30 pm, 4355 Field Street Councilpersons present were Mary Jo Cavarra, Joseph M Donaldson, Gary L Lewman, Anthony N FIasco, Ray C Pepe, and Louise F Turner Also present were City Clerk Carol John A Jerman, City Attorney Edmund Phyllis J Kramer, Department Heads Pinson, Robert G Vidal, Richard H and interested citizens F Hampf, City Administrator G Lambert, Deputy City Clerk Clyde E Hobbs, Chief Ed Bredt, and Dave Shelley, staff Approval of Minutes Motion by Councilperson Donaldson I move that the minutes of the meetlngs of December 19, 1977, and January 9, 1978, be approved as printed Seconded by Councilperson Cavarra Motion carried by 6-0 Public Comment No one signed the Roster to speak under Public Comment Item 1 (A) Presentation of specification package for furnishings for Munlcipal Complex (The Council members, as well as the Press, were invited by Dee Burt~n, City Hall Project Coordinator, to attend a tour of the new Municipal Complex on Saturday morning, January 21, 1978, at 9 30 a m She stated Arba Stlnnett, Project Archltect, of Hennlngson Durham & Richardson, and Mr Lillard, the contractor, would be present After the tour and return to the Council chambers, there would be a review of the Budget and update of project Ms Burton will confirm tour arrangements with the Council ) Dee Burton, City Hall Project Coordinator, and the InterPlan repre- sentative presented the proposed furnishings specification packet Motion by Councilperson Cavarra "Concerning item 75 Auditorium Seatlng--200 chairs involved, and the bid proposed is for fabric cover, I would like to move that these specifications be amended for an alternate bid for vinyl upholstery for the purposes of main- tenance factor--to take a look at comparison fabrics on this bid " Seconded by Councilperson FIasco Motion carried 6-0 Councilperson Pepe requested Council consider advisability of fil- ing cabinets for the use of Council members in the new Complex Council members' individual needs were discussed Amended Motion "I move that filing cabinets as requested by each Councilperson be made available in the Council meeting room" Original motion by Councilperson Pepe, seconded by Councilperson FIasco Motion as amended by Councilperson Cavarra, seconded by Councilperson Turner Amendment carried 6-0 Motion as amended carried 6-0 Following discussion of items 3 Lin Ft 80" Non-Acoust Panel and 4 Lin Ft 42" Non-Acoust Panel, Motion by Councilperson Lewman "I would move that item 3 Non-Acoust Panel be developed as an alternate to the bid proposal" Seconded by Councilperson Pepe and carried by vote of 6-0 Motion by Councilperson Cavarra "I would like to move that Council authorize the City of Wheat Ridge through InterPlan to go out for bids per Specifications package as amended" Motion seconded by Councilperson FIasco After discussion of the merits of the open space concept vs solid walls and the furnishings requirements of each concept, the motion carried by a vote of 5-1, with Council- person Turner dissenting City Council Mlnutes--January 16, 1978 Page -2- Item 1 (B) Taping System for new Municipal Complex The City Clerk described the needs and requirements of a new taping system for City Council meetings in the new Municipal Complex and requested authorization of the Council for preparation of specifica- tions by the City's Purchasing Agent for bid proposals Motion by Councilperson FIasco "I would so move that the Purchasing Agent, working with the City Clerk, be instructed to develop a bid package for a sound system, as well as taping system, within the Councll chambers, and further that this be made a part of the Communications Commltee responsibilities" Seconded by Councilperson Donaldson Discussion concluded that while a bid package had been previously let re the sound system, it was determined that this matter should again be reviewed by the Council in conjunction with a new taping system Motion carried by a vote of 6-0 Item 2 (A) Public Hearing re Application by Planning Commission to amend City of Wheat Ridge Code of Laws, Appendix A, to provide for comprehensive landscaping requirements in all districts Mr Shelley, Acting Director of Community Development, summarized the various points in the proposed amendment for comprehensive land- scaping requirements in all districts, and noted that the Planning Commission heard the matter on 15 December 1977 and recommended ap- proval by a vote of 5-0 After review and discussion, it was the consensus of the Council that this portion of the amendment be de- ferred to the February 6 Study Session so that the City Attorney could make a review and prepare some recommendations At that time the matter will be discussed fully Motion by Council person Cavarra "I would move that this portlon of the proposed amendment to Ordinance No 98 be deferred to the February Study Session" (portion 2 (A) only) Motion seconded by Councilperson FIasco and carried by vote of 6-0 Item 2 (B) Public Hearing re Application by Planning Commission to amend Clty of Wheat Ridge Code of Laws, Appendix A to provide for comprehenslve landscaped buffering requirements Mr Shelley, Acting Director of Community Development, explained that this proposed amendment dealt with the buffering requirements between commercial and adjacent residentiil districts, stating the Planning Commission had heard the matter on 15 December 1977 and recommended approval by a vote of 5-0 Motion by Councilperson Cavarra "I would move that we request the City Attorney to draft these amendments in ordinance form, and at that time we can also look at the details, as I think the concept is good" Motion seconded by Councilperson FIasco (The City Attorney requested that he be permitted to present it at the February 6th Study Ses- slon) Motion carried by vote of 6-0 Item 2 (C) Public Hearing re Application by City of Wheat Ridge to amend-CIty of Wheat Ridge Code of Laws, Appendix B, Flood Plain Zoning Ordinance, to comply with certain Federal Flood Insurance Program requirements Mr Shelley, Acting Director of Community Development, explained that in order to comply with the Federal requirements, the Flood Plain Zonlng Ordinance must be amended prior to February 1, 1978 However, ~f the ~mending ordinance has been passed on first reading by that tlme, thls would be acceptable Mr Shelley reviewed and explained the requirements set out, the definitions, the relation- ship to the Flood Plain Map, and the insurance restrictions (The City AdminisTrntor pointed out that in view of the Urban Drainage and Flood Control District (UD&FCD) study concerning Sloans Lake, and its recommendation that that area be incorporated in the City's Flood Plai~ Ordinance, th~s If lQ7" tage -7- '------- - ~ I~ /' CITY OF WHEAT RIDGE - MEMORANDUM To Mayor 01 i ver V Ph ill ips, John From Jerman, City Council Greco v Wheat Ridge et al D~e Edmund G Lambert, City Attorney January 16, 1978 Subject Approved Date In the above-referenced action, the Plaintiffs have obtained a Temporary Restraining Order enjoining the City of Wheat Ridge from carrying out the issuance of a building permit to Floyd Smith for the construction of anything other than a single-family dwelling on property located at the southeast corner of West 37th Avenue and Holland Street, City of Wheat Ridge The Restraining Order is effective until a court hearing can be held for the determination of the merits of Plaintiff's claim A Temporary Restraining Order has also been issued enjoining the owner of this property from commencing construction pursuant to the building permit until that time a hearjng can be held to determine the merits of the Plaintiff's claim The effect of the Court Orders is to deprive the Defendant Smith of the building permit until the Temporary Restraining Order is dismissed or withdrawn The attorney for the PI a i ntiffs has nolV requested to address City Council at their regularly scheduled meeting this date However, in view of the present Restraining Order enjoining the city from the issuance of a building permit, it would not be proper for the city to take any action on this matter, except with the approval of the District Court Since this matter is set for hearing on Defendant Smith's Motion for Dismissal of the Temporary Restraining Order on January, 18, 1978, it is recommended that the city refrain from any further action until the results of that hearing are made available From a legal standpoint, any action taken by the city at this time would not be ripe for consideration and accordingly, inappropriate EGL/ll Attachment to City Council Minutes--January 16, 1978 Re City Council Agenda Item "Item 18 Communication from matter of Sam Greco et al vs Smith" 18, January 16, 1978, titled, William A rohan concerning the City of Wheat Ridge and Floyd
