CITY OF WHEAT RIDGE, COLORADO
August 6, 1979
The August 6, 1979 Regular City Council Meeting was convened by Mayor Phillips
at 7 40 p m Council members present Mary Jo Cavarra, Joseph M Donaldson,
Anthony N Flasco, Gary Lewman, Louise F Turner and Ray C Pepe Also present
City Clerk, Carol Hampf, Department Heads Douglas Hilyard, Ed Pinson and
Charles Stromberg, staff and interested citizens
ORDINANCES ON FIRST READING
Item 1
An Ordinance providing for the approval of rezoning from Agri-
culture-One (A-l) to Commercial-One (C-l) for land located at
4301 Kipling Street, City of Wheat Ridge, County of Jefferson,
State of Colorado (Case No WZ-79-14)
Ordinance was introduced by Mr Lewman, numbered 350, and the title read by
the Clerk MOTION by Mr Lewman "I move that Ordinance No 350 be
adopted on first reading and ordered published, that a Public
Hearing be set for Monday, August 27, 1979, at 7 30 p m in City
Council Chambers at 7500 W 29th Avenue, in the Municipal Building
Wheat Ridge, Colorado, and that the Ordinance, if approved on
Second Reading take effect 15 days after final publication",
seconded by Mr Donaldson, carried 6-0
Item 2
An Ordinance providing for the rezoning of land from Residential-
One (R-l) to Planned Residential Development (PRD) and approval
of a Preliminary Development Plan on property located at 3470-3490
Parfet Street, City of Wheat Ridge, County of Jefferson, State of
Colorado (Case No WZ-79-13)
Ordinance was introduced by Mr Pepe, numbered 351, and the title read by
the Clerk MOTION by r~r Pepe "I move that this Ordinance be adopted
on First Reading and ordered published, that a Public Hearing be set
for Monday, August 27, 1979, at 7 30 pm, in City Council Chambers
at 7500 W 29th Avenue, Municipal Building, Wheat Ridge, Colorado,
and that the Ordinance, if approved on Second Reading, take effect
15 days after final publication", seconded by Mr Lewman, carried 6-0
Item 3
An Ordinance amending Chapter 9 of The Code of The City of Wheat
Ridge, Colorado, by the addition of Article IV, Waterway Control
Ordinance was introduced by Mrs Turner, numbered 352, and the title read by
the Clerk MOTION by Mrs Turner "I move that Ordinance No 352 be
approved on First Reading and the Public Hearing be set for Monday,
27th of August in City Council Chambers in Municipal Building,
7500 West 29th Avenue, in Wheat Ridge, and if approved on Second
Reading, it take effect one day after final publication", seconded
by Mr Pepe, carried 6-0
CITY ADMINISTRATOR'S MATTERS
Item 4
Approval of drainage improvements at West 26th and Gray Street
in cooperation with City of Edgewater Estimated Wheat Ridge
share, $5,478, Account 31-302-800-833
Emmett L Lane, City Engineer for Edgewater, explained the drainage problem at
26th and Gray Wheat Ridge is asked to share in the construction costs and
Edgewater bear the costs of design and construction administration MOTION by
Mr Donaldson "I move to Table this for one week to give other
Council members a chance to look at it", seconded by Mr Flasco,
carried 4-2 with Mr Pepe and Mr Lewman voting NO

COUNCILMEMBERS' MATTERS
Mr Flasco turned over to the City Clerk a petition he had received regarding
a drainage problem at 6073 and 6105 West 44th Avenue Item was set for Agenda
of August 20th
MOTION by Mrs. Turner to add land acquisition matter regarding an appraisal
and a legal matter requested by the Attorney to the Executive Session voted
on last week, seconded by Mr Lewman, carried 6-0
Mr Lewman said that it had been called to his attention that legal advice is
not readily available to the Planning Commission and, at times, hearing
decisions have to be delayed The UDFCD Report on the flood of March 17, 1979
is available from him for reading
Meeting was recessed into a Study Session
Executive Session was held
ADJOURNMENT
The meeting adjourned at 10 00 P m
