HomeMy WebLinkAboutResolution-1995-1469 RESOLUTION NO. 1469 TITLE: A RESOLUTION AUTHORIZING AN INTERGOVERNMENTAL AGREEMENT WITH THE CITY OF EDGEWATER FOR THE SLURRY SEALING OF SEVERAL EDGEWATER STREET SEGMENTS. WHEREAS, Section 14.2 of the Home Rule Charter of the city of Wheat Ridge provides express authority to enter into intergov- ernmental agreements providing for cooperative efforts between governments; and WHEREAS, The City of Edgewater has requested Edgewater street segments be included in Wheat Preventive Maintenance Program (Slurry Seal); and that several Ridge'S 1995 WHEREAS, In the spirit of cooperation, Wheat Ridge hereby agrees to include Edgewater's street segments in its 1995 Preven- tive Maintenance Program (Slurry Seal). Wheat Ridge will provide construction management and oversight of Edgewater' s inspection personnel; and, WHEREAS, In order to insure that project costs are equi- tably distributed between the cities and that ownership and maintenance responsibilities are clarified, it is necessary to enter into an intergovernmental agreement with the city of Edge- water. NOW, THEREFORE, BE IT RESOLVED that: Sec. 1. The mayor of the City of Wheat Ridge is hereby authorized to execute an intergovernmental agreement with the City of Edgewater for the inclusion of Edgewater street segments in Wheat Ridge's 1995 Preventive Maintenance Program (Slurry Seal) . " ........;;....._ /"t,)i-,~l~.... ,) ~t~.,.~ WANDA SANG, CITY CLERK 1 INTERGOVE~~ENTAL AGREEMENT THIS AGREEMENT MADE AND ENTERED INTO THIS 10th DAY OF April 1995, by and beb.'een the city of Wheat Ridge, with offlces at 7500 West 29th Avenue, Wheat Ridge, Colorado 80215, a Home Rule Municipality within the county of Jefferson, state of Colorado, hereinafter referred to as "Wheat Ridge", and the city of Edgewater, a Home Rule Municipality, with offices at 240l Sheridan Boulevard, Denver, Colorado 80214, County of Jefferson, State of Colorado, hereinafter referred to as "Edgewater", Wheat Ridge and Edgewater hereinafter sometimes referred to as "Parties". WITNESSETH THAT: WHEREAS, sections 29-1-201 and 29-1-203 Colorado Revised Statutes, 1972, as amended, permit and encourage governments to make the most efficient use of their powers and responsibilities by cooperating and contracting with other governments to provide authorized services; and, wnEREAS, Wheat Ridge has an ongoing Preventive Maintenance Program in which a portion of its streets each year are treated under the Slurry Seal part of the program, hereinafter sometimes referred to as the "Project"i and, WHEREAS, Edgewater wishes to include several street segments in Wheat Ridge's annual Preventive Maintenance Program (Slurry Seal), said street segments hereinafter sometimes referred to as the "Edgewater streets"; and, WHEREAS, The Parties desire to cooperate to the fullest extent possible to ensure that the planning, engineering and construc- tion of the Edgewater streets is accomplished according to the mutual desires of each party for the best interests of their respective citizens. NOW, THEREFORE, in order to accomplish the above stated desires, and in consideration of the mutual covenants and promises herein set forth, the Parties agree as follows: 1. The parties understand and agree that the inclusion of the Edgewater streets into Wheat Ridge'S annual Preventive Maintenance Program (Slurry Seal) will be in accordance with engineering specifications and design standards mutually acceptable and beneficial to the parties in order to bring the Edgewater streets into an acceptable service level as defined by each party. 2. Wheat Ridge agrees to design, advertise, award a construction contract and provide contract administration for the Project in accordance with the mutual desires of both parties. Edgewater agrees to provide project inspection for the Edgewater streets. 3. Wheat Ridge will provide a separate bid tabulation in the Preventive Maintenance Program (Slurry Seal) Bid Proposal for the 1 contractor for the Project. 8. wneat Ridge agrees to be responsible for the administration of the construction contract according to applicable state and federal la..'s. Edgewater agrees to assist as needed or re- quested to accomplish such administration and will be responsible for project inspection of the Edgewater street segments. 9. Wheat Ridge agrees to prepare engineering estimates, advertise for construction bids, conduct a formal bid opening, prepare formal contract documents, and award construction contracts. The construction documents shall be submitted to Edgewater for review prior to bid opening and any addendum thereto affecting the Edgewater streets shall be submitted to Edgewater for review. Edgewater will be allowed to review all bids submitted and a contract will not be awarded for the Edgewater streets without prior approval of Edgewater. 10. Wheat Ridge's inspection personnel will be available for assistance when the contractor is in Edgewater and will be responsible for contract administration functions. Wheat Ridge will make the final judgment relating to acceptance of slurry seal material placed on the Edgewater streets. 12. The parties agree that each shall own the improvements located within their respective jurisdictions. 13. The parties agree that the contractor to whom the Project is awarded will be required to carry, at a minlmum, adequate workers compensation, casualty and liability insurance in amounts mutually acceptable to the Parties. Contractor will be required to name Edgewater as an additional insured in his insurance policies. 14. The parties agree that the contractor to whom the Project is awarded shall be required to present a five percent (5%) bid bond at time of bid opening and 100 percent (100%) performance and labor and materials payment bonds at time of contract execution. The Contractor will also comply with any other applicable statutory provisions required of the parties. 15. Each party shall be responsible for its own negligent acts. Wheat Ridge shall be solely responsible for the design, construction and administration of said project as described above, and shall be solely responsible for any liability resulting from or relating to said design, construction and administration of said project. Each party will be responsible for project inspection within their own jurisdiction. Each party 3 RESOLUTION NO. ] 4liR Series of 1995 TITLE: RESOLUTION APPROVING FIRST AMENDMENT OF INTERGOVERNMENTAL AGREEMENT ESTABLISHING THE ROCKY FLATS LOCAL IMPACTS INITIATIVE WHEREAS, the City of Wheat Ridge entered into an Intergovernmental Agreement on March 18, 1993, by and between other municipalities of Jefferson County; and WHEREAS, the Rocky Flats nuclear weapons facility, a federal reservation located in Jefferson County ("Rocky Flats"), has been a producer of nuclear weapons components for some forty years and, in such capacity, has had substantial social, environmental and economic impacts on the region; and WHEREAS, the parties have modifications in the Intergovernmental of Wheat Ridge concurs; agreed to certain minor Agreement to which the City WHEREAS, the City Council of the agreed to enter into the attached Intergovernmental Agreement establishing Impacts Initiative; City of Wheat Ridge has First Amendment to the Rocky Flats Local NOW, THEREFORE, BE IT RESOLVED by the City of Wheat Ridge, Colorado, as follows: l. That certain First Amendment to Intergovernmental Agreement establishing the Rocky Flats Local Impacts Initiative between the City of Wheat Ridge, Colorado, and other municipalities in Jefferson County, attached hereto, is hereby approved. 2. The Mayor and City Clerk are authorized to execute said First Amendment to the Intergovernmental Agreement.
