HomeMy WebLinkAbout05/30/1978 CITY COUNCIL MINUTES CITY OF WHEAT RIDGE, COLORADO May 30, 1978 The Four Hundred and Tenth Regular meeting of the Wheat Ridge City Council was called to order by Mayor Oliver V Phillips at 6 30 pm, May 30, 1978, 4355 Field Street Council Members present were Mary Jo Cavarra, Joseph M Donaldson, Anthony N FIasco, Gary L Lewman, Ray C Pepe (who arrived at 6 55 pm), and Louise F Turner Also present were City Clerk Carol F Hampf, City Administrator John A Jerman, City Attor- ney Edmund G Lambert, Assistant City Attorney Charles Owens, Department Heads Richard H Bredt, Douglas Hilyard, Chief Ed Pinson, Charles Stromberg, staff, and interested citizens Item 1 Presentation of Schematic Design Report for Municipal Swimming Pool Complex Richard Dart of Camp Dresser & McKee presented the Schematic Design Report dated May 11, 1978, for the Municipal Swimming Pool Complex, and said that as a result of this evening's discussion he would like approval of the report so as to be able to proceed with the next phase Motion by Councilmember Cavarra "I move that the City Coun- cil approve the Schematic Design submitted on May 11 with the understand- ing that the various alternatives specified by (1) The Swimming Pool Advisory Committee re (a) relocation of tot pool to the east side of the pool, (b) alteration of the dimensions of the pool to accommodate a modified 'L', (c) sound wall vs land barrier, and (d) noise protec- tion on the southern side, and (2) Concerns specified by Council re (a) the link between the bathhouse and the Anderson Building be studied as to distance, (b) that encroachment upon the remainder of the Park be kept to a minimum, and (c) the placement of the bathhouse be immed- iately west of the link, will be explored during the second phase of design", seconded by Councilmember Donaldson, carried 6-0 Mr Dart also explained that Camp Dresser & McKee had been exploring the possibility of a "solar demonstration grant", and thought there was a good possibility of this being awarded to the City for the pool structure If solar panels are to be installed on the roof, the previ- ously recommended "off-the-shelf" covering could not be used, and a custom-covering would be required A custom-covering stressed for solar panels would, at this time, involve unknown foundation requirements Motion by Councilmember Cavarra 11 I move that the requirement of the foundation to be designed for future cover- ing be removed at this time because of the possibility of the solar grant and the uncertainty as to the nature of the covering", seconded by Councilmember Pepe, carried 4-2, with Councilmembers FIasco and Turner voting no Councilmember FIasco said he would vote against the motion because he felt it would raise the cost and would spread out the pool structure, using up more of the Park space, and putting in the foundation later would disrupt the pool THE REGULAR SESSION ADJOURNED TO THE STUDY SESSION Item 1 Review of Proposed Ordinances providing for establishment of various Munici- pal Boards and Commissions in accordance with the authority and guidelines as set forth by the individual Commissions and as established in the City Charter and Colorado Statutes - Mr Lambert stated that the ordinances were designed to be incorporated into Section 2 of the Code of Laws in sequence No policy decisions had been made at the attor- ney's office, and matters of a local nature may be governed by the Charter, but if a State nature, State Statutes take precedence General Council consensus re (1) Length of term of office of all Boards and Com- missions three years, with overlapping terms, and reappointment allowed Mr Lambert is to research if all current members must be allowed to fill out appointed term (2) Size of Boards and Commissions Five regular members and three alternates (A) Combined Civil Service and Personnel Commissions The combination of the two Commissions will not abolish the Civil Service system--only the Commissions are to be combined Mr Lambert is to research if the combining of the Civil Service Commission with the Personnel Commission is allowable under Home Rule Chief Pinson said that at this time he has no problem with the combination Wm Thornton, Vice- Chairman, Personnel Commission, stated that the five members with three alternates would be suitable Council suggestions included Delete section B, paragraph 7, section C, paragraph 3, and the first sentence of section C, paragraph 5; section C, paragraph 1, delete "the Mayor may appoint the alternate members" Items 1 (B) and 1 (C) were not discussed because of the possible combination of the Personnel and Civil Service Commissions as discussed in item (A) above (D) Ordinance re Parks and Recreation Commission Edgar Johnson, Parks & Recre- ation Commission, stated that he felt a commission of five regular and three . City Council Minutes May 30, 1978 Page -2- alternate members would be okay There were no suggested changes to the ordinance (E) Ordinance to establish Duties and Responsibilities of the Planning Commission Tom Woodford, representing the Wheat Ridge Fire Protection District, was concerned about section 3, paragraph (c) Capital improvements, that the wording to require the Fire District to take "all capital improvements to the planning commission" rather than buildings or large programs Ben Loye, representing the Wheat Ridge Water & Sanitation Distric$, expressed the same concerns for those entities Council sug- gestions included Section 3, paragraph (e), to delete the sentence, "The quasi- judicial hearing shall allow the applicant, the staff and the parties-in-interest to participate in the following types of testimony general testimony, cross exam- ination and rebuttal and summary", and the sentence, "The city council delegates to the planning commission the responsibility to hold the statutorily required public hearings on changes to zoning boundaries as required by C R S (1973) 31-23-304 and 31-23-305" Section 3, paragraph (c), clarify and define "capital improvements" Section 3, paragraph (k), needs a title, Mr Lambert to research the applicability of Colorado Statutes to Home Rule Cities, and add "notwithstanding Charter provi- sions, if any", to the final sentence Bonnie Scoma said there would be a report from the Planning Commission by Mondav morning (June 5, 1978) (F) Ordinance to establish the Board of Adjustment Ben Chastain stated the five- member and three alternate members would be okay He wondered why section 2-19 re Officers had been deleted, and that no alternates had been provided for in the ordinance Council suggestions included Section 1, paragraph (b), delete the second sentence "no more than two of the members "Section 2, paragraph (a), delete, subject to the attorney's research regarding applicability Amend previous Code rather than completely restate the duties Section 2, paragraph (g), if this should be Planning Commission duty; Mr Lambert to check Board of Adjustment duties in regard to the Flood Plain Ordinance (No 108), and possibility of setting stand- ards of variance Section 4, paragraph Sec 2-31, change the word "may" to the "board shall adopt bylaws " The City Attorney is to research the proposal re Appeal from the Board of Adjustment shall be to City Council rather than to the Dis- trict Court (G) Ordinance to establish duties and responsibilities of the Animal Control Commission With reference to Section 6, it was suggested the addition of "other exotic, unusual 9->-", _ or dangerous animals", however, it was explained that these are covered under State r~ 1..- Statutes, and thus not necessary in the City's ordinance tt( v~ cL 0/1/- (H) Ordinance establishing Duties and Responsibilities of Building Code Advisory Board It was suggested that this become more of an advisory board to the Council rather than the board granting a variance Mr Stromberg explained they do need to grant the variances because it is a completely different function from the Board of Adjustment, that they grant variances in building materials .- (I) Ordinance to establish Duties and Responsibilities of the Arborist Board Suggestions That the words "tree warden" be changed to "City Arborist" wherever it appears in the ordinance, and that the sections that cover "arborist duties" rather than "commission duties" be deleted from the ordinance and retained in the proper section in the Code General Council Consensus That these ordinances should be consolidated into one ordinance, with common requirements listed at the beginning under a general section, followed by the duties and responsibilities of each Commission or Board ANNOUNCEMENTS BY THE CITY ADMINISTRATOR June 20th, Governor Lamm and his cabinet will be at the Village Inn (4700 Kipling) Copy of the Police/Community Development Building appraisal by Baughar & Associates is available in the offices of the City Clerk and City Administrator That the City had been offered the opportunity to purchase five shares of water stock from the Collier property on Wadsworth, and asked consensus if the City were interested answer, yes Further, since the prop- erty is for sale, the City might consider purchasing a portion of the rear for traffic circulation purposes in the shopping center area Councilmember Turner reminded the Council of the Open Space meeting to be held May 31, Wednesday, re desires of Cities as to being allowed to spend Open Space funds for development and/or acquisition Council consensus indicated (1) three desired funds be first used for acquisition, and (2) three felt a portion should be allocated for use as the individual Cities desire STUDY SESSION ADJOURNED AT 11 30 p m ~;~ dlia~~ CAROL F HA..I1PF, CITY CLERK cfh pjk APPROVED cJ-J
