HomeMy WebLinkAboutResolution-2003-0005 TITLE: Whereas, Whereas, Whereas, Whereas, RESOLUTION # 05-2003 SERIES OF 2003 A RESOLUTION AUTHORIZING JEFFERSON COUNTY OPEN SPACE TO CONTINUE GOOD FAITH NEGOTIATIONS AND TO ACQUIRE THE 0.496 ACRES OF LAND, MORE OR LESS, LOCA TED AT WEST 44th A VENUE AT LAMAR STREET (BRAUER PROPERTY) AT THE NEGOTIATED PRICE FOR PARKS AND RECREATION PURPOSES. The CIty of Wheat RIdge has approved a Resolution authorizing Jefferson County Open Space to complete an Appraisal, Environmental Assessment, Survey, and negotiate the faIr market value of the 0.496 acres of property located at West 44th Avenue and Lamar Street (Brauer Property); and Jefferson County has completed the AppraIsal, EnVIronmental Assessment, Survey and negotiated the fair market value; and The appraised value has been communIcated WIth the City Council; and The negotiated faIr market value is $92,000 00; and NOW THEREFORE BE IT RESOLVED BY THE WHEATRIDGEClTY COUNCIL THAT l) JEFFERSON COUNTY OPEN SPACE BE AUTHORIZED TO CONTINUE GOOD FAITH NEGOTIA TIONS AND TO ACQUIRE THE 0.496 ACRES OF LAND, MORE OR LESS, LOCATED AT WEST 44'1'11 AVENUE AT LAMAR STREET AT THE NEGOTIATED FAIR MARKET VALUE. 2) THE BRAUER PROPERTY, LOCATED AT WEST 44th AVENUE AT LAMAR STREET IS A HIGH PRIORITY ACQUISITION FOR PARK LAND AND THE FUTURE USES WILL BE FOR PARK AND RECREATION PURPOSES 3) THE COST OF THE ACQUISITION INCLUDING LAND COST, APPRAISAL, ENVIRONMENTAL ASSESSMENT, AND CLOSING COSTS WILL BE PAID FROM THE JEFFERSON COUNTY BOND FUNDS WITH THE CITY OF WHEAT RIDGE MATCH REQUIREMENT OF 25% MET THROUGH 1998 ACQUISITION EXPENDITURES. 4) THE MAYOR AND CITY CLERK BE AUTHORIZED TO SIGN THE ENVIRONMENTAL INDEMNIFICATION AGREEMENT.
