TITLE:
RESOLUTION AUTHORIZING THE MAYOR
INTERGOVERNMENTAL AGREEMENT ENTITLED
PAYMENT AND CERTIFICATION OF USE OF FUNDS
A PARKS AND RECREATION MASTER PLAN AND
MASTER PLAN FOR MUGELE PARK.
TO SIGN THE
REQUEST FOR
FOR PREPARING
TO PREPARE A
WHEREAS, the Citizens of Jefferson County passed an
Open Space Resolution on November 7, 1972; and
WHEREAS,
the citizens amended said Resolution on November 4,
1980 to allow for maintenance and development of Open Space lands
and property; and
WHEREAS, Shalkey Walker Associates, Inc. has been
awarded the contract for preparing a Parks and Recreation Master
Plan and a Master Plan for Mugele Park in the amount of $40,000;
and
WHEREAS, it is in the best interest of the City of
Wheat Ridge to enter into the Intergovernmental Agreement which
is attached to this Resolution; and
WHEREAS, Section 14.2 of the Home Rule Charter of the
Ci ty of Wheat Ridge authorizes the City of Wheat Ridge, by
Resolution, to enter into Intergovernmental Agreements.
NOW, THEREFORE, BE IT RESOLVED by the City Council for
the Ci ty of Wheat Ridge, that the Intergovernmental Agreement
entitled Request for Payment and Certification of Use of Funds,
attached to this Resolution be approved, and the Mayor be
authorized to sign said Intergovernmental Agreement.

CERTIFICATION OF USE OF FUNDS
The City of Wheat Ridge hereby requests
from the Board of County Commissioners of Jefferson County, State of
Colorado, paymp.nt from the Jefferson County Open Space fund in the amount
of Forty Thousand and 00/100 Dollars ($ 40,000 ) ,
payable 100% from funds received subsequent to Januarv 1, 1981. The
following percentages and dollar amounts Iisted are to be taken from the
City's attributable share of the Open Space fund and/or from Jefferson
County's attributable share of the Open Space fund, but not to exceed the
present portion of their attributable share received subsequent to
January 1, 1981:

This request constitutes a certification by the
City
Council of the City of Wheat Ridge
to the Board of County Commissioners of Jefferson County that the
City of Wheat Ridge
has entered into a contract or contracts
(which are enclosed) in the amount of $ 40,000
for the purposes
fully described below (use additional sheets if necessary.)

the facility, program or project for which the reimbursement or
payment is being requested. Invoices and other documents must support
the requested reimbursement.)

CONTRACT
Shalkey Walker and Associates Inc. has been awarded a contract

to provide planning services to prepare an update to the City of
Wheat Ridge Parks and Recreation Master Plan. Attached is a scope
of services detailing the process. 35,000
Shalkey Walker Associates, Inc. shall prepare a Master Plan {or
the development of a new park. (Mugele Park, located at approx-
imately 47th & Miller St. in Wheat Ridge)

In the event the total cost of the contract work is less than
forty thousand & 001100 Dollars ($ 40,000
), the City of Wheat Ridge
will refund the unexpended funds plus any interest earned on the project
money to Jefferson County within 30 davs after completion of the project.
These funds will be credited into the attributable share account from
which it was originally paid.
Upon receipt of the funds bv the applicant, the funds shall be
deposited into an interest bearing savings account.
Within 30 days of completion of the project (contract date) the
will provide Jefferson County with the following:
1. Copy of all change orders.
2. Itemized list of the projects completed and final costs.
3. An accounting of the monies received while the Open Space money
was on deposit.
4. Return to Jefferson County all interest earned on the Open Space
money received prior to final payment of the contract unless
otherwise provided for in writing.

Council of the City of Wheat Ridge
also certifies that all of the above listed expenditures and/or contract
obligations constitute purposes which are authorized by the Jefferson
County Open Space Resolution as adopted bv the voters on November 7, 1972
and amended on November 4, 1980. In addition this certifies that
expenditures and/or contract obligations were for one or more of the
following:
A map showing the Iocation of the facilitv, program, proiect or
acquisition for which reimbursement or payment is being requested is
attached.
In accordance with the Jefferson County Open Space Resolution,
the County, or its designated representative, may, if it so desires, audit
the work papers and audit utilized by the City to determine the final cost
under the contract.

expenned only for the purposes stated and authorizes the
Mayor and City Clerk
to sign this Pequest.
This certification also certifies to the Board of County
Commissioners of Jefferson County that the facilities, programs or
projects upon which the funds will be or have been expended shall be open
to the general public and the use thereof shall not be restricted solelv
to the persons who reside within the City.
