repairs
3 Resolution Amending Capital Improvement Appropriation re Wheat Ridge
Park and Prospect Park, paving of Park Roads and Parking Lots Mr Jerman
said that this is a Resolution transferring money, but there still is not
enough to cover the projects requested ~Jittl the need to plan the swimming
pool, it was decided to hold the resolution until later, and perhaps the
State Trails Grant will come through ($35,000) which would free up some money
Regarding the Wheat Ridge Park parkinq lot plans, Mr Bastable was authorized
to complete them, to be paid out of Parks and Recreation operating funds

4 & 18 Demonstration of "Ballot Counter" for use in conection with Home
Rule Charter Election and Consideration of other Home Rule Election Matters
Faye Griffin from the Jefferson County Elections demonstrated one of the
"counters" which are available on loan There vlould be seven counters, one
for each precinct, to be located, if possible in the Council Chambers (de-
pending on Municipal Court) City Clerk presented the proofs of the Voto-
~atic ballot, the Memorandum of Agreement, (including time table and
Dolling places, payment of judges, and possible payment to Evangel Baptist
Church) for decision June 13
5 Request for interpretation of PCD plan for Shoppette at W 32nd and
Wadsworth Blvd with respect to color of signs The discussion involved
'dhether the "earthen color" requirement involved only the structural
elements of the sign and not the face of the sign or the complete sign
~'lr Chic Myers stated that some firms did not wi sh to come into the
Shopette unless they could use their national symbol Concensus was
that City Council would go \vith the Planning Commission ie the color of
the structural elements of signs, not face of signs, shall be of earthen
tones at W 32nd and Wadsworth
6 Request of Judge Anthony Zarlengo for reconsideration of salary of
Deputy Judge Judge Zarlengo spoke re the New Pay Ordinance, that it is
not in conformance with State Statutes 13-10-107 Sections (1) and (2) and
13-10-103 He asked that the Ordinance be Amended as regards the Deputy
Judge's salary, to read $6,000 payable $500 monthly In case the Presiding
Judge cannot Preside, the substitute Judge would be paid by the Deputy
Judge directly Mr Fox was asked to bring in the Amended Ordinance
7 Report on costs over and above contract for Preventive Maintenance
Service Contract for Radio and Communication Equipment (excluding Police
Department Mr Rhodes presented a report for the period April 1, 1976
through November 30, 1976 showing Contract Cost for the period $1784,
Charges above contract cost (for calls we made to them) $1069 03, and
Repair made to equipment and covered in contract (in addition to twice
yearly preventive maintenance) $551 83 Decision - no contract on a
6 month Trial Basis
Problem regarding Concession Agreement When the bid award was sent out,
the bidder did not respond Mr Rhodes then called him, and he said that
he had not sent in the bid, but was probably one of the people h~ supplies
food to The "bidder" would not cover the other person for insurance
Mayor Stites asked Mr Rhodes to terminate the contract and Mr Bredt
to Contact the Wheat Ridge and Jefferson High Schools DECA Clubs
8 Proposed Schedule of Public Hearings before City Council re West
Aspen Co Development Mayor Stites said that he felt the time of pre-
sentation should be limited Mr Fox suggested starting at 6 00 P m and
stop at a specified time Mr Zwagerman said that the lawyers could then
control the time, through cross examination, etc If a Councilman cannot
be present at a meeting, he should hear all of the testimony and then
continue to participate It was decided that a minimum of three weeks
should elapse from the June 20 meeting to allow time for Council to study
the testimony from the Planning Commission meetings Because of the
Home Rule Charter Election, the hearings will be held July 25, 26, 27 & 28
If a Councilman has questions of the staff, it is ok for them to come ask
Each witness may be questioned by Council as they appear Mayor Stites
stated that he cannot let the hearing get out of hand, the chair will not
entertain any show of hands or noise from the audience A Court Reporter
will be present, but transcripts will not be ordered at this time Council-
man Cavarra asked if it would be possible to have a fee to cover direct
costs of zoning hearings? Mr Fox said that this would make it impossible
for the lesser affluent to apply for rezoning if there were opposition
9 Council Policy concerning attendance of Planning Commission Members
at Colorado Municipal League Conference, June 28 - July 1, 1977 Mr
Zwagerman said that there had been a request for 6 members of the Planning
Commission to go to the conference, in~tead of 2 as in previous years
Concensus was not to put the item on the Agenda

11 Progress Report concerning the installation of pedestrian bike/
pathways on W 44th Aven from Robb Street to Kipling St and
from Clear Creek to Wadsworth Blvd Mr Hobbs stated that from Wads-
worth to Everett was staked, from Wadsworth to Kipling was 60%, and
Kipling to Robb, no stakes yet In the next 30 days there would be
installation in progress A citizen asked why the pathway stopped
at Robb and asked for it to continue to Youngfield It was explained
that this would be extended when budget money is available Mr
Hobbs was asked to bring in a plan to continue on to Youngfield. June 13

12 Authorization to submit application for funding under Federal
Highway Safety Act (A) New Bridge at Youngfield Street It was suggested
that application be made for rehabilitation of bridge
Authorization to submit application for funding under Highway Safety
Act (Rail-Highway Crossing Program for improved rail crossing at W 48th
& Ward Road Mr Hobbs to apply for all crossings in Wheat Ridge

Item 17 Reappointment of Police Advisory Committe
Alert Council that reappointments are necessary

Councilman Howard asked regarding another lawsuit regarding unpaid
sick leave and if there was any relief for the City Mr Fox said that the City
could request Declaratory Relief in District Court and enjoin the parties
and others until there is a determination Council requested City Attorney
to do so
