CITY COUNCIL MINUTES - October 3, 1977
The three-hundred eighty-first regular meeting of the Wheat Ridge City
Council was called to order by Mayor frank Stites at 7 30 p m at 4355
Field Street
Councilmen present were Mary Jo Cavarra, Joseph Donaldson, Robert Howard,
Calvin Hulsey, Larry Merkl, and Louise Turner
Also present were City Administrator John Jerman, City Attorney, Maurice
Fox, City Clerk Carol Hampf, Department Heads, Richard Bredt, Clyde Hobbs,
Dennis Zwagerman, Lt Howard Jacquay, and interested citizens
PUBLI C COMMENT
Steven W Driftmier, 2930 Vance, Wheat Ridge was the spokesman for a group
opposing the location of the Swimming Pool He presented petitions signed
by property owners who live near 29th and Wadsworth They oppose the
location because of limited ingress and egress They do not oppose Wheat
Ridge having a pool and spending funds, only the location
Judy Helsel, 3941 Chase spoke in support of the 29th and Wadsworth site
for the pool She believes that this site would serve the citizens as it
is midway between the two high schools (it could serve as a practice pool
for them) and is accessible from all of Wheat Ridge It would encourage
young people to move into the area All facilities should not be located
in one area
Dave Suttie, 4219 Xenon from the Wheat Ridge Boarding Kennels spoke re
the "Barking Dog" Ordinance He thinks the ordinance should be amended
since as it is now,barking is prohibited in any Zoning in the City
As a Boarding Kennel, he has no idea when he accepts a dog, whether it
will be a barker or not, and if it barks what would he be able to do?
He requested that the wording "in any area" be amended to read "in a
residential area" Mr Fox to bring a proposal to the Study Session on
November 7
PUBLIC HEARING
Publ ic Hearing on the proposed General (Operating) Capital Improvements
Park Acquisition, Conservation Trust and Revenue Sharing Budgets for 1978
Sharon Reichert, Carolyn Coolbaugh and Bev Bucklew of the Jefferson County
Mental Health Center came to ask that Wheat Ridge fund for the use of
their emergency services Case histories were presented, where, with these
services? Pol ice assistance would and would not be needed Mr Jerman pre-
sented Summaries of all Changes that were made to the Proposed Budget during
study sessions and called attention to the Assessed Valuation of $111,496,280
which is lower than the estimated valuation of $113,400,000 October 10
is set for the Adoption of the Budget
Motion by Councilman Merkl to Adjourn the regular portion of the meeting,
seconded by Councilman Hulsey and all Aye
STUDY SESSION
Item 8 Operation of Amusement Machine Establishments located near Public
Schools, which serve as a distracting element to school children Lt
Jacquay presented a list of business establishments in Wheat Ridge that
have game machines Mr Wanser, Principal of Wheat Ridge Junior High
said that the Lion's Den is directly across the street from the school
The students do not use the cross walks but go directly across the Street
presenting a safety hazard Also this year, since the business has re-
opened, 10 bicycles have been stolen from the school yard Mr Trebilcock
Assistant Principal of Wheat Ridge Junior High,said that he is concerned
also with safety,and further, that this kind of establishment draws older
kids from other areas Fights, scuffles, rock and snowball throwing and
name calling result Mr Fox was asked to discuss an Ordinance Amendment
with Mr Zwagerman and, if it is a Zon i ng ord i nance, take it to the
Planning Commission and then back to City Council Councilman Cavarra
asked about an Ordinance re Pornography Mr Fox will look into it
Item 1 Revision of Wheat Kidge Code of Laws, Chapter 4, Article 1, Section
4-3 (d), pertaining to kennel licenses Recommended by Animal Control
Commission Dr Hilsenroth, of the Animal Control Commission said that

the Commission felt that the ommission of proVlslon to sell cats
and dogs at a Pet Store had been an oversight An Ordinance Amendment
is to be brought to Council Dr Hilsenroth also was concerned about
Stray Dogs and the low amount of the fines levied He said that the
fines should be against the owner and not the dog, so that if different
dogs are picked up, belonging to an owner, the fines should continue to
increase Mr Fox said that perhaps the schedule should be reconsidered
by the Judge, and that the Mayor can talk to the Judge in this regard
Item 2 Report of City Administrator concerning award of Federal Grant
to the City of Wheat Ridge in conjunction with the City of Lakewood and
through the State Division of Highways for Traffic Signal coordination
project on Wadsworth Blvd from 1-70 to Colfax (100% Grant - $200,000)
Mr Jerman said that there may be enough in the Grant to have Kipling
included also The syncronization is to work through the Lakewood Central
Control Discussion as to necessity for this work and the syncronization
previously done To be on Agenda, October 10
Item 10 Request of Director of Public Works to retain an Engineering
Consulting Firm for special traffic engineering studies Mayor Stites asked
if the Traffic Count for Three Acre Lane & Wadsworth could not be done
with City Equipment Mr Hobbs will look into it Remaining items would
be taken care of under the Grant mentioned above
Item 3 Consideration of Jefferson County Land Use Program (1041) and
Funding of Projects Planning Department had indicated eight different
areas for proposed use for 1041 funds The Jefferson County Land Use
Coordinator had written to say that they would be interested in Historical
Preservation and could possibly work with Wheat Ridge along the lines of
the County Register of Historic Places
Item 4 Report of City Council/Chamber of Commerce Committee concerning
landscaping design for W 38th Avenue, Wadsworth to Sheridan The
Committee recommended that City Council endorse the concept of a study
for a uniform street tree program for 38th Avenue from Wadsworth to Sheridan
It is hoped that there would be a complete Master Plan for beautification
and improvements Mayor Stites directed Planning Staff to proceed
Item 5 Consideration of residency requirements re Building Code Advisory
Board members and other boards and commissions At this time the Planning
Commission is the only one with residency requirements Mr Jerman and
Mr Fox to bring in Ordinance or Resolution, as needed, that any person
serving on a Board or Commission should be a resident of Wheat Ridge
Question on attendance requirements for Boards, Commissions, council Members
and Mayor Mayor Stites directed that it be researched as to which groups
now have attendance requirements It was suggested thnt rOllncil t~ke a
stand on the number of consecutive terms of office which should be allowed
A request was made for an alternate member be added to the Parks and Re-
reation Commission
Item 6 Discussion of Council Policy re Attendance of Board and Commission
members at out-of-City Conferences Suggestion that any Commission be
allowed to send two members to out-of-City conferences within the State
during one calendar year, and that if there were a special conference or
out-of-state conference of interest it should be brought to Council for
consideration Mr Jerman to bring in a Policy
Item 7 Revision of Public Service Franchise, Ordinance 19, Series of 1969
Withdrawn
Item 9 Energy Conservation Codes for Non-Residential Buildings and Resi-
dential Building Construction & Renovation as proposed by the Board for
Energy-Efficient Non-residential Building Standards and the Residential
Energy Conservation Code Advisory Committee Item a matter of information only

Item 11 Discussion of Weed Ordinance, codified in Chapter 9, Article III,
Sections 9-7 through 9-11 of the Wheat Ridge Code of Laws Councilman
Cavarra said that the Ordinance is in conflict with State Statutes as re-
gards right-of-way Mr Hobbs to bring in a projection of how to take
care of the right-of-way, the equipment that would be needed, and the costs
Mr Bredt to bring in a report on a kind of grass or other possibilities
to hold the weeds down It was brought up that the Greenbelt areas do
notconform to the Ordinance An Ordinance Amendment is to be brought
in to exempt greenbelts and other natural Drainages
Item 12 Footbridges - Progress Report Flood Plain Appeal procedures
Mr Zwagerman presented a report on the Procedure being followed and sug-
gested one shortcut, which would be to hire an outside firm such as Wright-
McLaughlin to do the engineering on the bridges Concensus of Council
was agreement Mr Bredt said that the bridges for Prospect Park and
at Independence Court would not be funded until next spring
Mayor Stites asked Mr Fox to explain the Procedure on the handling of
the audit of the Zoning Map Last Spring the Planning Commission asked for
the Audit The Maps have been received, are sealed, and have been placed
in the Police Evidence Room until a procedure has been given Mr Fox
recommended that we take a fresh Mylar and describe on it the cor-
porate boundaries of the city, and depict on that Mylar all of the Zoning
classifications that have been established and implemented that are not in
question That would be described on the face of the Mylar with a line,with
the Zoning district printed on it, rather than key system as has been used
Then the Mylar would be printed, making several copies, and leave blank any
things that are in dispute or have any question about them The questioned
areas would circled in red, with a number at each one Accompanying the map
would be an outline of the problem, using the same numbers as on the map,
and including staff recommendations for correcting that individual problem
Then there would be a Public Hearing before Planning Commission, followed by
a Public Hearing before City Council This would result in a partial amend-
ment of the Comprehensive Plan It was recommended that the maps be avail-
able two weeks before the Public Hearing, and also take the matter under
advisement for two weeks to study the map Mr Fox recommended that when the
map is ready, before the Public Hearings, the map be published, a page in size
To be published before each of the Public Hearings It was suggested
that at the October 10 meeting a motion be proposed to declare a moratorium
on building permits on the properties in dispute Council will receive
a copy of the Mylar that is to be prepared, a copy of the problems and a copy
of the audit
Councilman Hulsey said that the Furniture Committee for the City Hall had
met this evening and were recommending that 3 employee~ who will be working
in the open areas, be added to the committee One draftsman, one secretary,
and one police detective They are to be paid, if needed Mr Jerman to
see to this The next meeting will be Monday, October 10, at 6 30 p m
Mr Jerman announced that there will be Lena Gulch neighborhood meetings
The first will be Tuesday, October 18 at Everitt Junior High School from
7 - 9 p m There will be similar meetings for each reach and residents will
be not ifi ed
Mr Jerman said that he had received today an appraisal for the property at
W 38th and Depew Council will receive copies of the letter
Mr Jerman said that he had been to the State Highway Department to look over
the plan for construction on Wadsworth at 1-70 and the plans show a 15 foot
pathway from 400 feet West of Wadsworth to Sheridan and on east
Councilman Turner asked if the parking on Holland near Wheat Ridge High School
had been changed and Mr Hobbs said that it had not been completed
Councilman Turner presented items to be placed in the Cornerstone
Motion to Adjourn by Councilman Merkl
