HomeMy WebLinkAbout07/11/1977 ----- MINUTES - CITY COUNCIL MEETING July 11 1977 The Three hundred seventieth regular meeting of the Wheat Ridge City Council was called to order by Mayor Frank Stites at 7 30 p m at 4355 Field Street Councilnen present were, Mary Jo Cavarra, Joseph Donaldson, Robert Howard, Calvin Hulsey, Larry Merkl, and Louise Turner Also present were City Administrator John Jerman, City Attorney Maurice Fox, City Clerk Carol Hampf, City Treasurer James Malone, Department Heads, Richard Bredt, Clyde Hobbs, Ed Pinson, Robert Vidal, staff and interested citizens Minutes of June 23, and June 27, 1977 were approved as published PUBLIC COMf'1ENT Mike Miller of 2800 Depew Street said that the water pressure at his home and those of his neighbors was very low and sometimes no water at all He has talked with the Wheat Ridge Water District and the Denver Water Board, and they have both been sympathetic but say there is nothing they can do now He has called a plumber who said it would cost $12,000 to remedy the problem of which $7,000 - $8,000 would be for the street and asked if the city would pay the cost of the street repair Councilman Merkl said that the Denver Water Board is planning to increase the size of the mains in that area and that the repairs discussed by Mr Miller might not cure his problem, because of the small mains Mr Hobbs was asked to check to see if Mr Miller's area was a part of the area in which main repairis scheduled Mr Jerman said that the Denver Water Board is trying to consolidate these contract Groups into one district or annex them to the Wheat Ridge Water District Mayor Stites asked Mr Jerman and Mr Hobbs to contact Mr Johnson of the Wheat Ridge Water District to see how the consolidation of these areas is coming along and to contact Mr Miller if they get some information Item 1 Ordinance 242 - to Amend Chapter 20, Article 10, which provides for permit fees for curb, gutter and sidewalks (Deferred from June 27) Council- man Hulsey "I move that the clerk read the amended title on first reading" The title of Ordinance 242 was read by the Clerk Motion by Councilman Hulsey "I move that Ordinance 242 as amended be approved on First Reading and publ ished" Motion was seconded by Councilman Donaldson Discussion Councilman Hulsey said that he feels the permit fees should be eliminated for new construction as well as reconstruction to encourage people to put in sidewalks Mr Hobbs said that a grade check is made of the forms before concrete is poured and that the $50 fee roughly covered expenses Councilman Cavarra asked for the costs of taking out deteriorated curb and gutter and costs for inspections Councilman Hulsey said that the city had been taking out deteriorated curb and gutter for several years (at no charge) Motion carried 5-0 Item 2 Ordinance 240 - Authorizing the purchase of land for park purposes (Ha rt Property) Mot i on by Counc i 1 man ~1erkl "I move for the adopt i on of Ordinance 240 on second reading and order it published" Motion was seconded by Councilman Donaldson Motion carried 5-0 Item 3 Ordinance 241 - Amending Sections I and VII of Ordinance 231 Motion by Councilman Donaldson "I move for the adoption of Ordinance 241 and order it published" Motion was seconded by Councilman Hulsey Discussion Councilman Merkl said th?t the statute referred to by Judge Zarlengo stated that we cannot pay on a case basis and we are not paying on a case basis now, therefore he feels this Ordinance section is not necessary ~10tion by Councilman Cavarra "I move that Section 2 be jeleted" Motion was seconded by Councilman Merkl Mr Jerman said that under the current Ordinance, some months the Deputy Judge might be paid more than the $500 and sometimes less Last year the $6,000 budget was used up and probably will be again this year Mr Fox said that the hourly basis was a matter of interpretation but did not bel ieve .that the curre.nt OY'rlil1ance is .in conflict with the la\'1 ~lotion to Amend earned 4-1, Co'Uncllman Hulsey votlng Nay Mo_tj~~ by Councilman Cavarra "I move that the Title be amended to insert MINUTES - July 11, 1977 a period after Pay Grade 32 and striking 'and further providing for monthly payment to Deputy Judge', the last '5' in 'Sections' and 'VIII'" Motion was seconded by Councilman Donaldson Motion to amend carried 5-0 Motion as amended carried 4-1, Councilman Turner voting Nay Item 4 Delayed until Judge Zarlengo's arrival Item 5 Motion by Councilman Turner "I move that Council approve the re- newal of the 3 2% Beer Retail License for Bill H Chisum dba Chisums Super Market at 10019 W 26th Avenue, Wheat Ridge" Motion was seconded by Council- man Merkl and carried 5-0 Motion by Councilman Turner "I move that Council approve the renewal of the 3 2% Beer Retail License for Kay Nitta dba Wheat Ridge Ranch Market at 6920 W 38th Avenue, Wheat Ridge, Colorado" Motion was seconded by Councilman Merkl and carried 5-0 Item 6 Deferral of Public Hearing re Class G 3-Way Liquor License for Canale's Italian Restaurant Applicant requests deferrment until August 15, 1977 Motion by Councilman Cavarra "I move that we approve deferral of the Publ ic Hearing on the Class G 3-Way Liquor License for Canale's Italian Restaurant until August 15, 1977" Motion was seconded by Councilman Donaldson and carried 5-0 Item 7 Staff Report concerning location of Crosspan Replacements and Curb & Gutter radii replacements as recommended by the Council Street Committee (Deferred from Council Meeting of June 27, 1977) Mr Hobbs said that the money for this program is in the Street Program and will cost an estimated $38,000 He said that the Street Committee was asking for authorization to go out for bids and then come back to Council Motion by Councilman Cavarra "I move that we authorize Public Works Department to go out for bids for Replacement Crosspans and Curb and Gutter Radii as recommended in the list submitted in the July 11, Agenda" Motion was seconded by Councilman Merkl and carried 5-1, Councilman Turner voting Nay Item 8 Award of Bid for curb gutter, sidewalk and paving for W 44th and Vance Park at a cost not to exceed $7,534 40, Account No 54-508-865-5 Conservation Trust Fund Mr Vidal said that 2 bids had been received and recommended the lowest bidder $336 40 to be taken out under "staking" because this has already been done Motion bv Councilman Hulsey "I move that the lowest and best bid be awarded to:Campbell Cement, at 5360 Wadsworth Blvd, Arvada, Colorado for Curb, Gutter, Sidewalk and Paving 44th Vance Place, Not to exceed $7,198 00 to be charged to Account 54-508-865-5" Motion was seconded by Councilman Donaldson Discussion Councilman Cavarra asked if this was a priority item This is an item budgeted for this Park, and curb & gutter are needed to protect the sod (people are driving into the park The item is for curb & gutter that borders the park, less the single family residence These residents have been contacted to see if they wish to have the installation also (at same price as the City) and they do not Councilman Merkl said that this park still needs Rest Rooms Motion carried 4-2, Councilmen Cavarra and Turner voting Nay Item 9 Award of Bid for purchase of Cab and Chassis for Paint Striping Machine Mr Vidal said that lowest bidder is not able to supply the 1977 Truck, but could supply a 1978 for $6,109 31, which would be available late September or early October They have a 1977 truck with air-conditioning, which would be extra Mr Fox said that Larry Coil has a contract to build the striper, and if there is a delay, there will be more labor fees since the contract was based on doing the work now Motion by Councilman Cavarra "I move that we authorize staff to negotiate with Lakewood Fordland for the purchase and immediate delivery of a 1977 Ford F-350 cab and chassis at a cost not to exceed $300 excess of the low bid price to be charged to Account No 19-503-808" Motion was seconded by Councilman Donaldson and failed in a tie vote, Councilmen Howard, Merkl, and Turner voting Nay Councilman Hulsey suggested buying the truck with air-conditioning, at an extra cost of approximately $450, such cost probably being less than legal fees Councilman Howard asked about the contract with Colorado Lines Mr Vidal said that they did not want to sign the contract as they believe it does not represent what they bid Motion by Councilman Merkl "I move that the lowest and best bid be awarded to- Lakewood Fordland,at 11000 West Colfax Avenue, Lakewood, Colorado for Ford F-350 Cab and Chassis no~ to exceed $5829 31 to be charged to Account 19-503-808 and that Mr Vidal's office be notified to contact Lakewood Fordland tomorrow to tell them we will take delivery within 10 days, or legal action will be started by the City Attorney. Motion was seconded by Councilman Turner and carried 6-0 - 3 - MINUTES - July 11, 1977 c 10 Report concerning Bidding Procedures for City Hall modular furniture and other furnishings Ms Burton presented the options for selection of furnishings and recommended hiring a group to design the specific areas This group would help choose suitable furnishings and write specification that would not eliminate furniture companies They would also be able to secure discounted prices Question re Architects doing this Mr Jerman said that the Architects are not expert in this field and do not want to tackle it Ms Burton said that this is for the furnishings not for the building itself She said that if only vendors are contacted for help, naturally they want us to believe that their brand is the one, whereas a designer has several brands as options Such a design project might cost $10,000 Councilman Turner asked re the costs H ~ walls had been used, butbM~.flor Stites said it was too late to consider this as the bids have already e advertised Motion by Councilman Cavarra "I move to direct staff to work with the Council Committee to develop a bid package for Open Office Landscape Furniture" Motion was seconded by Councilman Donaldson and carried 4-2, Councilmen Howard and Turner voting Nay '" ~ Item 11 Offer of sale of property located at southwest corner of 38th Ave and Depew St , by Ralph Mauro, owner, for street purposes Mr Fox said that Depew St is underwidth (25 feet) and that the owner is concerned because he has a piece of property he cannot use, since to use it he would have to dedicate ROWand the remaining piece would be too small The owner said that he is willing to have it appraised by an MIA and sell it at that price and will take deferred compensation until the next budgetary year Motion by Councilman Merkl "I move that Council authorize the appraisal work to be done on the subject property" Motion was seconded by Councilman Donaldson and carried 6-0 Item 4 Resolution transferring funds within Municipal Court Budget Ap- propriation for purpose of hiring a part-time Clerk and increasing Overtime appropriation Judge Zarlengo said that the reason for hiring a part- time clerk was that the Court Clerks no longer desired to continue over- time work to the extent they have in the past The work load is such that additional help is needed Judge Zarlengo was requested to include this in his 1978 Budget, if he wishes to continue this way Motion by Councilman Turner "I move that Resolution No 525 be approved" Motion was seconded by Councilman Donaldson and carried 6-0 Item 12 Authorize payment to Mountain States Postal for delivery of Parks and Rec Brochures, City's Annual Report, and Questionnaires of City Identity Committee Mr Jerman said that he had been asked to secure an affadavit concerning the delivery of these items, and that a letter had been attached to the Agenda, plus he had the invoice, and also had mail delivery statements that were confidential, but were available for inspection Mr Cooper of the Mountain States Delivery company said that he had a map showing the areas that had not had delivery because he had been short of items His company had delivered 11,434 pieces and there are approximately 11,900 address in Wheat Ridge Some pieces had not been delivered because of dogs, and some due to new routings Mrs Slattery spoke and said that she had done a survey, which showed that 110 people did not get the delivery and 59 did (as a sample) She had called the Committee, people she knl wand friends of people she knew, and also random people She displayed a map showing the distribution of her survey f~otion by Councilman Howard "I move that we authorize payment not to eocceecr--- $1145 89, charged to Account No 001-121-651 in the amount of $232 26 (Questionairres), Account No 001-106-651 in the Amount of $454 91 (Annual Report), and Account No 001-602-651 in the amount of $458 72 (Brochure) " Motion was seconded by Councilman Turner and carried 4-3, Councilmen Howard Merkl, Turner and Mayor Stites voting Aye Item 13 Authorize appraisal of the Henry Zarlengo property located at Clear Creek and Kipling for Open Space Purposes Mr Jerman said that he had spoken with Mr Zarlengo regarding the Kipling Street frontage and that most of it was taken up by the bridge The remaining 125 feet did not have much property in back of it Mr Fox said that Mr Henry Zarlengo will be required to provide a survey, which will include the location of the creek, and that the appraiser will indicate the location of the flood plain Minutes - July 11, 1977 - 4 - Mot i on by Counc il man Merkl "I move tha t Counc il authori ze appra i sa 1 of the Henry Zarlengo property located at Clear Creek and Kipling for Open Space purposes" Motion was seconded by Councilman Donaldson and carried 6-0 Item 14 Authorize publication of full text of Home Rule Charter on July 14, 1977 Mr Fox stated that all legally required publications had been made There was no motion for republication City Administrator's Matters - Mr Jerman said that Mr Hobbs had a report on the Monumentation program Mr Hobbs said that he had attended a meeting on the Monumentation and that there would be 2 in Wheat Ridge, and the cost would be $7,500 Motion by Councilman Donaldson "I move that the City of Wheat Ridge participate in this program for our proportionate share, to be paid from the 1978 Budget, if necessary" Motion was seconded by Councilman Turner and carried 5-1, Councilman Howard voting Nay Councilman Merkl stated that he was against the payment for the sound system, and asked the City Attorney to not settle out of court Councilman Cavarra asked re the Einarsen case, and Mr Fox said that the Judge had taken his request for dismissal under advisement Motion to adjourn by Councilman Howard, seconded by Councilman Merkl, all Aye I ~-l ( c (",,_r/--- '--- City Clerk r r .L /' , / j;L-- / APPROVED , t)..J I '\, ,I' -'1 . . ), I J/ i I
