RESOLUTION NO. 1476

TITLE:
A RESOLUTION AUTHORIZING THE CONDEMNATION OF PROPERTY
INTERESTS FOR THE SHERIDAN-38TH AVENUE INTERSECTION
PROJECT
WHEREAS, the City Council of the City of Wheat Ridge has
determined that it is necessary to improve the Sheridan-38th Avenue
intersection to enhance traffic flow and traffic safety; and
WHEREAS, the City Council of the City of Wheat Ridge has
determined that it is necessary to acquire the property described
in Exhibit A attached hereto and incorporated herein in order to
construct the improvements associated with the Sheridan-38th Avenue
Intersection Project; and
WHEREAS, the City has negotiated in good faith with the
owner of the property described in Exhibit A; and
WHEREAS, the parties have been unable to agree upon the
purchase price of the property needed for the Project, more
particularly described in Exhibit A, and it is necessary for the
City to acquire immediate possession thereof.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of
the City of Wheat Ridge, Colorado, that:
1. The City Attorney is instructed on behalf of the City
of Wheat Ridge to exercise the power of eminent domain vested in
the city and proceed immediately to condemn the property described
in Exhibit A.
2. A copy of this Resolution shall be forwarded to the
record owner of the property described in Exhibit A.

Description of Property:
A tract ofland lying in the SE 1/4 of Section 24, Township 3 South, Range 69 West of the 6th
Principal Meridian, City ofWheat Ridge, County of Jefferson, State of Colorado, described as:
THE WEST III FEET OF THE EAST 141 FEET OF THE NORTH 135 FEET OF THE
SOUTH 165 FEET OF THE SE 1/4 OF SAID SECTION 24.
EXCEPT: THAT TRACT OF LAND DESCRIBED AT RECEPTION NUMBER 91058214
OF THE OFFICIAL RECORDS OF THE COUNTY OF JEFFERSON, STATE OF
COLORADO.
SAID TRACT CONT AINlNG 14,985 SQUARE FEET, MORE OR LESS.
