A RESOLUTION RESCINDING RESOLUTION #34-2000. A RESOLUTION
AUTHORIZING JEFFERSON COUNTY OPEN SPACE TO CONTINUE GOOD
FAITH NEGOTIATIONS AND TO ACQUIRE THE 5 ACRES OF LAND,
MORE OR LESS, LOCATED AT 4100 MILLER STREET (ZARLENGO
PROPERTY) AT THE NEGOTIATED PRICE FOR PARKS AND
RECREATION PURPOSES.
The CIty of Wheat RIdge has approved a Resolution authonzmg Jefferson County Open
Space to complete an AppraIsal, EnVlronmental Assessment. Survey, and negotiate the faIT
market value of the 5 acres of property located at 41 00 Miller Street (Zarlengo Property);
and
Jefferson County has completed the Appraisal, Envu'onmenta1 Assessment, Survey and
negotiated the fall' market value; and
The appraised value has been commumcated WIth the CIty Council, and
The negotIated fair market value is $468,000 00; and
The Appraisal and EnVIronmental Assessment costs $3,975 00
NOW THEREFORE BE IT RESOLVED BY THE WHEAT RIDGE CITY COUNCIL THAT
I) JEFFERSON COUNTY OPEN SPACE BE AUTHORIZED TO CONTINUE GOOD
FAITH NEGOTIATIONS AND TO ACQUIRE THE 5 ACRES OF LAND, MORE OR
LESS, LOCATED AT 4100 MILLER STREET AT THE NEGOTIATED FAIR
MARKET VALUE.
2) THE ZARLENGO PROPERTY, LOCATED AT 4100 MILLER STREET IS A HIGH
PRIORITY ACQUISITION FOR PARK LAND AND THE FUTURE USES WILL BE
NATURAL OPEN SPACE.
3) THE COST OF THE ACQUISITION INCLUDING LAND COST, APPRAISAL,
ENVIRONMENTAL ASSESSMENT, AND CLOSING COSTS WILL BE PAID FROM
THE CLEAR CREEK LEGACY GRANT AWARDED TO JEFFERSON COUNTY
OPEN SPACE AND THE BALANCE PAID BY JEFFERSON COUNTY OPEN SPACE
BOND FUND WITH THE CITY OF WHEA T RIDGE MATCH REQUIREMENT OF
25'Yo MET THROUGH 1998 ACQUISITION EXPENDITURES.
4) THE MAYOR AND CITY CLERK BE AUTHORIZED TO SIGN THE
ENVIRONMENTAL lNDEMNIFICA TION AGREEMENT,

In 1999 the Zarlengo Property was IdentifIed by ResolutIOn as a hIgh pnonty acql11sltlon
for the CIty of Wheat RIdge
ThIs five acre pIece of property IS located at approXImately 41" and Miller St. It IS
surrounded by City of Wheat RIdge Open Space on three contIguous SIdes, east, west and north,
The fourth and south SIde IS bordered by reSIdences. The property acql11sltIon pnonty IS hIgh
because the acqUIsItIon mamtains the mtent of the Open Space area It is contIguous to CIty of
Wheat RIdge open space and provIdes a buffer to the Clear Creek cOrrIdor (Sec attached map)
A Legacy grant was secured from Great Outdoors Colorado through Jefferson County
Open Space whIch was entItled the Clear Creek Legacy Grant. The Legacy Grants are large
grants that mc1ude cooperatIon between several entItIes, The Clear Creek Legacy grant was
deSIgnated for propertIes up and down Clear Creek m Jefferson County
Jefferson County has been negotlatmg wIth the owner smce 1999 The owner appeared to
verbally agree to the origma1 pnce lIsted m ResolutIOn 34-2000, but then faIled to rcturn contact
InItIated by the County The original price agreed to by the owner was below the appraised
pnce,
Contact has recently been successful and the owner has agam agreed to sell the propcrty.
The new Resolution rescmds ResolutIOn 34-2000 and authonzes the new pnce lIsted. ThIS new
pnce IS stIll below the 1999 appraIsed pnce,
Jefferson County Open Space and the appraIser feel the new pnce IS JustIfiable based on
the ongmal appraIsal and the amount of tIme that has passed Slllce the first pnce offer

1) JEFFERSON COUNTY OPEN SPACE BE AUTHORIZED TO CONTINUE GOOD
FAITH NEGOTIATIONS AND TO ACQUIRE THE 5 ACRES OF LAND, MORE OR
LESS, LOCATED AT 4100 MILLER STREET AT THE NEGOTIATED FAIR
MARKET VALUE.
2) THE ZARLENGO PROPERTY , LOCATED AT 4100 MILLER STREET IS A HIGH
PRIORITY ACQUISITION FOR PARKLAND AND THE FUTURE USES WILL BE
NATURAL OPEN SPACE,
3) THE COST OF THE ACQUISITION INCLUDING LAND COST, APPRAISAL,
ENVIRONMENTAL ASSESSMENT, AND CLOSING COSTS WILL BE SPLIT 75%
FROM THE CITY OF WHEAT RIDGE SHARE OF THE JEFFERSON COUNTY
OPEN SPACE BOND FUND AND 25% FROM CITY OF WHEAT RIDGE FUNDS
WITH ALL COSTS CHARGED TO ACCOUNT 32-601-809.
4) THE MAYOR AND CITY CLERK BE AUTHORIZED TO SIGN THE
ENVIRONMENTAL INDEMNIFICATION AGREEMENT.

WHEREAS

The City Council desires to establish a priority list for the acquisition of open
space and park land properties in Wheat Ridge, and
The Parks and Recreation Commission has completed an evaluation of the
existing list of open space and park land properties and has recommended a
priority list for the acquisition of open space and park land properties in Wheat
Ridge, and
This list of properties will be used to communicate to the Jefferson County
Open Space Department and the Citizens of Wheat Ridge the priority open
space and park land properties desired for acquisition, and
WHEREAS
NOW THEREFORE BE IT RESOLVED BY THE CITY OF WHEAT RIDGE CITY COUNCIL THAT'
1) The priority list of open space and park land properties for acquisition be approved
