HomeMy WebLinkAbout11/19/1979 November 19, 1979 CITY COUNCIL MINUTES CITY OF WHEAT RIDGE, COLORADO The November 19, 1979 Regular City Council ~Ieeting was convened by Mayor Stites at 7 30 P m Councilmembers present Pat Aiello, Bill Bowman, Mary Jo Cavarra, Kent Davis, Ken Lewis, Lawrence G Merkl, Kay N Ore, and Louise F Turner who arrived at 7 35 P m Also present City Clerk Carol F Hampf, City Treasurer James Malone, City Attorney Ed Lambert, Department Heads Richard Bredt, Chief Ed Pinson, Charles Stromberg, staff and interested citizens APPROVAL OF MINUTES MOTION by Mr Davis to approve the minutes of the meeting of October 29,1979 as published, carried 7-0 PUBLIC COMMENT Dr Lawrence M Murphy, 3045 Parfet Dr Lakewood, representing parents of Everitt Jr High students, spoke requesting discussion with the City regarding the safety of children and the prospective shopping center in the vicinity of 38th and Kipling Mr Stromberg was asked to make arrangements John Peterson, 3990 Independence Ct , asked that the large chuck hole in the street be repaired Chief Pinson was asked to see that the problem is taken care of Mary Boll, 4535 Yukon Ct , representing residents of Briarwood Court, asked that speed dips, speed limit sign and dead end sign be placed on Yukon Ct She had a petition from Yukon Ct and Yarrow Street people The petition was given to Chief Pinson to be looked into Item 1 Election of Mayor pro tem MOTION by Mr Bowman that Mayor pro tem and Council President terms (those being voted upon tonight) be for 1 year, carried 8-0 MOTION by Mrs Cavarra that the Counci 1 Rul es of Order and Procedure be amended to allow the Mayor pro tem and Council President terms to be either 1 or 2 years at Council's discretion, carried 8-0 Three ballots were held without a majority vote MOTION by Mrs Cavarra that the first ballot be reviewed and that the Council vote on the two people receiving the most votes on the ballot It was necessary to vote on three people since the first ballot had been 4 - 2 - 2 Fourth ballot yielded no majority Fifth ballot (voting on the top 2) resulted in Ken Lewis being elected Mayor pro tem Item 2 Election of Council President First ballot elected Mary Jo Cavarra Council President PUBLIC HEARINGS AND ORDINANCES ON SECOND READING Item 3 Application for a new Class G - Hotel & Restaurant Liquor License - by Carol and Joseph Barton, dba Bartoni's Time Square Restaurant, 4234-36 Wadsworth Boulevard (currently have Beer and Wine license) Carol and Joseph Barton, 7161 N Swadley Circle, Arvada, applicants, were present and stated that they were asking for a Class G, Hotel and Restaurant License at the request of their patrons Sherry McGarry, who had done the City's survey, was present if Council had any questions The City Attorney asked that the City's file including the survey be a part of the record The Public Hearing was closed ~~OTION by tltr Merkl that the application for a new Class G - Hotel and Restaurant License for Bartoni 's Time Square Restaurant, located at 4234-36 Wadsworth Boulevard, Wheat Ridge, be approved for the following reasons there was no opposition and the applicant presently has a wine and beer license The present 1 i cense I'fi 11 not be cont i nued, carried 8-0 CITY COUNCIL MINUTES November 19, 1979 Page -2~ Item 4 Ordinance No 366 - Amending Chapter 19A of The Code of The City of Wheat Ridge, Colorado (Sign Code) Ordinance No 366 was introduced on second reading by Mrs Cavarra MOTION by Mrs Cavi\rra that Ordinance 366 be approved on secondreading and ordered-published, carried 8~0 Item 5 Ordinance No 367 ~ Creating Chapter 4A of The Code of The City of _u,___ Wheat Ridge, Colorado (Courtesy Benches) Ordinance was introduced by ~lrs Turner Amended Motion that the ordinance be approved on second reading with the following amendments (1) Section 4A-3 (b) read, "All permits shall expire at midnight on the 31st day of March of each year In order to retain ownership of a current permit for a courtesy bench location, the owner must make re-application by the first day of March If no changes of the bench are anticipated, the re-application shall include the same items as the initial application, with the exception of a site plan However, if the owner wishes to make any changes of the bench, a new site plan shall be included in the re-application If re- application is not submitted to the building inspector by March 1, the owner will be presumed to have abandoned his rights in the bench, and the bench must be removed by the 31st day of March" (2) Section 4A-8, "one bench" be changed to "two benches" (3) Section 4A-1, Paragraph 2, to read "~~~rtesy Bench (a) Any bench or seat, located on public or private property within the City of Wheat Ridge, which contains advertising material (b) Any bench or seat not containing advertising material which is located on a public right- of-way or on public or private property within the following rectangle adjacent to an RTD sign designating a bus stop Twenty (20) feet either side of the RTD sign and parallel to the roadway, and ten (10) feet from the RTD sign perpendicular from the roadway" (4) Section 4A-10 (b) to read "Benches for bus stops shall be lo- cated only at designated bus stops within the public right-of-way, off of the roadway or off of the public right-of-way, with written permission of the property owner If a bench for a bus stop is located off of the public right-of-way, the written permission of the property owner shall accompany the original application for per- mit and each annual re-application submitted by the permitee The bench must be placed at, or as near as is practicable, to the place where passengers board and disembark from the bus It shall be the sole responsibility of the permittee to assure that all benches are placed on the public right-of-way or that permission has been granted from the other property owner " Amendment (1) by Mrs Turner, carried 8-0, Amendment (2) by Mr Merkl, carried 7-1 with Mrs Cavarra voting No Amendment (3) (4) and motion to approve as i\mended by Mrs Cavarra, carried 7-1 with Mr Merkl voting No Item 6 Ordinance No 368 - Amending certain sections of Appendix A, Zoning Ordinance of The Code of Laws of The City of Wheat Ridge, as adopted and passed in 1976, as amended, which sections pertain to fences, walls, lighting structures and obstructions to view Ordinance was introduced by Mrs Turner Amended Motion that the Ordinance be approved with the amendment that in each section '12 feet' be changed to '10' feet, Amendment by I"rs Cavarra carried 8-0 Original Motion by Mrs Turner as amended carried 6-2 with Mr Lewis and Mrs Ore voting No Item 7 Ordinance No 371 - Adding an additional Job Classification and amending Ordinance No 357, Series of 1979, Section I, Merit and Civil Service Classification Ordinance was introduced by Mr, Merkl who moved that Ordinance 371 be adopted on second reading and orderea-published; carried 8-0 CITY COUNCIL MINUTES November 19, 1979 Page -3- DECISIONS, RESOLUTIONS AND MOTIONS l!em 8 Resolution authorizing the appointment of a Deputy City Treasurer Resolution was introduced by Mr Merkl, numbered 667 and the title read by the Clerk MOTION by Mr Merkl that Resolution 667 be adopted carried 8-0 Item 9 Budget Transfer Resolution appropriating additional funds for imple- mentation of Ordinance 357 and year end adjustments Resolution was introduced by Mrs Turner, numbered 668 by the Clerk and the title read MOTION by Mrs Turner that Resol uti on 668 be approved carried 8-0 Item 10 Agreement between UDFCD, City of Wheat Ridge, City of Arvada, and Adams County and Wright McLaughlin for Clear Creek Major Drainage Study, and approval of Wheat Ridge share of cost ($6,500) Questions were raised about the number of formal presentations to be given and the possible need for more than presently listed in the contract MOTION by Mr Merkl that decision of the 'Form Agreement for Major Drainageway Planning of Lower Clear Creek' be postponed for one week for input from Urban Drainage carried 8-0 Item 11 Applications for renewal of Beer/Liquor Licenses A Class D - Retail Liquor Store License B Class E - Liquor Licensed Drug Store C Class G - Hotel & Restaurant License D Class J - 3 2% Beer Retail Licnese E Class T - Tavern License The City Attorney reviewed the requirements for renwal of licenses and possible grounds for non-renewal A Mr Aiello moved to approve the renewal of a Class D - Retail Liquor Store License for Hillcrest Liquors, 4403 Wadsworth,and Wheat Ridge Liquors, 5808 West 38th Ave , carried 8-0 B Mr. Merkl moved to approve the renewal of a Class E - Liquor Licensed Drug Store - License for Wadsworth Drug, Inc , 7379 West 44th Ave, carried 8-0 C Mrs Turner moved to approve the renewal of Class G - Hotel & Restaurant Liquor Licenses for the following establishments Red Lobster, 4455 Wads- worth, Holly West, 3490 Youngfield, Gasthaus Ridgeview, 4465 Garrison, Vern's, 7605 West 44th Ave, House of Lords, 4111 Kipling, and LaFonda Mexican Restaurant, 5750 West 38th Ave, carried 8-0 Mrs Cavarra moved to approve the renewal of Class G - Hotel & Restaurant Liquor Licenses for the Ramada Inn, 10101 1-70 Service Road, the Country Broker Restaurant (Bull & Bear Pub), 10151 West 26th Ave and the Port 0' Entree-West, 4105 Wadsworth Blvd, carried 8-0 D Mr Merkl moved to approve the renewal of a Class J - 3 2% Beer Retail License for Kipling Self Service, 4075 Kipling, carried 8-0 E Mrs Ore moved to approve the renewal of Class T - Tavern License - for the following Swiss Society of Denver, 4850 Wadsworth and Disabled American Veterans Club, Chapter No 22,4901 Marshall, carried 8-0 ~1AYOR' S t~ATTERS Item 12 Recommendation by individual Councilmembers as to top three selections and rating of said three selections from City Administrator Applicant's resumes Mayor Stites asked Council to hand their selections to him for tabulation and then the top three, as recommended by Council, would be contacted for interviews Councilmembers were reminded of the 8 15 a m meeting in Council Chambers to meet with the employees (Meeting was cancelled Tuesday afternoon, because of the weather) CITY COUNCIL MINUTES November 19, 1979 Pilge .,.4- CITY ATTORNEY'S MATTERS At the request of the City Attorney Mr Aiello moved that an Executive Session be held at the end of the meeting to discuss present litigation matters carried 8-0 COUNCILMEMBERS' MATTERS Mr Merkl requested that copies of the car replacement policy be distributed to Council and that the subject be on the Agenda after the 1st of the year Mrs Turner distributed the new 5-year plan from Urban Drainage and Flood Con- trol District Mrs Cavarra reported from DRCOG that prospects are very dim for Wheat Ridge to receive any Federal Highway money in the near future Mr Bredt reported on two problems regarding the Swimming Pool (1) The joists for the bathhouse roof were specified to be 20 inches 18-inch ones were supplied Plans to bring them to strength are being made and will be submitted to our architect for approval (2) The tot pool was installed by dry pack instead of gunnite (due to lack of dry sand) as specified Core drillings are being made for tes ts COUNCIL COMMITTEES' AND COMMISSIONS' MATTERS Item 13 Appointments to Boards and Commissions to fill expired and vacated positions Since it has been some time since notice has been given that there are vacancies on some Boards and Commissions, Mrs Turner moved that all vacancies be adver- tised, that current members be continued on a temporary basis until this can be acted upon, carried 5-3 with Mr Merkl, Mr Lewis, and ~1rs Ore voting NO EXECUTIVE SESSION WAS HELD AJOURNt1ENT The meeting adjourned at 10 05 P m / :=-:- / ) u?/d' ~x/" Carol F Hampf, City APPROVED CFH, chj, fg,
