CITY OF WHEAT RIDGE, COLORADO
October 29, 1979
The October 29, 1979 Regular City Council Meeting was convened by Mayor Phillips
at 7 32 P m Councilmembers present Mary Jo Cavarra, Joseph M Donaldson,
Anthony R Fl asco, Gary L Lewman, Loui se F Turner and Ray C Pepe Al so pre-
sent City Clerk Carol F Hampf, City Attorney Charles Owens, Department Heads
Chief Ed Pinson, Leonard Smith, Charles Stromberg, staff and interested citizens
APPROVAL OF MINUTES
MOTION by ~1r Donaldson "I move for the approval of the Minutes of
October 22,1979 as printed", seconded by Mr Flasco, carried 6-0
PROCLAMATIONS BY THE MAYOR
Mayor Phillips read the following proclamations
Designating the month of November, 1979 as "NATIONAL REACT MONTH"
Proclaiming Wednesday, November 14, 1979 as "OPERATING ROOM NURSE DAY"
Proc 1 a irni ng Thursday, November 15, 1979 as " STAMP OUT DRAGON BREATH" day
Mrs Dale Schlenger was present to accept the "National React Month" procla-
mation Mr John LePenske, Mrs Vivian Towell and the Smokeless Dragon accepted
the "Stamp Out Dragon Breath" proclamation

PUBLIC HEARINGS AND ORDINANCES ON SECOND READING
Item 1 Application by C & H Development for approval of a two-lot Minor Sub-
division for property at approximately 9900 W 49th Avenue
(Case No MS-79-6)
Mr Stromberg gave staff comments Don Berry, 10367 Wes t Vleaver, L ittl eton ,
applicant, was available to answer questions MOTION by Mr Lewman "I move
that Case No MS-79-6, Denny's Addition Minor Subdivision be
approved for the following reasons (1) Requirements of notification
have been met, (2) Subject parcel is within the City of Wheat Ridge,
(3) All requirements of the Subdivision Regulations have been met,
(4) Planning Commission and the Planning staff recommended approval",
seconded by Mr Flasco, carried 6-0
ORDINANCES ON FIRST READING
Item 2 An Ordinance providing for the approval of rezoning from Agriculture-
One (A-I) to Commercial-One (C-1) for land located at 9990 W 49th Ave,
City of Wheat Ridge, County of Jefferson, State of Colorado
(Case No WZ-79-38) (C & H Development)
Ordinance was introduced by Mr Lewman, numbered 370 and the title read by the
Clerk t~OTION by Mr Lewman for the adoption of Ordinance 370 on first
reading, that it be published, that a public hearing be set for
December 10, 1979 at 7 30 P m in Council Chambers at 7500 West 29th
Avenue, and that the Ordinance, if approved on second reading, take
effect one day after final publication, seconded by Mr Flasco, carried
6-0
Item 3 An Ordinance adding an additional job classification and amending
Ordinance No 357, series of 1979, Section I, Merit and Civil Service
Classification
Ordinance was introduced by Mr Lewman, numbered 371 and the title read by the
Clerk MOTION by t~r Lewman that Ordinance 371 be adopted on first
reading, that it be ordered published and that a public hearing be
set for November 19, 1979 at 7 30 p m in Council Chambers at 7500
Vlest 29th Avenue and that the Ordinance, if approved on second reading,
take effect one day after final publication, seconded by t~r Flasco,
carri ed 6-0

t~OTION by Mr Flasco "I move that up to five Public Works ~1aintenance
Workers-I be hired as soon as possible Such hiring shall be done
in accordance within the City of Wheat Ridge Merit System Personnel
Rules and Regulations", seconded by Mr Lewman, carried 6-0
DECISIONS, RESOLUTIONS AND MOTIONS
Item 4 ~ Request for approval of easement by Fruitdale Sanitation District
for extension of Clear Creek Sewer between Parfet and Miller
(Case No WCP-79-3)
~ Right-of-way Agreement between Adolph Coors Company and Fruitdale
Sanitation District with Subordination Agreement between Adolph
Coors Company and City of Wheat Ridge
Mr Stromberg gave staff comments MOTION by t1rs Cavarra to add to the
end of the 6th line of the Easement Agreement, "Such reconstruction
must be approved in writing by the Director of Parks and Recreation",
seconded by Mrs Turner, carried 6-0
Emmett L Lane, 9500 West 14th Avenue, Lakewood, stated that none of this is
located in the Metro Sanitation District MOTION by Mr Pepe "I move that
the Easement Agreement between Fruitdale Sanitation District and
the City of Wheat Ridge be approved and executed I further move
that the Right-of-way Agreement between Adoph Coors Company, Fruit-
dale Sanitation District and the City of Wheat Ridge be approved
and executed", seconded by Mr Lewman carried 6-0
Item 5 Authorize Mayor to sign Letter of Agreement with Arthur Young &
Company for audit of Annual Financial Statements
~10TION by Mr Lewman that the Mayor be authori zed to execute the
Letter of Understanding between Arthur Young and Company and the
City of Wheat Ridge, seconded by Mrs Turner, carried 6-0
Item 6 Authorize Mayor to execute agreement between City of Wheat Ridge and
Jefferson County Mental Health Center, Inc re monthly billing
Ci ty Attorney Owens as ked that the second 1 i ne of the Agreement, "a mun i ci pa 1
corporation" be changed to "a Home Rule City" ~~OTION by Mr Pepe that the
Agreement between the City and Jefferson County Mental Health Center
be approved and the Mayor authori zed to sign it, seconded by Mr
Flasco, carried 6-0
Item 7 Budget Transfer Resolution on Budget Adjustments for the Public
Works Department
Resolution was introduced by Mr Lewman, numbered 666 and the title read by
the Clerk t~OTION by Mr Lewman that Resolution 666 be approved as
printed, seconded by Mr Donaldson, carried 6-0
Item 8 Award of bid on stationary items to be stocked in Central Supply and
issued to departments as ordered
t~OTION by Mr Donaldson "I move to approve the purchase of one year's
supply of stationary items from Peterson Print at a cost of
$3,68390, to be charged to account No 01-116-652", seconded by
Mr Lewman, carried 6-0
Item 9 Motion directing the City Attorney to draw up a lease with the
Van Hoosers (for Independence Street footbridge over Clear Creek)
Following Mr Pramenko's comments at last week's meeting regarding his dis-
cussion with the Van Hoosers, Mr Smith (Public Works Department) contacted
the Van Hoosers' representative This representative desires to speak with
the City Attorney prior to the drawing of a lease MOTION by Mrs Cavarra
that after discussion with the Van Hoosers , if it is appropriate,
the City Attorney draw up a lease with the Van Hoosers, that Mr
Van Hooser be asked to sign the lease, and it then be brought
to Ci ty Counci 1, seconded by Mr Donaldson, carried 6-0

Item 10 Decision regarding date of Seating of newly elected City Officals
(November 12th is a City holiday See Rule 1, page 1, City Council
Rules of Order and Procedure)
~10TION by tk Lewman that the City Council Meeting normally scheduled
for November 12, be scheduled for November 13, in these chambers,
seconded by t~r Donaldson, carried 6-0
MAYOR'S MATTERS
Mayor Phillips told Council that (1) New motors for the air conditioners have
been installed, (2) A contract regarding the Lower Clear Creek Major Drainage
Way is being circulated among the involved cities and will be brought to Wheat
Ridge City Council before the end of the year, (3) A contract for an Early
Warning System between Consolidated Mutual, Jefferson County, Wheat Ridge,
and UDFCD has been received He suggested that Wheat Ridge participation share
be 18% as in previous similar contracts
CITY ATTORNEY'S MATTERS
Mr Owens brought to Council the Order of the Court regarding the Cheryl Wood
et al case The portion of the suit naming the City Councilmembers and Mayor
individually, and the request for Class Action has been dismissed The re-
mainder of the suit is scheduled for trial
COUNCILMEMBERS' MATTERS
Mrs Cavarra asked that the Mayor send a letter to Consolidated Mutual asking
that (1) The City be forewarned when they are going to release water, (2)
Urban Drainage or Consolidated Mutual enlarge the holding ponds, (3) If
something could be done about the foul smelling run-off water Mayor Phillips
said he had spoken with the General t1anager and they have already said they
will not cycle any systems without letting us know in advance Mr Pinson
said that under flood conditions, foul smelling water occurs due to decaying
vegetation Mrs Turner indicated a report had been received showing Consoli-
dated Mutual's admission of direct responsibility in the recent minor flood
and they would be handling the claims
