CITY OF WHEAT RIDGE, COLORADO
June 11, 1979
The June 11, 1979 Regular City Council Meeting was convened by Mayor Phillips
at 7 35 P m Council Members present Joseph M Donaldson, Anthony N Flasco,
Gary Lewman, Louise F Turner and Ray C Pepe Also present City Clerk Carol
F Hampf, City Administrator John A Jerman, City Attorney Edmund G Lambert,
Department Heads Douglas Hilyard, Charles Stromberg, Clyde Hobbs, staff, and
interested citizens Mary Jo Cavarra arrived at 7 40 P m
Approval of Minutes
MOTION by Mr Donaldson "I move that the minutes of June 4,1979 be
approved as pri nted", seconded by Mrs Turner, carried 6-0
Public Comment
No one was present for Public Comment
Proclamation
Proclamation declaring FLAG DAY - INDEPENDENCE DAY, 1979, June 14 - July 4,
1979 was read by Mayor Phillips
MOTION by Mr Donaldson (referring to memo from Clyde Hobbs, Director of Public
Works asking for an executive session re personnel matters) "I move that
we have this executive session when we have an intermission which
usually fall s about 9 pm", seconded by Mrs Turner, carried 6-0
Item 1 Resolution pursuant to request of Wheat Ridge Historical Society to
reprint booklet copyrighted by the City of Wheat Ridge in 1971
Resolution was introduced by Mrs Turner, title read by the clerk MOTION by
~1rs Turner "I move that this Resolution (No 650) be approved",
seconded by Mr Flasco
Naomi K Olson, 3335 Marshall Street, Wheat Ridge, told Council that all copies
have been sold and the Historical Society would like Council's approval to re-
pri nt the ccpyri g hted materi a 1 $500 has been gi ven to the Hi s tori ca 1 Soci ety
in memory of Joy Clapp by her sister June which will be used to reprint this
booklet Carried 6-0
Public Hearings
l!em 2 Pre-budget Public Hearing re 1980 Budget to receive citizen
comments, suggestions, and requests
Phyllis Kramer, 2715 Fenton Street, Wheat Ridge, suggested that (1) Wheat
Ridge return Revenue Sharing monies to the government and refuse other grants,
and request the Federal Government to lower income taxes or use Revenue
Sharing and other funds to eliminate food sales tax on groceries and restau-
rant food especially for senior citizens as well as assist seniors with
housing problems (2) That Council be concerned with drainage and some
examples listed were 29th from Garrison to Harlan, 29th-Jay to Kendall
33rd & Harlan, 35th-Harlan east, and 38th & 44th east of Wadsworth (3)
That we do not need to buy any more land, fire houses, community centers,
or autos (4) Resolve that the open space tax be rescinded or turned over
to the RTD for busses through the area (5) That Council take a look at the
dollar costs of employee turnover
Peter Rex, 3388 Swadley, member of Lena Gulch Homeowners Association, asked
for an increase in funds for Lena Gulch At present, completion is not ex-
pected for 10 years and urged additional expenditure before a serious flood
could cost lives
Irene Gimeno, 5070 Garrison Street, requested a walkway-bikepath on the
west side of Garrison from 51st to 49th or further because Garrison is a
narrow street with soft shoulders and is dangerous
Karen Watson, 3390 Garrison, requested that the City of Wheat Ridge take
over the administration of the school crossing guards instead of it being
handled by the Parent Teacher Volunteer Organization

Renewal of Class G Hotel and Restaurant Liquor License for Village
Inn Pancake House, Inc , Clyde's Pub, located at 4700 Kipling
Street, Wheat Ridge, Colorado
Charles R Frederickson, Vice President of Village Inn Pancake House, Inc ,
stated that Gerald Cohen is the General Manager and Clyde Babb is the Lounge
Manager Mr Cohen is responsible for the management of the entire liquor
areas Council and the City Attorney were concerned about the management
arrangement, the management agreements with Mr Babb and Mr Cohen, and a gun
incident in the lounge
MOTION by Mr Pepe that This license, Village Inn Pancake House,
Inc , not be renewed until the proper management agreement be
presented to thi s counci 1 and wi th the State's approval Seconded
by Mr Flasco, carried 5-1 Mrs Cavarra voting NO
Item 4
Ordinance No 330, Providing for the approval of rezoning from
Residential-Three (R-3) to Commercial-One (C-l) for land located
at 3829 Sheridan, (George Holley Associates, Wood Brothers Homes,
Inc ) City of Wheat Ridge, County of Jefferson, State of Colorado
(Case No WZ-78-117)
Mr Pepe introduced the ordinance on second reading and the clerk read the
title Mr Gidley gave the staff report and entered the necessary documents
into evidence George Holley, 13949 West Colfax, Golden, represented the
applicants Council were concerned that this is commercial zoning with
residential neighbors, and that it conflicts with the Comprehensive Plan
designation of low density There was on one in opposition MOTION by
Mr Pepe "I move tha t Ordi nance No 330 be adopted on Second
Reading for the following reasons (1) Requirements for pub-
lishing, posting and notification have been met, (2) Planning
Commission recommended approval of this application at its
January 18, 1979 meeting, (3) The property is adjacent to C-l
zoning on the west, (4) This property being located on Sheridan
Blvd and near 38th Ave is adversely affected for residential
purpose by traffic noise and movement, (5) No one appeared at
the Planning Commission or the Council meeting in opposition"
Motion died for lack of a second
MOTION by Mrs Cavarra "I move that we continue the decision for
one week and allow applicant to amend his application to a
Planned Commercial Development If applicant chooses not to
do so, a decision will be rendered next week", seconded by
Mr Flasco, carried 4-2, with Mr Donaldson and Mrs Turner voting NO
Mrs Turner stating that this is shown as low density residential (Yellow)
on the comprehensive plan and would expand the commercial area

Ordinance No 332, Providing for the approval from Commercial-
One and Residential-Three (R-3) to Restricted Commercial-One
(RC-l) for land located at 3767 Harlan, (Ray Valente) City of
Wheat Ridge, County of Jefferson, State of Colorado (Case
No WZ-79-2)
Ordinance was introduced on second reading by Mrs Cavarra, title read by
the clerk Mr Gidley gave the staff report, entered the records into
evidence, and indicated that the billboard currently on the property would
be removed
Ray Valente, 3715 Harlan, applicant and also has a contract to purchase
the property, stated that he plans to build an office building on the
property
Oscar Livingston, present owner, was also present
Gene Snyder, 3720 Harlan, Leona Treloar, 3740 Harlan, Ron Webber, 5985 W
37th Place, and Dorothy Webber, 5985 W 37th Place, also spoke-rn favor of
the zoning change---There was--no one in opposition

MOTION by Mr Pepe that Ordinance No 332 change from Commercial-
One and Residential-Three to Restricted Commercial-One be approved
for the following reasons (1) Legal requirements for publishing,
posting and notifications have been met, (2) this parcel is
currently zoned C-l and R-3, (3) The subject parcel is adjacent
to heavy commercial on the north, and single family residential
across Harlan Street to the east That the RC-l zone would
provide a good buffer between the heavy commercial along 38th
Avenue and the residential to the south, (4) The Planning Commission
recommended approval, and (5) be contingent upon applicant meeting
those items of concern,such as the Development Agreement with
Publ i c Works, seconded by tk Flasco, carried 6-0
Item 6 Application by Keith D Davis for a 3-1ot Minor Subdivision for
property located at approximately 3810 Wadsworth Blvd (Case No
MS-79-4)
Mr Stromberg gave the staff report and entered the records into evidence
Donna Dunaway, 3706 Dartmouth Avenue, Dallas, Texas, who holds leases on
this property and wishes to build on the vacant lot was present
Kent Davis, 8880 Melrose Drive, Wheat Ridge, one of the owners of the property
indicated that if changes were required from the present plan he would need
to take it back to his group Council were concerned about access of the
lot in question to public streets and that the remainder of the property
(to the south) had not been included in this subdivision request
Lois Hayna, 4045 Upham, was concerned as to whether the buffer or berm would
be constructed Mr Stromberg indicated this would be a requirement when
the building permit is issued
MOTION by Mr Flasco That thi s be conti nued for a two-week peri od
for the applicant, the land owner, and the city to work out
those details and be brought back to City Council at that time
with those things that are necessary to have action on, including
the question of access Seconded by Mr Donaldson, carried 6-0
Item 7 Application by the City of Wheat Ridge to correct the Official
Zoning Map by excluding from the Residential-Two (R-2) Zoning
District and including within the Restricted Commercial (RC)
Zoning District property located at 4856 Wadsworth (James J
Di mi troff)
It was explained that this was a Zoning Map error, that the case had been
heard in Jefferson County on January 8, 1968 (Case B-67-105) but the Zoning
Map had not been changed at that time Council discussion If it is nec-
essary for these corrections to be made by motion or ordinance and if an
ordinance is necessary could they be put in one ordinance except for those
that have serious problems
MOTION by Mr Flasco "I move that we continue this for a one-
week period and the City Attorney bring back to us his rec-
omme n d at ion", seconded by Mr Donaldson, carri ed 6-0
Application by the City of Wheat Ridge to correct the Official
Zoning Map by excluding from the Agriculture-One (A-l)zoning
district and including within the Residential-One A (R-IA) zoning
District Property located at 4700 Parfet Street (Luther Williams)
(Case No WZ-78-48D)
Since this is also a zoning map correction, Mrs Cavarra MOVED "That the
hearing by the City of Wheat Ridge, correction of Zoning Map
from Agriculture-One (A-I) and include within the Residential-
One A (R-IA) zoning district, for property located at 4700
Parfet Street, be continued for one week", seconded by Mr Flasco,
carried 6-0

(C-l) zoning district on property located at 11880 W 44th Avenue
(Case No SUP-79-4)

Mr Gidley gave the staff report Sipriano Aragon, 4745 Indiana, stated that
he plans to expand his repair shop business
MOTION by ~lr Pepe "I move that Case SUP-79-4 be approved for the
following reasons (1) requirements for publishing, posting and
notification have been met, (2) The purpose of this request for
a Special Use Permit is to allow the applicant to expand his
existing auto body repair shop where that use is currently non-
conforming due to lack of a Special Use Permit, (3) The subject
use has successfully been operating for several years and that
the use is compatible with surrounding land uses, therefore, it
would be proper to encourage the physical improvement and ex-
pansion of the auto body shop, (4) Planning Commission recom-
mended approval of this application at their meeting of May 3,
1979", seconded by t~rs Turner, carri ed 6-0
Item 10
Ordinance No 331 Amending Ordinance No 289, Series of 1978,
of the Code of the City of Wheat Ridge, Colorado, by the addition
of Section 11-4
Mrs Cavarra introduced the ordinance on second reading and the clerk read the
title
MOTION by t~rs Cavarra "I move that Ordinance No 331 be approved
on second reading and ordered published", seconded by Mr Lewman
Discussion the problem of enforcing the ordinance regarding weight limits
and parking time requirements, possible deletion of pick-ups from the
ordinance MOTION by Mrs Cavarra "I move that we continue this
hearing until June 25", seconded by Mr Flasco, carried 6-0
Ordinances on First Reading
Item 11
An Ordinance authorizing the transfer of the Building Maintenance
Division, including staff and all operating appropriations and
expenditures, from Public Works Department to the Administrative
Services Department
Ordinance was introduced on first reading by Mr Lewman, numbered 333, and the
title read by the clerk
MOTION by ~1r Lewman "I move that Ordinance No 333 be adopted on
first reading and ordered published, that a Public Hearing be set
for Monday, June 25, 1979 at 7 30 pm, in City Council Chambers
at 7500 W 29th Ave, Municipal Building, Wheat Ridge, Colorado,
and that the Ordinance, if approved on second reading take effect
J u 1 y 1, 1979", seconded by Mrs Turner, carri ed 5-1 Mr Pepe voti ng NO
Decisions, Resolutions and Motions

Recommended emergency reconstruction of street intersection at
W 32nd Ave and Youngfield and 1-70 overpass as an extension of
1979 street contract

Motion for City to initiate a rezoning application and to authorize
the Mayor to sign the application for the Mugele property located
north of 44th and east of Miller Street from PRD to A-l
Item 14
Approval of agreement with RTD for installation of bus pullout, bus
shelter, and related improvements at W 38th Ave and Wadsworth and
concrete pad, curb and gutter on W 26th Ave immediately east of
Wadsworth Blvd
MOTION by Mrs Cavarra "I move that Items 12, 13 & 14 be continued
for one week", seconded by ~1r Flasco, carried 6-0
