HomeMy WebLinkAbout04/17/1978 CITY COUNCIL MINUTES CITY OF WHEAT RIDGE, COLORADO APRIL 17 1978 The Four Hundred and Fifth Regular meeting of the Wheat Ridge City Council was called to order by Mayor Oliver V Phillips at 7 35 pm, April 17 1978, 4355 Field St Councilpersons present were Mary Jo Cavarra, Joseph M Donaldson, Anthony N FIasco, Gary L Lewman, Ray C Pepe, and Louise F Turner Also present were City Clerk Carol F Hampf, City Administrator John A Jerman, City Attorney Edmund G Lambert, Deputy City Clerk Phyllis J Kramer, Department Heads Douglas W Hilyard, Chief Ed Pinson, Charles H Stromberg, staff, and interested citizens Approval of Minutes for meeting of April 10, 1978 City Clerk pointed out that on page 3, last paragraph, should read "3/8" rather than 3/8" "Bolt" asphalt Moti_on by Councilperson Donaldson "I the approval of the minutes of April 10,1978, as corrected", by Councilperson Turner, carried 6-0 Hot Asphalt" move for seconded NO PERSONS APPEARED FOR PUBLIC COMMENT NO PERSONS APPEARED TO SPEAK AT THE PUBLIC HEARINGS City Administrator introduced Dougla?~Hilyard, the newly appointed Director of Administrative Services Department Item 1 Ordinance No 263 Amending Sections 16, 17, 18 and 19 of Appendix A,.~oning Ordinance, Concerning the Area Regulations of certain Commercial Districts (second reading) Ord No 263 introduced by Councilperson Cavarra, title read by City Clerk (Council- person Turner noted errors of (1) numbers "12 feet" and "15 feet" have been reversed in paragraphs 7 and 8 of Section 3 (5), and (2) that the "Board of Adjustment" should be substituted for "Board of Adjustment~" wherever applicable) Motion to adopt Ord No 263 by Councilperson Turner, seconded by Councilperson Cavarra Motion to amend Ord No 263 by Councilperson Cavarra "I propose this amendment to the first sentence to Sections 3 6, and 9, to read 'If parking is located other than in the front yard, and said front yard is completely landscaped, the minimum depth of the front yard may be reduced to 30 feet', unless the height of the building exceeds 35 feet in which case the minimum depth of the front yard shall be 50 feet", seconded by Councilperson Pepe, carried 6-0 ,t:lotio~ to amend by Councilperson FIasco "I would move to amend the motion, so that item 8, in all sections, shall read 'A minimum of 12 feet landscaped buffer area is required when adjacent to a residentially zoned and used parcel''', seconded by Councilperson Turner, carried 5-1, with Councilperson Lewman voting no Motion ~o adopt as amended carried 6-0 Ordinance No 264 Amending Sec 28 23(~) of ~ndix A, Zoning Ordinance, which Section pertains to the defirlition of "landscaping" Ord No 264 introduced by Councilperson Lewman, title read by City Clerk Motion by Councilperson Lewman "I would ask that Ord No 264 be approved on sec- ond reading and ordered published", seconded by Councilperson Turner, carried 6-0 Item 2 Item 3 Ordinance No 265 Amending Appendix A, Zoning Ordinance, ~ the Addition of Section~~ which pertains t~ Comprehensive Landscaping~9uirements in Districts all Ord No 265 introduced by Councilperson Cavarra, title read by City Clerk Motion by Councilperson Cavarra "I move Ord No 265 be approved on second read- ing and ordered published", seconded by Councilperson FIasco, carried 6-0 Item 4 Ordinance No 274 Repealing Ord No 231 and Ord No 241 ; and Further Regarding City Employee Longevity Pay, Merit Sal~ncreases, Cost of Living, and Sick Leave Conversion Pay Ord No 274 introduced by Councilperson Lewman, title read by City Clerk Motion by Councilperson FIasco "I would move that Ord No 274 be adopted on second reading", seconded by Councilperson Lewman Motion to amend by Council- person Lewman "I would move that Section I of Ordinance 274 shall be made retroactive to March 17, 1978, and Section 2 of Ordinance No 274 shall be retroactive to March 13, 1978", seconded by Councilperson FIasco Janet Phillips of the City Attorney's office made the explanation as to the effective dates for the two specific portions Motion carried 6-0 Motion to adopt as amended carried 6-0 CITY COUNCIL MINUTES April 17, 1978 Page -2- Item 5 Ordinance No 275 Amendi~ Section 16-3 of the Code ability oZ the Personnel Rules and Regulations Ord No 275 intr04uce~ by Councilperson Pepe, title read by City Clerk Motion by Councilperson Lewman "I would move to adopt Ordinance No 275 on second reading" seconded by Councilperson FIasco Motion to amend by Councilperson Pepe "I move that the effective date of Ordinance No 275 be amended tor ea d Ma r chi 3, 1978", seconded by Councilperson FIasco, carried 6-0 Motion to adopt as amended carried 6-0 Regarding the ~pplic- Item 6 Motion to Amend re Yellow Street Paint Motion by Councilperson Lewman "I will move that the dollar amount in the motion of March 27, 1978 regarding the purchase of paint to be used for street striping be amended to read $7854 instead of $7801 50", seconded by Councilperson Turner, carried 6-0 City Administrator announced (I) that at the request of Councilperson Turner re Solar-Day of May 3rd--the date President Carter will be visi~ing the Solar Research Institute in Golden, he had contacted officials of SERI and requested participation of the Mayor and Council in this visitation since the City's new City Hall is to be solar-assisted The City Hall is on the list for the President's consideration for inclusion in his tour The City is to be notified of the decision (2) Infor- mation re City's Insurance Broker of Record, Galbraith & Green, has been forwarded to City Council Item 7 City Attorney's Opinion re Auditorium Chairs Recommended the purchase be made through competitive bidding in accordance with City's Purchasing Manual This matter is being handled by the City's Purchasing Agent, and it is hoped some 4 to 5 chairs will be available for inspection of City Council within a week or two Item 8 City Attorney's opinion re Recommendation of referral of water well at City Hall site matters to water attorney, Mr Steve Hannon, who has acted as a water judge in Greeley Mr Hannon will be willing to take on the work at $60 per hour City Administrator stated he had contacted Virgil Hill of Consoli- dated Mutual who verified Board would consider sale of the water rights to the City at estimated cost of no more than $1,000 Motion by Councilperson Cavarra "I would move that we authorize Mr Lambert to assign Mr Hannon to research the possibility of the City adjudicating the well on the City Hall Site at a cost of approximately $120, representing two hours legal work", seconded by Councilperson FIasco, carried 6-0 Councilperson Turner re Question for City Attorney "According to the Code, when the sale of the Police Building was put on the ballot, did a positive response to that question mean that the City now can sell the building or the City must sell the building?" The City Attorney will respond to the question, after research, at a future date Item 9 Proposed cancellation of May 29 meeting due to Holiday Motion by Council- person Donaldson "I move that we cancel the meeting of May 29th due to it being a holiday, and in place of it, have our meeting May 30th, as a Study Session meeting", seconded by Councilperson FIasco, carried 6-0 Item 10 Report on DRCOG meeting re Urban Systems by CouncilpersonLewman He stated the meeting is to be held on May 3rd, and he has not been given any idea as to percentage chance of City's obtaining grant funds He also reported a letter suggesting several amendments has been sent to DRCOG re the Regional Housing Opportunity Plan which is up for public hearing Item II Progress Report on status of Crown Hill Negotiations Councilperson Cavarra reported the Committee met last Thursday (April 13, 1978) and authorized Mr--P;intz of the Open Space to go ahead with negotiations Mr Printz reported that water is available and there is a willing seller He was directed to go ahead with negotiations There is a question of participation shares by the entities Motion by Councilperson Cavarra "I would move that at the close of this me;ting we have an Executive Session regarding the Wheat Ridge participation in the Crown Hill purchase", seconded by Councilper- son FIasco, carried 6-0 CITY COUNCIL MINUTES APRIL 17, 1978 Page -3- Councilperson Cavarra stated the Personnel Commission Chairman requested an Executive Session with the City Council re personnel matters that might involve pending liti- gation Motion by Councilperson Cavarra "I will move that the City Council and the Personnel Commission meet in an Executive Session re person- nel matters at 6 30 pm, Monday, April 24, 1978", seconded by Council- person FIasco; carried 6-0 The City Attorney, City Administrator, and the new Director of Administrative Services are to be present at the Executive Session Councilperson Cavarra reported re the Community Development Committee meeting (1) Going out for bid on sidewalks left in the Budget, and (2) streets designated last year but not completed--this will be on a later agenda Ward I Councilpersons may wish to review the list as a representative had not been able to attend the meeting The Sign Code was also discussed, and City staff has been asked to review height and size requirements through the Planning Commission to Council City Administrator reported possible loss of community center (Ye Olde Firehouse building at Columbia Heights School site) because of anticipated sale of the school property Alternates to be investigated, including move of the building after gift by or purchase from the School District, and use of Hart Estate Councilper- son Pepe requested a (legal) description of the said school property from the Com- munity Development Department City Administrator also reported a possible problem with the telephone system for the Police Department at the new City Hall Building After discussion, it was Council consensus that the City Administrator, Chief of Police, City Hall Communi- cations Committee, and Mountain Bell representatives should meet for the purposes of arbitrating this matter MEETING ADJOURNED AT 9 05 p m c( C c.
