Home My WebLink AboutResolution-1997-1592 CITY OF WHEAT RIDGE, COLORADO RESOLUTION NO 1592 Series of 1997 TITLE A RESOLUTION APPROVING AN AGREEMENT WITH THE VOLUNTEERS OF AMERICA WHEREAS, the City of Wtleat Ridge operates a Community Center, and WHEREAS, the Volunteers of America, Colorado Branch, Seniors' Nutrition Program, funded through Title III-C of the Older Americans Act, wishes to contract for use of the Community Center for a Seniors' Nutrition Program; and WHEREAS, the City Council believes the Program would be of benefit to residents of Wheat Ridge NOW, THEREFORE, BE IT RESOLVED by the Wheat Ridge City Council, that the Mayor is authorized to execute, and the City Clerk to attest, an Intergovernmental Agreement between the Volunteers of America, Colorado Branch, Seniors' Nutrition Program and the City of Wheat Ridge regarding use of the Wheat Ridge Community Center. DONE AND RESOLVED this 25thdayof March , 1997 ,L),c;--..__.l J~.A: cL~, Dan Wilde, Mayor ATTEST )) - -= ./ I Ii f-' iI.. /'/'<\ ! ,',_ L-< ( Wanda Sang, ChyClerk " GE[Y.5302T 17f)152 1 INTERGOVERj~MENTAL AGREEMENT BETWEEN THE VOLUNTEERS OF AMERICA COLORADO BRANCH SENIOR'S NUTRITION PROGRA.M AND THE CITY OF \VHEA T RIDGE REGARDING USE OF THE WHEAT RIDGE COMM1. iNTTY CENTER THIS AGREEMENT is entered Into thiS 24 th day of March , 1997, by and between the VOLUNTEERS OF AMERICA NUTRITION PROGRAM, COLORADO DIVISION, a nonprofit corporatIOn (hereinafter referred to as "VOA" and the CITY OF WHEAT RIDGE, COLORADO, a mUnicipal corporatIOn (hereinafter referred to as "Wheat RIdge" or the "City"), and colleclively referred to as "the Parties" WHEREAS, VOA and the City are duly incorporated under laws of the State of Colorado and are authonzed to enter Into thiS Intergovernmental Agreement under Colo Rev Stat. 29-1-201, et seq. ----/ WHEREAS, the City operates a Community Center at 6363 West 35th Avenue, WHEREAS, VOA and the City agree to combIne the resources of both programs In an effort to establish a comprehensive well-Integrated program of services, WHEREAS, the City Will proVide a supervisor of mealslte volunteers entitled DInIng Center CoordInator for the VOA Senior's NutntlOn program, WHEREAS VOA seeks to have a Wheat Ridge CommunIty Center staff person act as DinIng Center CoordInator of the SenIors' NutntlOn program, WHEREAS, VOA will then monetanly reimburse the City of Wheat Ridge for the Dining Center CoordInators lime, NOW, THEREFORE, In consideratIOn of the foregOing recitals and mutual covenants and promIses set forth below, and other good and valuable conSideration, the receipt and suffiCiency of which IS hereby acknowledged, VOA and Wheat Ridge agree as follows I ObligatIOn of the CltV. The City agrees to a. Make a hall located at 6363 West 35th Avenue, IncludIng storage space and furnishings available for use of the SenIors' NutntlOn Program Monday through Thursday from 10'30 A.M. to 1'00 P.M. excluding VOA holidays, for the purpose of serving meals and SOCialiZing. b PrOVide Janltonal serVice, ul1lil1es, includIng phone serVIce and building maintenance. including Ice and snow removal from outSide walkways, and pest control as needed, c. ProVIde a DinIng Center CoordInator to be responSible for daily supervIsion of the center and It'S partiCipants. Intergovernmental agreement VOA and City contmued d. Mamtam any and all data reqUired bI Volunteers of Amenca Colorado Branch Nutntion Services DivIsIOn, to Include but not limited to participant forms, documentatIOn of meals served, computer log sheets, temperature compliance and meal reports e ProvIde outreach to the commumty about the Semors' NutntlOn Program f. Place orders for meals two days In advance not later than 1.30 P M. each day to VOA at 294-0111 g Provide clients the opportumty to make a confidential and voluntary dona- tIOn for the meal. All indiViduals not eligible to partICipate in the meal program on a donation baSIS will pay for the meal at the rate of$4 00 per meal or as amended by VOA. h. Forward all chent donatIOns and guest fees to VOA on a daily baSIS. 2. Obhgations of VOA. VOA agrees to, a. VOA will train coordinator(s) aSSIgned by the City b. ASSIgn a staff Supervisor, to be responsible for the superVISIOn and on gOIng training for the DinIng Center Coordinator. c. Provide a Satellite Site InstructIOn Manual to the Wheat Ridge Center Coordinator The contents of the manual will be used as a reference In the operation of the mealsIte program and In the traInIng of all staff and volunteers. d. Prepare and transport to the site a hot, nutntlOus lunch for dIning center partiCipants. e Perform outreach work In the commumty to pubhcIze the commumty center and dining center actiVIties. f. ProVide the City of Wheat Ridge a sum of $4200 00 per year payable at a rate of $35000 per month to assist With operatIOn of the dmmg center 3. All food prepared by VOA is to be consumed on the premises unless deSignated and packaged for home dehvery by the Dmlng Center Coordinator. 4 The VOA Semors' NutntlOn Program field supervisor will meet as necessary With the Wheat Ridge Commumty Center staff to facihtate commumcatIon and problem solvmg. 5 The Parties do not intend that thiS Agreement constitute or create an agency or JOint venture relatIonship Neither the City nor VOA, nor their officers, employees, volunteers and agents, shall be empowered to or shall act for or on behalf of the other Each Party hereby mdemm Intergovernmental agreement VOA and CIty contInued ties and holds the other harmless from and agaInst any claIms for Injury or damage. IncludIng attorney fees, for theIr neghgent acts or omIssIOns, and those of their separate officers, employees, volunteers and agents. 6 ThIS Agreement will remain In effect unless and until temlnated, reVised or altered upon (60) days \\Tltten notice by either party In addition, the City may termll1ate thiS agreement for cause or to protect pubhc health or safety upon (5) days \\Tltten notice to VOA, provided, however, that should VOA correct or cure the condition causing the health or safety threat prior to the expIra- tIOn of the (5) day penod, the Agreement shall not be terminated.
