RESOLUTION NO. 1265
SERIES OF 1991
TITLE:
A RESOLUTION OF THE CITY OF WHEAT RIDGE DECLARING THE
PRIMACY OF THE HOME RULE CHARTER OF THE CITY OF WHEAT
RIDGE REGARDING THE CONDUCT OF OPEN MEETINGS WITHIN THE
CITY OF WHEAT RIDGE.
WHEREAS, the City of Wheat Ridge is a home rule city,
possessing all of the rights and powers granted by Article XX of
the Constitution of the State of Colorado and the Home Rule Charter
adopted by the electorate of the City of Wheat Ridge;
WHEREAS, home rule cities within Colorado have plenary power
to legislate on matters of purely local concern wi thin their
jurisdiction;
WHEREAS, the electorate of the city of Wheat
adopted the city's Home Rule Charter which sets
parameters under which executive sessions of the City
be held;

WHEREAS, the Colorado General Assembly has adopted SB 91-33
which purports to legislate on a matter of "statewide concern" but
which, by its terms, provides for less restrictions upon the
holding of executive sessions than is contained in the Home Rule
Charter of the city of Wheat Ridge;
WHEREAS, the city Council of the city of Wheat Ridge wishes
to declare its belief that the provisions of the Home Rule Charter
of the city of Wheat Ridge supersede the provisions of SB 91-33
within the City of Wheat Ridge;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Wheat Ridge, Colorado as follows:
1. The City Council specifically rejects the finding of the
Colorado General Assembly as stated in SB 91-33 that the regulation
of meetings within a home rule municipal corporation is a matter
of statewide concern.
2. within the City of Wheat Ridge, the provisions of
section 5.7 of the Home Rule Charter of the City of Wheat Ridge,
which provisions are more restrictive than those established in
SB 91-33, shall be adhered to regarding the calling and holding of
executive sessions during open public meetings.
3. The City Council of the City of Wheat Ridge specifically
declares and resolves that the conduct of local meetings within the
city of Wheat Ridge is a matter of local, not statewide concern,
and shall be regulated pursuant to the provisions of the Home Rule
Charter of the city of Wheat Ridge as adopted by the electorate of
the City of Wheat Ridge.
