Mayor Phillips convened the meeting of the City Council at 7 35 p m~ February
12, 1979 Council Members present Mary Jo Cavarra, Joseph M Donaldson,
Anthony N Flasco, Gary L Lewman, Ray C Pepe, and Louise F Turner .Also
present City Clerk Carol F Hampf, City Treasurer James 0 Malone, C1ty
Administrator John A Jerman, City Attorney Edmund G Lambert, Department
Heads Richard H Bredt, Clyde E Hobbs, Douglas W Hilyard, Chief Ed Pinson,
and Charles Stromberg, staff, and interested citizens
No one appeared to speak under Public Comment
Approval of Minutes
AMENDED MOTION "I move for the adopti on of the Mi nutes of the
meetings of January 29, 1979, as continued from January 22 and
January 29, and February 5, 1979, with the following amendment
to Item 2 of the February 5th Agenda, that it read 'recommendations
on a least cost basis'" Original motion by Mr Donaldson, seconded
by Mrs Cavarra, amendment by Mrs Cavarra, seconded by Mrs Turner, both
motions carried 6-0

at the same hour", seconded by Mr Donaldson, motion failed by 3-3, with

Ordinances on First Reading
Item 2 An Ordinance repealing Ordinance No 305, Series of 1978, providing for
new Classifications, Pay Ranges and Pay Grades for City Employees
effective April 1, 1979, and further providing fee and special con-
tractual rates
Speakers on the various salary surveys were George Holte, 4190 Carr St ,
Chairman of the Personnel Commission, who indicated that their recommendation
was for the ordinance reflecting the "Woods (PAS) Study", and Frank Cosolo,
4370 Dudley St , member of the Civil Service Commission, who stated that that
Commission had submitted a proposal and explained their method which had been
to take a "true average" of Mr Woods' figures rather than the "Quartile
method" used by Woods (in which the top and bottom quarters were not used)
The Council requested a statement on the Woods', staff, and Flasco proposals
methodologies Mr Hilyard reported that Mr Woods of the 70 positions had
received and used data on 52, on the remaining 18 where there was no data,
used his professional judgment He had averaged data from the two middle
quartile and disregarded the highest and lowest Mr Jerman reported that, on
the staff survey, that it was based on 17 key classes as taken from the PAS
(Woods) Study, and gave the procedure utilized from the report included with
the salary study Mr Flasco reported that he had taken an average of all of
the data from John Woods, including the minimum, maximum, and Wheat Ridge
Where there was no data, or Wheat Ridge data only, had used the Woods' study,
and found a like placement on the salary schedule The ordinance was introduced
by Mr Flasco, numbered 319, and the title read by the Clerk AMENDED MOTION
"I move that Ordinance No 319, as proposed by Councilmember Flasco,
be adopted on first reading and ordered published, that a Public
Hearing be set for Monday, February 26th at 7 30 p m in Council
Chambers at 7500 W 29th Ave, Municipal Building, Wheat Ridge,
Colorado, and that the Ordinance, if approved on second reading,
take effect on April 1, 1979, with the following amendments
(1) To include the Municipal Judge, Deputy Judge, and Bailiff
at their present pay rates, (2) That the Liquor or Beer Survey
be amended to read 'not to exceed $150 per case', and (3) That
the 'Accounting Technicians' be changed from Grade 9 to Grade 10"
Original Motion by Mr Flasco, seconded by Mr Pepe Amending motion re
'not to exceed $150 per case' by Mr Lewman, seconded by Mr Pepe, carried
6-0 Amending motion re 'Accounting Technicians' by Mrs Turner, seconded
by ~~, carried 4-2, with Mrs Cavarra and Mr Lewman voting NO

of Highways, indicating their willingness to go back to the original Path Plan
and the need for Wheat Ridge to establish the one right-of-way in question
MOTION by Mr Lewman "I move that the City accept the dedication of
12 feet of ROW for the installation of the pathway adjacent to
the street in front of Mr James H Brown property at 17701 W
32nd Ave, and that a suitable conduit pipe be installed under
the pathway under Colorado Department of Highways Project BWHHO
0006(11) at no direct expense to Mr Brown", seconded by Mrs Cavarra,
carried 6-0 Claudia Worth spoke regarding three children who had recently
been hit and stated That attached walks are dangerous, and that she is opposed
to the curb and gutter because of drainage problems Council discussion involved
That previous discussion had gone back to the attached form because there had
been so much community opposition, do not want to scrap the whole thing because
we do need a walkway, compromise of 4 feet of concrete and 4 feet of grass with
a curb and gutter, and that if we do not have an 8 foot walkway, we would
stand to lose the $90,000 Federal Grant, and that 4 feet is not wide enough
for both bicycles and pedestrians MOTION by Mr Lewman "I move that the
Colorado Department of Highways be requested to prepare a revised
engineers' estimate of the total project costs (BWHHO 0006(11)),
taking into account that a separated walkway is desired where it
is possible within the ROW, using accepted engineering practices,
and the Architects Engineers' plans west of Nelson St , subject
to final review and approval of such costs by the City before
competitive bidding is commenced", seconded by Mrs Turner Mr Lewman
further explained that he meant the walkway to be in a straight line near
to the edge and 30 feet in front of people's front door Motion died by
tie vote of 3-3, with Council Members Flasco, Donaldson and Pepe voting NO
Mr Flasco stated he could not vote in favor without seeing an engineer's
survey MOTION by Mrs Turner "I move that the Ci ty contract for a
walkway within the area specified by the State Highway Department
Plan, leaving the curb as they propose, cutting the pavement,
the concrete, to 4 feet, and placing 4 feet of grass between the

Gene Fortier, 8795 W Kentucky Ave, Lakewood, Director of Jefferson County
Housing Authority, explained the Section 8 program, which is a subsidy rental
program, using existing housing There has been an allocation of 175 units
with 45% of those going to Wheat Ridge citizens Fifty more have been applied
for, with perhaps 25 of those being for Wheat Ridge residents Council felt
this is an excellent housing program
Item 6 Approval of agreement with Francis and Gwendolyn VanDerbur (Olingers)
for certain street improvements in return for dedication of property
The proposed agreement between the City of Wheat Ridge and Francis & Gwendolyn
VanDerbur was read in full by the Clerk Discussion that previous decision
had been for no action to be taken at that time or until the signal at 29th
and Wadsworth was in operation IvlOTlON by Mrs Cavarra "I move that we
defer any action until 60 days after the installation of the signal,
and that Olinger Mortuaries, VanDerburs, be so notified", seconded

Mrs Cavarra explained a proposed revision of Rule 66 to restrict testimony
to a reasonable period of time AMENDED MOTION "I move we adopt the
amendment to Council Rules and Regulations with this addition
This addition would be the second to last paragraph 'It is under-
stood that time utilized by staff to present the case, to respond
to questions from the Council, and to cross-examine and summarize,
if necessary, will not be counted against the time alloted to either
the applicant or the opposition' This rule (time limitations) will
apply to zoning and subdivision cases, liquor licenses, and Board

The City Attorney requested an Executive Session next meeting regarding two
litigation matters
Council Members' Matters
Mr Pepe stated that Chief Willis of the Fire District indicated he needs
two cars, one for the Assistant Fire Chief at each station, and requested
two of our old Police cars Possibility of Fire District purchasing these
at a reasonable fee was discussed
Mr Lewman called attention to a letter from DRCOG showing the attendance
records of various Committee representatives He requested the item be
placed on the February 26th agenda for Council suggestions of alternate
people to represent Wheat Ridge on these Committees
