HomeMy WebLinkAbout01/09/1978 fJTY COUNCIL MINUTES--January 9, 1~78 The three hundred ninety-second regular meeting of the Wheat Ridge City Council was ~rought to order by Anthony V Zarlengo, Municipal Court Judge, expressing feellngs o~ honor of the fifth administration of the City Judge Zarlengo made comments wlth respect to the background of the formation of the City for the purp~ses of giving to its citizens specific desired services, commending the s:rvlces glven by past and present members of the City Council, City Clerk, and Clty Treasurer Present wer~ Mayor Frank Stites, Council persons Robert G Howard, Calvin 0 Hulsey, Lawrence G Merkl, Mayor-Elect Oliver V Phillips, Councilperson Joseph M Donaldson, Council person Mary Jo Cavarra, Council person-Elect Anthony N Fiasco, Council person-Elect Gary L Lewman, Council person-Elect Ray C Pepe, and Council person Louise F Turner, City Clerk Carol F Hampf, and City Treasur- er James 0 Malone Also present were City Administrator John A Jerman, Judge Anthony V Zarlengo, Robert L Danz, Maurice F Fox, Edmund G Lambert, Deputy City Clerk Phyllis J Kramer, Department Heads Robert G Vidal, Clyde E Hobbs, Chief Ed Pinson, Wm Wiggins, David Shelley, staff, and interested citizens Swearing-in Ceremonies At this time, Judge Zarlengo called before him the honorable Oliver F Phillips, Mayor-Elect Phillips gave the oath of office as Mayor of the City of Wheat Ridge which was accepted Carol F Hampf and James 0 Malone gave the respective oaths of office as City Clerk and City Treasurer which were accepted by Judge Zarlengo City Council members Mary Jo Cavarra, Joseph M Donaldson, Anthony N Fiasco, Gary L Lewman, Ray C Pepe, and Louise F Turner were called before Judge Zarlengo The Council persons gave the oaths of office as City Council repre- sentatives for the City of Wheat Ridge which were accepted Convening of New Council Thereafter the new Council was convened by Mayor Phillips, who stated the meeting came to order at 7 37 p m Item 2 Presentation o~reciation Plaques Mayor Stites presented plaques to the outgoing Council persons Robert G Howard, Calvin 0 Hulsey, and Lawrence G Merkl, on behalf of the citizens of Wheat Ridge in appreciation of their dedicated service ~tem 1 Presentatio~~f Appreciation Award to Mayor Frank Stites Mayor Phillips on behalf of the citizens of Wheat Ridge presented an inscribed silver bowl to Mayor Stites in appreciation of his dedicated service Item~Jllec~!on of Mayor Pro Tem by Secret Ballot Pursuant to the City Council Rules of Order and Procedure, by secret ballot collected by City Clerk and presented to Mayor Phillips, Councilperson Joseph M Donaldson was selected by vote of 4-2 as Mayor Pro Tem for the term of office January 9, 1978 - January 7, 1980 Item 4 Election of Council President by Secret Ballot Pursuant to the City Council Rules of Order and Procedure, by a second secret ballot collected by City Clerk and presented to Mayor Phillips, Council person Mary Jo Cavarra was selected by vote of 4-3 as Council President for the term of office January 9,1978 - January 7,1980, Mayor Phillips voting to break the tie Mayor Phillips qualified his tie-breaking vote by stating the person he selected had never served as a Council President, while the other Council person had The first secret balloting result showed no one had received a majority of the votes Item 5 _A2Q.CJintment of Muni~i~ Judge Motion by Council person Mary Jo Cavarra "I would move that Anthony Zarlengo be appointed as Municipal Judge for a two-year term" Motion seconded by Councilperson Turner Judge Zarlengo replied to questions.presented by mem- bers of the Council Motion carried by vote of 4-2, Councllpersons Fiasco and Lewman voting nay City Council Minutes--January 9, 1978 Page -2- Item 7 Appointment of City Attorney (This item taken out of order) Motion by Councilperon Joseph M Donaldson "I move that Edmund G Lambert be appointed City Attorney for the City of Wheat Ridge, and I also move that the contractual agreement between the City and Edmund G Lambert as presented and discussed this evening be approved, and that the Mayor be authorized to sign the agreement" Motion seconded by Council- person Fiasco Motion carried 6-0 Item 6 Appointment of Deputy Municipal Judge Motion by Council person Gary L Lewman "I move that Robert L Danz be appointed Deputy Municipal Judge of the City of Wheat Ridge" Motion seconded by Council person Mary Jo Cavarra Motion carried 6-0 Item 8 Appointments to Parks & Recreation Commission (This item had been deferred from the Council meeting of December 19, 1977 Three regular members to 3-year terms, January 1, 1978-January 1, 1981, and one alternate per Section 15-13 of Wheat Ridge Code of Laws were to be selected Motion by Council person Joseph ~1 Donaldson "I move that Edgar Johnson be appointed for a three-year term on the Parks & Recreation Commission" Motion seconded by Councilperson Gary L Lewman Motion carried 6-0 Motion by Council person Anthony N Flasco "I would like to move that John McDermott, 3925 Marshall St , be appointed to the Parks & Recreation Commission" Motion seconded by Council person Donaldson Motion carried 6-0 Motion by Council person Mary Jo Cavarra "I would like to appoint Jerald Wilson, 3390 Holland St , to the Parks & Recreation Commission" Motion seconded by Council person Lewman Motion carried 6-0 Motion by Councilperson Joseph M Donaldson "Inasmuch as three appointments have been made that have been male members, I would move that a female be appointed as a member at large, namely, Mrs Doris Ibbison, a Wheat Ridge resi- dent of thirty years standing, and who has expressed a desire to be a member of this Commission" Motion seconded by Councilperson Turner Motion carried 5-1, with Council person Fiasco voting nay (Doris M Ibbison, 3615 Teller St ) Items 9 and 10 Appointments by Mayor of Council Members to City Hall Fur- nishings and City Hall Communications Committees Council persons Mary Jo Cavarra, Gary L Lewman, and Ray C Pepe were appointed by Mayor Phillips to the City Hall Furnishings Committee Council persons Joseph M Donaldson, Anthony N Fiasco, and Louise F Turner were appointed by Mayor Phillips to the City Hall Communications Committee Announcements The Mayor reminded Council members of Orientation Workshop for newly elected Council members to be held January 19-20, 1978, beginning at 8 30 am, at the Brown Place Hotel, with reservations to be placed with the City Clerk Swearing-in of Deputy Municipal Judge Robert L Danz At this time, Robert L Danz was called forth by Judge Zarlengo Mr Danz gave the oath of office as Deputy Municipal Judge for the City of Wheat Ridge which was accepted Adjournment Motion by Council person Lewman to adjourn meeting, seconded, all aye The City Council meeting was adjourned for a reception of the newly installed officers of the City of Wheat Ridge / I. ~.~.____ ~{r JANUARY 9, 1978 SECRET BALLOTS RE $: "- cl f ~0 ~<? In 'J ~ ~ e> r s::- SELECTION OF MAYOR PRO TEM AND COUNCIL PRESIDENT cI>< ~ \j ~ j fX=\ U 1 ~ eJ \ 10900 v'EST 44TH i-\VENUE TE I_EPHUN E in, '121 8480 , 'HE, IT F,lfIG[ cr IU lR'\lJU JonJ~ n'e City ,,f ~heat GRidge I)FP,-,cT 1UIT "I" U,'.ili\,1l 'I'J IT',' DE' ELtlF [ T PLAI\!NIVl; DI\ January 26, 1978 Mayor/City Council City of Wheat Ridge Wheat Ridge Colorado The Wheat Ridge Planning Commission recommends the release of all correspondence and information on the zoning map audit Prior to taking this action, the Planning Commission has contacted the City Attorney, through ~lr Dave Shelley (~cting Community Development Director) and has been advised that the City Attorney has no objections to the above recommendation Because of existing procedural handling, known zoning map discrepancies and the overall poor quality of the current zoning map, the Vmeat Ridge Planning Commission along with the Department of Community Development, decided to spearhead the task of creating a new district zoning map for all lands lying within the City limits of Wheat Ridge With the cooperation of City Council, nearly one year ago a private consultant (CH2M- Hill) was hired to prepare a new zoning map The consultant was also directed to research for existing discrepancies and recommend security, procedural handling for the new zoning map CH2M Hill completed their contract about min-vear 1977 At this point the Planning Commission determined they still did not have a completed document that the Commission could recommend to City Council for adoption Both Community Development and the Planning Commission continued to work on this pro- ject We recommended a new set of district zoning maps on a scale of 1"=100' and a procedural guide for zoning map preparation that was approved by City Council (note copy of Procedural Guide attached) The Planning Commission wants to emphasize that all the maps and correspondence are working documents only Any of the discrepancies noted exist as a result of research by Community Development staff and CI12M Hill No zoning changes have taken place on any conflicting zoning If any zoning recommendations are needed, they will come from the Planning Commission only after public hearings The Planning Commission and staff knew we were undertaking a difficult task in creating I flff/( III ((If u!\ljl( If 1'\ I/.I Nfl} f/\ 1.11 dIl "1 hI' ('(/1'1/011(11/ ('11\ Mayor/City Council ') -,-- Tanuary 26, 1978 new district zoning maps We purposely set our goals high for clarity and accuracy It was hopeo that the task could be completed in about four months To date we have taken well over a year Recommendation for public release of material on the audit and zoning map are being made now because completion of this work could go well into 1978 The Commission and staff are very confident of the successful completion of this work and an excellent working zoning map will be forthcoming Sincerely, ,:- (" <. , , ~ .~ ~- -t! is the Procedural Guide re Zoning Map Preparation as noted in the letter from the Planning Commission dated January 26, 1978, read into the minutes of the City Council meeting of January 30, 1978 This Community Dcvclopment shall create a new Zoning District r,lap for all lands lying within thc city limits of the City of IVheat Ridge according to the following rules and procedurcs 1 The new Zoning District 'laps shall be drafted on mylar at a scale of 1 ' - 100' 2 The source for the map base information (scction lines other land lines rO;Jth"ay location (except for those roadways located within subdivisions) and Public ServiCE Company right-of-way lines) shall be the 1"-100' Quarter Section l1ajJs on file in the Department of Co~munity DeveloDment The source for the map base information dealing with Clear Creek, Lena Gulch and Rocky ~lountain Ditch shall be the aerial photographs at the scale of 1"-50' which are on file in tl-le Department of Com- munity Developmcnt ~ 3 The new Zoning Dist~ict Maps shall show section lines, quarter-section lines road way I~cations and Public Scrvice Company rights-of-way lines by means of tracing .. from the existing 1"-100' Quarter Section '1aps 4 The new Zoning District Maps shall also show the location of Lena Gulch, Rocky ~Iountain Ditch and Clear Creek by means of tracing approximate location lines onto the new Zoning District 1,laps from the 1"=50' aerial photographs after photographic adjustITTellt is made to produce the scale of 1"=100' 5 The new Zoning District Maps shall also show all official, approved and recordeo subdivisions and the boundaries of all official, approved and recorderl planned residential development plans, planned commercial dcvelopment plans and industrial development plans These boundaries shall be tFaced onto the new Zoning District Maps front t!1C official plats and plans after photographic adjustment is made to produc:e the scale of 1"=100' 6 Zoning district boundaries shall be drawn on the new Zoning District Maps by the drafting of a solid black line showing the limits of the various districts and thc zoning district classification of the property shall be labeled within the boundar with black ink -2- . 7 Zoning district boundarics shall be established pursuant to the following (a) First all approvcd zoning district amcndmcnts since the City's incorporat shall be drafted on the new Zoning District Maps based on legal descriptio as included in the City's zoning files The Department of Community Deve lopment draftsman shall draft all such legal descriptions and said oraftin shall be checked by the Director of Community Development (Note the zoning boundaries of all properties that are suhject to discrepancies as delineated in the zoning map audit completed by CH2~ Hill Consulting firm shall be determined by the Planning Commission by voice vote) (b) Second, the remaining zoning districting shall be drafted on the new Zonir District Maps pursuant to the following 1 The various zoning districts shall be scaled as closely as possible on the existing Zoning District Map dated June, 1975 (scale 1"=500') 2 The dimensions of the various district boundaries as scaled on the 1"=500' map shall then be drafted on the new Zoning District Maps (1"=100' Quarter Section ~laps) 8 During preparation of the new zoning District Maps, the Department of Community Development shall use the following guidelines, In the order listed, for deter- mining zoning district boundaries When there IS an apparent discrepancy of zoning boundary location due to the change in map scale as well as when the dis crepancy is apparent on the current Zoning 11ap (ie , zoning district overlaps or areas void of zoning lying between two adjacent zoning districts) (a) The Jefferson County Board of Commissioners minutes and resolutions and al available Court records shall be researched for a zoning case covering sai disc~epancy If there is a case covering the area in question, the bounc shall be established per the minutes or court order on record The DirE of the Department shall check the drafting of said cases -3- (b) If a-zoning district boundary appears to be on or withIn ten (10) feet of a property line, street rights-of-way line, subdivision or lot or parcel boundary line, or the centerline of an alley or waterway, such line shall become the zoning district boundary line (c) If a zoning district boundary line appears to overlap another zoning district boundary line or to not meet any adjoining district boundary line and the boundaries are within ten (10) feet of each ~ther, each boundary line shall be adjusted by one-half (~) of the total dimension of the overlap or separation (d) If a zoning district boundary line appears to be located more than ten (10) feet from a property line, street rights-of-way line, subdivision boundary line, or the centerline of an alley or waterway, or if a zoning district boundary line appears to overlap another zoning district boundary line by more than ten (lOJ feet, or if a zoning district boundary line does not fall within ten (10) feet OT another adjacent zoning district boundary line, the boundary of the districts shall be established by recorded vote of the Plan- nlng Commission 9 After the completion of the new Zoning District Maps and after the Planning Com- mission has voiced their satisfaction with the completeness of the maps and the procedure used in their preparation the Planning Commission shall hold a public . hearing for the purpose of adopting the new Zoning District Maps, and after com- pletion of the public hearings the Planning Commission shall make their recom- mendation for adoption of the new Zoning District Map to the City Council 10 The City Council shall then hold a public hearing for the purpose of adopting the new Zoning District Ma~s and shall make such decisions as necessary or desirable to adopt said maps
