MINUTES OF CITY COUNCIL MEETING
July 18,1977
The 371st meeting of the Wheat Ridge City Council was called to order
by Mayor Frank Stites at 7 30 P m at 4355 Field Street Councilmen
present were Mary Jo Cavarra, Joseph Donaldson, Robert Howard, Calvin
Hulsey, Larry Merkl, and Louise Turner Also present were City Adm
John Jerman, City Atty Maurice Fox, Dept Heads Richard Bredt, Clyde
Hobbs, Robert Vidal, Dennis Zwagerman, Acting City Clerk J Thorngate,
Staff and interested citizens
Minutes of July 11, 1977 were tabled until the tape can be researched for
a correction requested by Mrs Turner
1 Application by Frank & Fern Skala and Kenneth & Marlene Rice for
approval of final plat for a 2 lot Minor Subdivision at 4722 to 4752
Everett Ct (MS 77-04) Motion by Councilman Cavarra, second by Councilman
Hulsey, "I move that case MS 77-04 be approved with the stipulation that
a 10' easement be included at the rear of the property" Mrs Toni Rice
6818 Routt St one of the cpplicants explained this would enable each double
on these lots to have its own legal description, essentially this is to clear
up a legal technicality since these two doubles were constructed sometime ago
Motion carried 6-0
2 Application by John & Roxie Villano and James & Douglas Miller for approval
of rezoning from A-l to Ind and approval of Preliminary & Final Industrial
Development Plan for property at 10601 N 1-70 Service Rd (WZ-77-10) A question
arose regarding a drainage plan and a recess was called to enable Mr Zwagerman
and Mr Hobbs to search their records Also Mrs Turner questioned the availa-
bility of sewer and water taps for this property Mrs Cavarra and Mrs Turner
questioned the percentage of greenery in the landscaping and were assured by
~1r Zwagerman that the greenery requirement was met When Council reconvened
after the recess Mr Bruce Leiser, the City Engineer was present and a drainage
plan had been furnished by the developer Mr Leiser requested more time to
review this plan since this was the first time he had seen it Motion by
Councilman Merkl, second by Councilman Hulsey "I move that application (WZ 77-10)
by John & Roxie Villano and James & Douglas Miller for approval of rezoning from
A-l to Industrial and approval of Preliminary and Final Industrial Development
Plan for property at 10601 N 1-70 Service Road be approved with the contingent
clause that the City's Engineering dept approve the drainage plan as submitted
this evening, within 72 hours Motion carried 5-1 with Mrs Turner dissenting

Motion to defer the application by Holt Chew, Terry Kunz and Steve Sabel
by Councilman Howard seconded by Councilman Hulsey, "I move that Case WZ 77-12
be deferred to a later date at the request of the applicants" passed 6-0
4 Application by Lawrence & Katherine Merkl, Robert & Kathleen Merkl and
John & Mary Merkl & Consolidated Industries, Inc for rezoning from R-2 and PCD
to PCD and approval of Prelim & Final Development Plan for property between 45th
Place & W 48th Ave on east side of Wadsworth Case WZ-77-l3 Councilman Merkl
was advised to abstain from voting and leave the room since his relatives were
concerned ~lr Geo Von Eissler who is President of Consolidated Ind owners
of the property since 6-30-77 answered questions regarding ingress/egress and the
number of vehicles per day expected Motion by Councilman Hulsey, seconded by
Councilman Donaldson "I move that Case WZ-77-13 application by Consolidated
Industries Inc for approval of rezoning from R-2 & PCD to PCD and approval of
preliminary and final Dev Plan for PCD be approved with a stipulation that a 6'
solid fence be placed on the East boundary of the property in question" Motion
carried 3-2 with Mrs Turner and Mrs Cavarra dissenting
Mr Jerman discussed the renewal of the leases on the City Hall and Vantage build-
ings He is to talk to the landlords to possibly negotiate part year leases and
bring the information back to Council
An Executive Session was held on several items

Motion by Councilman Merkl, second by Councilman Donaldson RE City Hall
Plans, "I move to authorize the Mayor and the Director of Community Develop-
ment to approve and sign the final plans and specifications for the new city
hall and all addendums thereto and further direct that the original electrical
distribution and the original lighting system and the original number of
heating zones, be bid as an alternate Motion carried 6-0
Councilman Hulsey asked that the City Attorney put on the Agenda for consider-
ation, the sale of the Police Bldg possibly by the next Study Session (This
must be approved by a vote of the people and needs to be put on the November
ballot
