City Treasurer, James Malone; city AumiIlistrator, Tom Palmer; City Attorney, John Hayes; Department Head Gary Diede; staff; and interested citizens APJ:'KOVAL uF IHNU'l't,~ Motion by Mr Davis to approve the Mi,utes of ~eptember 22, 1geU with the amendment that under Councilmembers' Matters - where it is stated that Mr Davis would like to have the school crossing guard control the traftic signal at Yarrow Street-- the words "she should operate the traftic signal trom the side from which the children come"; seconded oy Mr Lewis; carried 7-0 PUBLIL COMHEicJT NO one was present to speak under public comment URDINANCE~ UN FIRST READING Item 1 Louncil Bill No 36 - An Ordinance providing for the approval ot a Zoning Map Correction from Industrial (I) to 21anned Commercial Development (PCD) tor land lacated at approximately the bouth ~st Lorner, I-7U and Harlan Street, Lity ot Wheat Ridge, County of Jefterson, State ot Colorado (Case No WZ-80-17D) Louncll 8ill 36 was introJucd by Hr Merkl; title read by the ClerK Motion oy Mr MerKl that Council Bill 36 be adopted on first reading and ordered published; that a Public Hearing be set for Monday, October 20, 198U, at 7 30 P m in City Council Chambers at 750U West 29th Avenue, Muncipial Building, Wheat Ridge, colorado; and that the urdinance, if approved on second reading, take effect 15 days after tinal publication with the amendment to the title adding at the end "to be consistent with zoning granted by Zoning Case .vZ-73-16"; seconded by Mrs rurner; carried 7-0 Item 2 Council 13ill No 37 - An Ordinance providing for the approval of a Zoning Map Correction from Restricted Commercial (R-C) to Restricted Commercial une (R-Cl) for land located at approximately 3660rJadsworth Blvd , Lity ot Wheat Ridge, County of Jefferson, State of Colorado (Case No irJZ-80-lOD) Louncil 3il1 No 37 was introduced by Mr Bowman; title read by the Clerk Amended Motion that Council 8ill 37 be adopted on first reading and ordered published; that a Public Hearing be set for Monday, October 20, 1geO, at 7 30 pm, in City Council Chambers at 75uu I"i 2':!th Avenue, Municipal Building, 'rJheat Ridge, Colorado, and that the Ordinance, if approved on second reading, take effect 15 days atter tinal publication, with the amendment, that at the end of the title the wording "to be consistent with Zoning granted by Case 1"i~-76-11" uriginal Motion by Mr Bowman; numbered 717; and the title read by the Clerk It was asked if this was the computer item that had been discussed at the Budget Study bession; and it was agreed that this was true qotion by Mr Lewis to purchase the "ASK" data inquiry arrd reporting software computer pacKage from NLR Corporation for an amount at $4,d50 with said funds to be derived from Account No 01-103-750; and to approve the Budget Transfer Resolution; seconded by Mr rlowman Motion carrIed 8-0 (Mr Aiello's sealed vote was read) Item 4 Rejection ot clid tor construction of Lena Gulch 32nd Avenue Culvert Entrance qr Diede recommended rejection ot the single bid received and that we go out to bid as soon as possible aimin] for more than one bid to be submitted I1e was asked why only one was received As far as known, two of tne other contractors had recently received contract awards on other projects and therefore could not work on this one He is hoping to receive better bids the next time Motion by Mr Merkl that the City reject the bid received on September 17, 1980 from Winslow Construction Company in the amount of $42,390 to construct the Lena Gulch 32nd Avenue Culvert Entrance; seconded by Mr Bowman; carried 8-0 The engineer's estimate for the project had been $35,7000 Item 5 Motion to authorize the Mayor to sign the agreement oetween the City of Wheat Ridge and the Denver Water Board for Conveyance ot Right-of-way (Lena Gulch Schedule I) Mr Diede stated that we are not paying the Denver water Board tor the easement; out we will relocate the line and will give a one-year warranty Motion by Mr Bowman that the Mayor be authorized to sign the Agreement oetween the City of Wheat Ridge and the Denver Water cloard tor conveyance ot right-ot-way for Lena Gulch Schedule I; seconded oy Mr Davis; carried 8-0 Motion oy Mr Davis that we remove Item b from the Agenda and reschedule it for uctober 13, 1980 at the city Attorney's request; seconded oy Mr Lewis; carried 7-0 Meeting adjourned 1rs Ore;
