called the Four Hundred Thirty- second Regular Meeting of the City Council to order Council Members present Mary Jo Cavarra, Joseph M Donaldson, Anthony N Flasco, Gary L Lewman, Ray C Pepe, and Louise F Turner Also present were City Clerk Carol F Hampf, City Administrator John A Jerman, City Attorney Edmund G Lambert, City Treasurer James 0 Malone, Department Heads Richard H Bredt, Douglas W Hilyard, Clyde E Hobbs, Charles Stromberg, Chief Ed Pinson, staff, interested citizens Approval of Minutes MOTION by CM Donaldson "I move for the approval of the minutes of the meetings of November 6th and 13th, 1978, with an amendment to Novem- ber 13th on page 3, under Council Members' Matters, the first sen- tence should read 'Councilmember Turner requested that the Jefferson County Housing Authority be asked to clean up the Hook School prop- erty, and asked if they wanted to reconsider the proposed removal of structures in view of restrictions relative to new construction in the Flood Plain"', motion carried 6-0 Public Comment Jim Shakelford, 3240 Moore St , stated that he was representing the Clarks who live at 32nd & Moore He spoke regarding the 32nd Ave pedestrian/bike pathway The Clarks have found that the stakes placed by the Colorado Department of Highways now curve into their yard where there is a sprinkler system installed In other areas, the pathway is apparently straight, and they are concerned about the curve and wondered why there had been a change in the design Mr Hobbs was requested to find out why the plans had been changed from the ones submitted by Mr Troxel and approved by City Council Public Hearings Item 1 Consideration and Decision re Apportionment of the City into four Council Districts pursuant to Sec 17 3 of the City Charter Genie Merkle spoke, commending the Council and Mr Flasco, for the good redis- tricting jOb An alternate proposal had been presented to Community Development Department by CM Turner Discussion involved the numbers of people as well as the acreage involved in the two proposals MOTION by CM Cavarra "I move that the Council direct the staff to prepare an ordinance for the agenda of December 11th, describing the redistricting as outlined by the Fl asco proposa 1", seconded by CM Pepe, carried 6-0 Item 2 Application of Ray Valente for approval of a Dumping Permit for property at approximately the northeast corner of W 35th & Wadsworth (DP-78-03) Mr Stromberg stated that he had recently received a request for a Dumping Permit and had prepared the case as quickly as possible for presentation to the Planning Commission and City Council A drainage study that is necessary has not been com- pleted as yet Planning Commission had approved the Permit subject to the engi- neering drainage study Bill Myers, 7535 W 35th Ave, spoke requesting that the drainage plan be done, and was concerned that the water might drain to the east Ray Valente, the applicant and owner of the property, stated that he would like to have the matter settled this evening, that he had agreed to the drainage study and would pay for it, and that he had had an opportunity for some free dirt and did not realize a Dumping Permit and City Council hearing were required MOTION by CM Turner "I move we continue this case until a drainage study has been completed and take action at that time", seconded by U~ Cavarra, carried 5-1, with CM Pepe voting NO, stating that he felt it had Planning Commission approval, and the staff could take care of the drainage plan Ordinances on Second Reading and Public Hearings Item 3 Ordinance No 298 repealing and reenacting Art IV of Chap 2 of Code, Establishing Certain Boards and Commissions MOTION by CM Lewman "I move to defer action on Ordinance No 298 until the December 11th meeting as requested by the City Attorney", seconded by CM Cavarra, carried 6-0 Request was made for an addition to the ordinance, ie, that legal notices be published concerning cases to be heard by the Board of Adjustment CITY COUNCIL MINUTES November 20, 1978 Page -2- Item 4 Ordinance No 280 amending See 9 3, Art II, Environmental Control Introduced on second reading by CM Turner, title read by the Clerk MOTION by CM Turner "I move that Ordinance No 280 be approved on second read- ing, .subject to one amendment in the fourth line of the paragraph, that is the body of the ordinance, to say 'bridges or culverts for bri dge purposes properly des i gned I, etc \I, seconded by eM Donaldson, carried 6-0 Item 5 Ordinance No 300 providing for adoption of Six Quarter Section Zoning Maps as the Official Zoning Maps of the City MOTION by CM Donaldson "I move that Ordi nance No 300 be adopted on second reading and ordered published", seconded by CM Cavarra MOTION by CM Cavarra "I move that Ordinance No 300 be amended as follows 1 The following phrase be inserted as noted on attached sheet 'all bearing the designation "Official Zoning Map 1978-9 Update", and' 2 The attached maps of the City which indexes the quarter section maps being adopted be incorporated as part of Ordinance 300 3 That the letters identifying the maps, small (a) - (f) be changed to the capital letters A - F to correspond to the index letters on the attached map", seconded by CM Donaldson, carried 6-0 Concerns about the zoning map procedure were discussed MOTION by CM Cavarra "I move that a sample map be brought to Council study session December 4th showing (1) the subdivision names and other plats written onto the map, (2) lines that divide zoning categories be drawn thicker, (3) large tracts and tracts that include more than one zoning class be identi- fied by legal description or dimensions, (4) the City limits be more definitely outlined I further move this Public Hearing be con- tinued to December 18th", seconded by CM Flasco, carried 6-0 Further re- quests were for maps shown in the scale of 1 100 and 1 200 and maps showing sym- bols Ordinances on First Reading Item 6 Ordinance amending Chap 15, Art II, Sec 5(k) of the Code re Park/Recreational Facility Hours Introduced by CM Cavarra, numbered 303 and title read by Clerk MOTION by CM Cavarra "I move that Ordinance 303 be adopted on first reading, ordered published, that a Public Hearing be set for Monday, December 18, 1978, at 7 30 pm, in City Council Chambers, at 7500 W 29th Ave, Municipal Building, Wheat Ridge, Colorado, and that the Ordi- nance, if approved on second reading, take effect 15 days after final publ ication", seconded by CM Donaldson, carried 5-0 (Councilmember Turner had left the meeting due to illness ) Item 7 Ordinance amendin Section 18-40, Contribution -- Limit on Cit Police Pension Fund, of the Code of the City Introduced by CM Lewman, numbered 304, with title read by Clerk MOTION by CM Lewman "I move that Ordinance No 304 be adopted on first reading and ordered published, that a Public Hearing be set for Monday, December 18, 1978, at 7 30 pm, in City Council Chambers at 7500 W 29th Ave, Municipal Building, Wheat Ridge, Colorado, and that the Ordinance, if approved on second reading, take effect January 1,1979", seconded by CM Cavarra, carried 5-0 Decisions, Resolutions, and Motions Item 8 Joint Recommendations of Civil Service Commission and Personnel Com- mission concerning Public Administrative Services Employee Classification and Salary Study Mr Hilyard stated the Personnel and Civil Service Commissions had met Thursday, November 16th, and their recommendations had been distributed to Council on Fri- day He went over the report of Classification and Salary Plan structures and implementation Discussion regarding the tenure adjustment Chief Pinson was asked to comment on this phase and told Council he believed that a new employee was not as valuable as an employee that had been on board for some time, and there is considerable cost in training new employees Ann Kampf, Park Ranger, new classification of Park Ranger-Naturalist I, said she felt there were inequi- ties, and that her position was classified too low, considering the fact that a college degree is required Neil Lewis, Park Ranger-Naturalist II, agreed, and felt that since he had considerable supervision in the summer time, he, too, was classified too low Council commented that there had been discussion that during the summer, when he has extra people to supervise, perhaps there should be an adjustment Mr Bredt said that since some members of the Parks Department CITY COUNCIL MINUTES November 20, 1978 Page -3- had been reclassified to a lower classification, some employees would be getting a pay cut Mr Hobbs requested that Council adopt the Commissions' recommendations MOTION by CM Cavarra "I move that we instruct the staff to prepare a re- vised pay ordinance to be placed on the December 4th agenda, that we ask staff and Mr Woods to consider the recommendations outlined by the Personnel and Civil Service Commissions, to consider the recommen- dations regarding the four positions listed under salary pay structure, and the two positions, Park Ranger Naturalist I and II; that Plan B be implemented; that the tenure adjustment be computed at one percent increments for each twenty-four months of service", seconded by CM Lewman Discussion that the tenure provision be separated from the main motion for vote Tenure adjustment portion of the motion failed 1-4, with CM Flasco, Donaldson, Pepe, and Lewman voting NO Other parts of the motion failed 2-3, with CM Flasco, Donaldson, and Pepe voting NO CM Flasco stated he was voting NO he agreed that the study had been well done, but felt with this pay plan we would be the highest paid of our neighbor cities, not in conformity with our neighbors CM Donaldson stated there was too much of an increase MOTION by CM Flasco "I move that all City employees be given a five percent raise, and that additional study be made", seconded by CM Donaldson, carried 3-2, with CM Cavarra and Lewman voting NO AMENDED MOTION "I move that the Personnel Commission, Civil Service Commission, Council Members, employees, and citizens be contacted for input) and that Public Hearings be held for additional work~and come back to City Council with as much haste as possible with recommendations; taking into account the six posi- tions enumerated this evening; and any input they may get from Mr Woods", original motion by CM Lewman, seconded by CM Cavarra, amending motion by CM Flasco, seconded by CM Donaldson, both carried 5-0 Item 9 Application for Renewal of Class G Hotel & Restaurant License for Ramada Inn 1-70 West, 10101 1-70 Service Road North Mr Burns of the Ramada Inn was present for Council questioning He was asked what is being done to decrease the amount of policing required at this licensed establishment Mr Burns stated that Security Guards have been hired, and explained that they are open seven nights a week, have 10,000 customers weekly, and felt that their percentage was not too bad MOTION by CM Pepe "I move to approve the renewal of the Class G - Hotel and Restaurant Liquor License for Ramada Inn 1-70 West, located at 10101 1-70 Service Road North, in Wheat Ridge, Colorado, for the year ending December 14, 1979", sec- onded by CM Donaldson, carried 5-0 Item 10 Application for Renewal of Class T - Tavern Liquor License for MTL Enter- prises Inc dba Rockette Bar, 10006 W 44th Ave Mr Lewis of the Rockette Bar was present He was asked what was being done to decrease the problems He stated that he has now male bartenders at night who seem to be able to keep better control over the situation MOTION by CM Pepe "I move for the renewal of the Class T - Tavern Liquor License with extended hours for MTL Enterprises, Inc , dba Rockette Bar, 10006 W 44th Ave, for the year ending December 29, 1979", seconded by CM Cavarra, carried 5-0 Item 11 Approval to hire four new Police Officers on December 29, 1978 in order to take advantage of Police Pension Contribution from State MOTION by CM Cavarra "I move that the City Council approve the hiring of four additional Police Officers, as approved in the 1979 Budget, to take effect December 29, 1978", seconded by CM Flasco, carried 4-1, with CM Pepe voting NO Item~ Approval of final payment to Interplan, Inc for design layout and spe- cification development, $990, Account No 31-504-811 MOTION by CM Lewman "I move that a final payment in the amount of $990, charged to account #31-504-811, be approved to Interplan, Inc for open office furnishings design layout and specification development at the Wheat Ridge Municipal Building", seconded by eM Donaldson, carried 5-0 Item 13 Resolution authorizing Agreement between City and Colorado Department of Highways for construction of frontage road at W 48th Ave and Otis St Resolution introduced by CM Lewman, numbered 619 and title read by the Clerk MOTION by CM Lewman "I move that Resolution No 619 be adopted", sec- onded by CM Flasco, carried 5-0 CITY COUNCIL MINUTES November 20, 1978 Page -4- Item 14 Resolution authorizing establishment of Permanent Emergency Fund Introduced by CM Lewman, numbered 620 by the Clerk and title read MOTION by CM Lewman "I move for the adoption of Resolution No 620", seconded by CM Flasco, carried 5-0 Item 15 Budget Transfer Resolution - Provide funds to purchase pump for removal of flood waters Introduced by CM Flasco, numbered 621 and title read by Clerk MOTION by CM Flasco "I move that Resolution No 621 be adopted, this is single source item", seconded by CM Donaldson, carried 4-1, with CM Cavarra voting NO, stating she feels this is an unnecessary expenditure Item 16 Award of bid for Sand and Salt mix MOTION by CM Lewman "I move that the lowest and best bid for Salt and Sand Mix be awarded to Albert Frei and Sons at a cost of $3 05 per ton if materials are picked up by the City or $4 50 per ton if materials are delivered to the Pub- lic Works yard by the vendor, as determined by the City Purchases of this material are to be charged to Account No 01-303-660", sec- onded by CM Flasco, carried 5-0 Item 17 Applications for renewal of Liquor/Beer Licenses MOTION by CM Cavarra "I move the following applications for liquor/beer licenses be approved (a) Class E - Drug Store Liquor License of T H Hark- ness, Jr , dba Paramount Pharmac , 10041 W 26th Ave, (b) Class F - Beer and Wine License Hotel, Restaurant of Los Panchos, Inc , 6351 W 44th Ave, (c) Class G - Hotel and Restaurant Liquor License of Gasthaus Rid eview, Inc , 4465 Garrison St, (d) Class J - 3 2% Beer Retail Licenses for 1 Safeway Stores, Inc , 302, 10050 W 38th Ave, (2) Eugene W Cookenboo dba Kipling Self-Service, 4075 Kipling St " seconded by CM Flasco, carried 5-0 Mayor's Matters Mayor Phillips informed Council that a member of the Mass Transit Committee, Mr Barton, had died of a heart attack Mr Jerman said that flowers had been sent to the house City Administrator's Matters Item 18 Report of Municipal Building Expenditures as of October 31, 1978-- Capital Construction Report Mr Jerman explained the accounting of the Capital Construction Report for the City of Wheat Ridge Municipal Building and showed that there is $16,770 36 that is not committed at this time The suggestion was to carry the money over for expenditure during 1979 Item 19 Add Account No 01-607-793 to motion adopted November 13, 1978 approving final payment to Lillard & Clark Construction Co , Inc MOTION by CM Cavarra "I move that the Account 01-607-793 be added to the motion passed on November 13, 1978, approving the final payment of Lillard & Clark Construction Company, Inc ", seconded by CM Donaldson, carried 5-0 Council Members' Matters Item 20 Suggested Annexation Criteria to Examine MOTION by CM Lewman "I move that the suggested annexation criteria be reviewed and eval- uated by staff and Planning Commission, and returned to City Council on or before January 22, 1979", seconded by CM Cavarra, carried 5-0 Item 21 Examination of Values Relating to Existing Special Service Districts It was requested that this matter be brought to the December 4th Study Session for discussion Item 22 Cancellation of Council meetings MOTION by CM Cavarra "I move that the meetings of December 25, 1978, and January 1, 1979, be cancelled", seconded by CM Donaldson, carried 5-0 It was requested that a copy of the City Administrators contract be included as Information in the December 4th packet Council Committees' and Commissions' Matters Item 23 Resignation of Ray Sweeney as member of Police Advisory Committee It was suggested that the press give us some publicity re vacancy on the Police Advisory Committee, and the Clerk prepare a press release The Clerk brought to Council that three other Commission members' terms are expiring before the new Boards and Commissions Ordinance will be effective MOTION by CM Cavarra "I move that all expiring appointments be temporarily extended until
