HomeMy WebLinkAbout09/10/1979 CITY COUNCIL MINUTES CITY OF .iHEAT RIDGE, COLORADO __~tember 10, )979 __ The September 10, 1979 Regular City Council Meeting was convened by Mayor Phillips at 7 50 P m Councilmembers present Mary Jo Cavarra, Anthony N Flasco, Gary Lewman, Louise F Turner, and Ray C Pepe Also present City Clerk Carol F Hampf, Treasurer James ~,a lone, Ci ty Attorney Ed Lambert, Department Heads Ri ch Bredt, Doug Hilyard, Ed Pinson and Charles Stromberg, staff and interested citizens APPROVAL OF MINUTES MOTION bj Mr Pepe to approve the Minutes of the Special Meeting of August 25, 1979 and the Regular Meeting of August 27, 1979, seconded by ~1rs Cavarra, CARRIED 5-0 PUBLI C COMf'1ENT No one was present to speak under Public Comment PUBLIC HEARINGS AND ORDINANCES ON SECOND REJI.DING Item 1 Ordinance No 357 - Repealing tlo 305, Series of 1979, providing for new classifications, pay ranges and pay grades, providing for imple- mentation retroactive to July 1, 1979, and further providing fee and special contractual rates Mrs Cavarra and ~1rs Turner presented suggested amendments to the Ordinance for consideration following comments by the pUblic The following persons spoke in favor of pay raises for City employees Herbert C Schillerff, 3900 Garrison St , Don Lancaster, 4076 Everett St , Christine Parke, 3250 Flower St , Linda Clark, 11305 West 44th Ave, Dennis Floyd, 3265 Fenton St , representing the Wheat Ridqe Chamber of Commerce, W J Hiederfeld, 11771 W 49th Ave, Arthur R Gardner, 7035 W 37th Ave, Shannon Geis, 4125 Otis St , James T Johnson, 10895 W 38th Place, Rod Killian, 3784 Union Ct , Nancy Snow, 11155 West 40th Ave, Jack Clark, 3590 Miller St , Genie Merkle, 3891 Estes St , Elbert Roller, 10535 W 32nd Ave, Kay Ore, 10565 W 46th Ave, Carol F Hampf, City Clerk, Marshall Fogel, Attorney, representing the \>Jheat Ridge Police Pro- tective Association, who submitted a pay proposal for the Police Department Mrs Turner said that Mr Donaldson had asked that Council not take action on the Ordinance this evening - that he wished to be allowed to listen to the tapes - but she felt it wise to take action tonight and MOVED that Council do so, seconded by Mrs Cavarra, CARRIED 4-1 with Councilmember Flasco voting NO Af\1EtWED t.10TION for the adootion of Ordinance No 357 with the amendment that Section XV, Implementation and Effective Date of This Ordinance _ the first two paragraphs be deleted and replaced with the following _ Any employee whose present salary is at the current minimum shall receive the new minimum All other employees' salaries shall be computed as follows __ Current salary + Current Salary - Minimum of Current Range (r) X Max of Current Range - Min of Current RangeX J (Maximum of New Range - Minimum of New Range) The resulting amount or the new minimum, whichever is greater, shall be the revised salary with the exception of those with less than one year's service Those people shall receive their current salaries or the new minimum, whichever is greater However, in no circum- stances shall the computed salary exceed the maximum of the range All complaints concerning the classification of particular jObs shall be handled in the manner prescribed by the Personnel Rules ORIGINAL MOTION by Mr Lewman, seconded by Mrs Cavarra AMENDING r~OTION by CITY COUNCIL MINUTES September 10, 1979 Page -2- ~1rs Cavarra, seconded by ~1r Lewman, Ar~ENDrvJENT CARRIED 4-1, t'lr Flasco voting NO, stating that this would help the long term employees or those who needed the money the least Mrs Turner stated she preferred the other proposal but would vote FOR this amendment MOTION AS AMENDED CARRIED 4-1, Mr Flasco voting NO for the same reasons as stated above MOTION TO AMEND by Mrs Turner that Senior Secretary and Deputy Court Clerk be placed in Class 8, that Accounting Technicians be placed in Grade 10, that Chief Court Clerk be placed in Grade 10, seconded by Mr Flasco t~OTION by r~rs Cavarra that Council defer action on this amendment until it can be referred to the Personnel Commission for viewing in the over-all plan, should this Ordinance be adopted, seconded by ~1r Lewman, CARRIED 3-2, Mr Flasco and Mrs Turner voting NO Item 2 Ordinance No 353 - Repealing Ordinances 91 and 99 and establishing the salary of the Mayor of the City of Wheat Ridge, Colorado, for the period beginning November 12. 1979 MOTION by Mr Pepe that Ordinance No 353 be adopted on second reading and that it be published, seconded by Mr Lewman, CARRIED 4-1, Mrs Cavarra voting NO FAILED AMENDING MOTION by Mrs Turner that the salary be $4,800 per year and $400 per month, seconded by Mrs Cavarra, FAILED 2-3, Councilmembers Pepe, Lewman and Flasco voting NO, Mr Flasco stating he was voting no because Council had previously given raises to the employees and should follow through Item 3 Ordinance No 354 - Repealing Ordinance 92 and establishing the salary of the City Council of The City of Wheat Ridge, Colorado, for the period beginning November 12, 1979 Ben Chastain, 3250 ~1arshall St , spoke in favor of the City Council salary At1ENDED MOTIOri that this Ordinance be approved with the amendment that the salary be $1,800 per year and $150 per month ORIGINAL MOTION by Mrs Turner, seconded by Mrs Cavarra, AMENDMENT by Mr Lewman, seconded by Mrs Cavarra, A~1nWMENT CARRIED 3-2 with ~,r Flasco and Mr Pepe voting NO MOTION AS AMENDED CARRIED 3-2 with Mr Flasco and Mrs Turner voting NO Portion of original motion as divided out to set the salary at $1,500 per year and $125 per month, FAILED 2-3 with Mr Flasco, Mr Lewman and Mr Pepe voting NO Item 4 Ordinance No 355 - Repealing Ordinance 256 and establishing the salary of the City Treasurer of The City of Wheat Ridge, Colorado, for the period beginning November 12, 1979 MOTION by Mr Lewman for the adoption of Ordinance No 355 as printed, seconded by Mrs Cavarra, CARRIED 5-0 Item 5 Ordinance No 356 - Repealing Ordinance 257 and establishing the salary of the City Clerk of The City of Wheat Ridge, Colorado, for the period beginning November 12, 1979 ~10TION by ~lr Lewman to adopt Ord i nance No 356 as pri nted, seconded by Mrs Cavarra, CARRIED 5-0 Item 6 Ordinance No 351 - Providing for the Rezoning of land from Residential- One (R-1) to Planned Residential Development (PRD) and approval of a Preliminary Development Plan on property located at 3470-3490 Parfet Street, City of Wheat Ridge, County of Jefferson, State of Colorado (postponed from August 27th) (Case No WZ-79-13) ~1r Stromberg read the Staff Comments t~emo Ed Schaefer, 12600 Wes t 32nd fJ..ve , stated that he thought if the pipe under Parfet Street were cleaned out, the standing water would drain and the reedy area should be used as a grass area, not as a swamp, when it wi 11 be someones yard t.10TION by f1rs Turner (as de- ferred from 8/27, with additions) that the 2 lots on the south end of the property be amended to have 100-foot frontage each and that Lot 1, which would then en- compass 171 28 feet along Parfet Street, not be built upon, and that the City in consideration of the water storage situation, which is unique or peculiar CITY COUNCIL MINUTES September 10, 1979 Page -3- to this property, and in consideration of the financial investment of the applicant, negotiate with the applicant for (1) outright purchase of Lot 1, or (2) purchase a scenic easement or development rights on Lot 1, or (3) be platted as a non-exclusive drainage easement; seconded by Mrs Cavarra, CARRIED 5-0 Item 7 Application for New Class G - Hotel & Restaurant Liquor License W/Ext Hrs by Dewey Dutton, dba Top's Coffee Shops, 4300 Wads- worth Boulevard, Wheat Ridge, Colorado A E Anderson, Attorney representi ng the app 1 i cant, t1r Dewey Dutton, 12145 Applewood Knolls Drive, Lakewood, gave his reasons for applying for a liquor license vlhich included a revised operation Two pictures, shovJing the Liquor Hearing Notice sign, were admitted as Applicant's Exhibits A and B Frank Striker, 3562 Allison, Linda Gilmore, 2290 South Williams, and Robin Squires, 2399 South Gilpin, of Marketing Service Associates, presented petitions in favor of the license, showing 590 names, secured within the 1-mi 1 e radi us, were admitted as J\ppl i cant's Exhi bits C and D t10TION by Mr Lewman "I move that the Application for a New Class G - Hotel & Restaurant License With Extended Hours for Top's Coffee Shop, located at 4300 Wadsworth Boulevard, Wheat Ridge, Colorado, be approved for the following reason That it is apparent that the needs of the neighborhood are not being completely served by the existing establishments", seconded by r~rs Cavarra ~1r Pepe stated he intended to vote NO because he feels the needs are being met by the existing establishments and the applicant's petition did not record those people who were against the license MOTION by Mr Flasco that a decision be deferred for one week since he was not sure whether the needs were being met, no further testimony will be taken, seconded by Mr Pepe, CARRIED 4-0 Mrs Turner left Council Chambers due to illness during the Hearing DECI S IONS, RESOLUTIONS AND ~10TIONS Item 8 Resolution to reinvest funds of the General Fund Resolution was introduced by Mr Lewman with the request that First Bank of Wheat Ridge and interest rate of 11 25% be filled in, was numbered 661 and the title read by the Clerk 1\10TION by ~1r Lewman "I move to adopt Resolution 661", seconded by r.1r Pepe, CARRIED 4-0 Item 9 Additions/deletions to Active Vendor's List (auditing firms) for Annual Audit (James Malone, City Treasurer) After discussion with Mr Malone regarding the possible auditing firms, MOTION by Mr Lewman to defer the list for one week, seconded by Mr Pepe, CARRIED 4-0 Item 10 Approval of final payment to Palmer Enterprises, Inc for installation of offices for City Clerk and other minor building modifications ~10TION by t1rs Cavarra "I move to approve payment in the amount of $9,016 to Palmer Enterprises, Inc for office remodeling to be charged to Account No 31-307-811, provided no claims are filed v/ith the City in response to the Notice of Final Settlement", seconded by Mr Lewman, CARRIED 4-0 Item 11 Motion to appoint an elected official or member of staff to CML Po 1 i cy Commi ttee City Clerk Carol Hampf was chosen to represent Wheat Ridge on the Colorado Municipal League Policy Committee for the coming year CITY COUNCIL MINUTES September 10, 1979 Page -4- Reconsideration of authorization for payment to Faulkner-Kellogg & Associates, Inc , Consulting Engineers, for street inspection services ($6,814 86) Account No 31-303-800-840 (Requested by Councilmember Fl asco) MOTION by Mr Flasco that we pay Faulkner-Kellogg & Associates, Inc , consulting engineers, for street inspection services in the amount of $6,814 86, to be charged to Account No 31-303-800-840 seconded by fJlr Lewman, CARRIED 3-1, Mr Pepe voting NO Item 12 MAYOR' S ~lATTERS Item 13 Request of Everitt Science Club at Everitt Junior High School to use City pickup truck to deliver glass bottles to Coors Container Company following their monthly recycling drive Mayor Phillips was asked to work with Everitt Junior High School on this CITY ADMINISTRATOR'S MATTERS Item 14 Submission of Preliminary Draft of 1980 Budget pursuant to provisions of the City Charter Suggested dates for Study Session - September 18, 19, and 20 - as published in the Budget Calendar Mr Hilyard stated that this is a balanced budget within the finanical capabilities of the City City Council decided to hold Study Sessions on this Budget on September 13 and September 20 in the Municipal Building from 7 00 P m to 10 30 P m CITY ATTORNEY'S MATTERS Mr Lambert introduced the new member of his firm, Chuck Brownman COUNCILMEMBERS' MATTERS Councilmember Pepe asked that the street problems in the vicinity of 31st and Lamar and 36th between Otis and Pierce be looked into ~10TION by Mr Flasco to correct the motion of August 27 "The bank mentioned in my motion on August 27, 1979 regarding cutting a drainage ditch in the area of the Pop Shop should have been the Western Federal Savings, not Majestic Savings and Loan, therefore, I woul d move that change be made", seconded by f~r Pepe, CARRIED 4-0 ADJOURNMENT The meeting adjourned at 12 00 midnight ----- ,~/ } /' I " </ /,.. { /"/ T / , -t '--t _ J"-t / v --T ''i Carol F Hampf, City Clerk APPROVED ell ~!/71 7> / CFH,fg,chj,
