HomeMy WebLinkAboutResolution-1991-1262 RESOLUTION NO. 1262 SERIES OF 1991 TITLE: A RESOLUTION OF THE CITY OF WHEAT RIDGE EXPRESSING THE EXTREME DISPLEASURE OF THE CITY COUNCIL AT THE ABSENCE OF THE CITY'S ADMINISTRATION FROM A CONTINUED CITY COUNCIL MEETING HELD AUGUST l3, 1991. WHEREAS, the City Council of the City of Wheat Ridge held its regular Council Meeting on August 12, 1991, at the conclusion of which it was necessary to continue said meeting to August 13, 1991, for the purpose of discussing in further detail an agenda item relating to employee compensation; WHEREAS, at the time of said continued city Council Meeting on August 13, 1991, the City Administrator was not present; WHEREAS, those members of the City Council present at said continued meeting, began to discuss the matter on the agenda for discussion, but determined, during the course of that discussion, that the absence of the City's Administration precluded a decision being made upon that item because answers to certain City Council questions were not able to be obtained; WHEREAS, during the course of said continued City Council Meeting, attempts were made to contact the city Administrator by telephone, which attempts were unsuccessful; WHEREAS, during the course of said meeting, the City Council voted to enlist the Police Department of the City of Wheat Ridge to go to the residence of the City Administrator and determine whether or not the city Administrator was at home and available to come to the meeting; WHEREAS, the Police Department of the city of Wheat Ridge, acting in accordance with the Council's request and direction, went to the City Administrator's home and determined that the city Administrator was at his place of residence at that time; WHEREAS, notwithstanding the presence of the Police Department at his home, the city Administrator refused to attend the continued City Council Meeting; WHEREAS, Section 5.5 of the Home Rule Charter of the City of Wheat Ridge provides as follows: A majority of the members of the Council may, by vote, either request or compel the attendance of its members and other officers of the City at any meeting of the Council. Any member of the Councilor other officer who then notified of such request for his attendance fails to attend such meeting for reasons other than confining illness or absence from the City, or because such Councilmember of officer is attending a meeting as a representative of the city, shall be deemed guilty of misconduct in office unless excused by the Council. WHEREAS, the council had not excused the city Administrator from the continued meeting being held on August 13, 1991, and the City Administrator had not sought excuse from said meeting; WHEREAS, the absence of the city Administrator from said meeting left the city council without the ability to obtain answers to specific questions which the council, or a majority thereof, felt necessary to obtain before continuing to resolve the question before it. NOW, THEREFORE, BE IT RESOLVED by the City Council of the city of Wheat Ridge that the Council expresses its extreme displeasure at the absence of the City Administration from the lawfully continued meeting of the Wheat Ridge City Council, continued on August 12, 1991 to August 13, 1991.
