City Treasurer, James Malone; City Administrator, Tom Palmer; Assistant City Attorney, Lee Phillips; Department Heads Richard Bredt, Charles Stromberg, and Rodger Young staff; and interested citizens Motion by Mrs Ore for approval of the Minutes of May 13, 1981; seconded by Mr Davis; carried 8-0 PUELI C COL1l\1ENT No one was present to speak under Public Comment PUBLIC lfEARINGS Item 1 Pre-Budget Public Hearing on the 1982 City of \'lheat Ridge Budget to receive citizens' co~nents, suggestions, and requests rhose present to speak were 1) Paul Kelly, 3670 Upham, from Family Tree Inc CWomen in Crisis program); 2TLlllian Fleming, 6363 W 29th ~ve , on Open Space; 3) Ron Granell, chairman of the Police ~dvisory Committee, 2905 webster,-cul crime prevention and Training Officer request; 4) Phyllis Lancaster, 4076 _Everett Street, requeste~ _ continuance of the spaying program, upgrade old commercial areas, add blke/walkways, and less street widening, 5) Loretta Campbell, 2949 Chase, representing Are~ 4 ~ommi- tee, a request for a moratorium on expenditures for Open Space and street wldenlng, _ 6) Barbara Brockman, 11715 W 33rd Place, on Open Space, traffic in the vicinity of 32nd and Youngfield, and to redevelop shopoing centers without subsidies; 7) Janice 'rhompson, 12290 \'1 42nd _~venue, on a light near Kullerstrand, crime prevention, park land, summer ranger program, bikeways, encourage activity centers, keep the Comprehensive Plan, and continue prosecution of prostitutes and drug related problems; 8) Jerry Wilson, 3390 Holland, from the Parks and Recreation Co~nission, requesting time on the study Session, July 6, 1981, to adress park questions and long range planning, and that a position statement was being distributed regarding the proposed Edgewater joint Park at 29t~ & Kendall Item 2 Application by Helen Ludine Williams for a Class 0 - Retail Liquor Store License - for Sav-Mor Liquors, located at 10123 '.vest 37th Place The following people were sworn in by the Mayor Sherilyn MCGarry, 2260 Ingalls, Edgewater, (City neighborhood surveyor) Carroll Quelland, 7052 'v Stanford, Gerald Boatwright, 4315 Wadsworth, 8eIen \'lilliams, 2373 W Parhill Ave ,Duane tlelrns, 4141 Kipling, and James Dover, 510 Petroleum Building '1r -Boatwrignt represented the apclicnnt, Helen Williams and also called Carroll Quelland to testify ~pclicant's exhibits 1 - 5 were entered into the record land 2 were petitions circulated at Safeway, the Sub-Sandwich Shop, and other areas in Kipling Plaza 3, a 1980 census by tract; 4, an alpha-list of ~heat Ridge licensed outlets; and 5, a list of retail liquor stores in ,meat Ridge James Dover, represented Duane Helms of Jolly Jack Liquors, in opposition to the license Motion by Pat ~iello to approve the application by Helen Ludine Williams for a Class 0 -Retail Liquor Store License- for Sav-Mor Liquors, located at 10123 West 37th Place, for the following reasons l) ~ll applications and fees required by statute have been filed and paid; 2) notice of hearing and posting of the premises have been accomplished according to statutory requirements; 3) applicant is or will be entitled to occupancy of the premises by virtue of a signed lease; 4) the directors of applicant corporation, the applicant, and the manager for applicant have been shown by investi3ation to be of good moral character; 5) the evidence adduced at cmblichearing on June 8, establishes that the desires of the residents of the neighborhood under consideration are for granting this license, as evidenced by petitions bearing 63 signatures in favor of the issuance, 29 signatures in opposition, and 13 signatures evidencing no opinion, and that issuance of this license is consistent with the needs of the neighborhood under consideration; seconded by ~1r Lewis, carried 5-3, with Mr Bowman, ~lrs Ore, and Mrs Turner voting No CITY COUNCIL MIJUTES June 8, 1981 Page -2- Item 3 Public Hearing re approval of a Special Use Permit -Case No SUP-81-5, application by Dick and Darrel Strange to allow for a garage for repair of motor vehicles entireley within an enclosed building, at approximately 9670-80 ,~est 44th Ave Mr Stromberg gave the staff report and entered the documents into the record Nnended Motion that Case No SUP-Bl-5, a request by Dick and Darrel Strange for approval of Special Use Permit to allow the operation of a garage for the repair and service of motor vehicles at 9670-80 W 44th Avenue, be approved for the following reasons 1) Staff recommends approval; 2) Planning Commission recolllillends approval; and 3) the request is compatible with surrounding land uses; and with the following conditions a) that the owner or lessee maintain the fence from the western boundary of the property running north/south to the rear of existing building; b) there will be no wrecked cars, parts or equipment stored at any time in front of the building Original Motion by Mr 1'1erkl; seconded by ~1r Lewis Amending Motion by ~1rs Cavarra; seconded by Mrs Ore Amendment carried 7-l with f'lr Le'Nis voting No, and '-1otion as amended carried 7-1, with Mrs Turner voting no, stating that she fails to see where this use is compatible next door to a law office on the west, is in the same building as an Antique Store to the east, and immediately across the driveway from Apartment houses ORDINANCES ON FIRSr READING Council Bill 72 - An Ordinance providing for the approval of rezoning from Residential-Two (R-2) to Restricted Commercial-One (RC-l) for land located at approximately 12550 and 12590 'dest 32nd }\venue, City of vmeat Ridge, County of Jefferson, State of Colorado (Case No WZ-81-6) (Patrick Reynolds and lIes Ninder) Item 4 Ordinance was introduced on first reading by Mr Aiello; title read by the Clerk 11otion by Mr Aiello that Council Bill 72 be approved on first reading, ordered published, public hearing be set for Monday, July 27, 1981 at 7 30 P m in City Council Chambers, Municipal Building, and if approved on second reading, take effect 15 days after final publication; seconded by Mr Lewis After discussion about the possibility of defeating the Ordinance on first reading, and an opinion by the Attorney, that there should be legal support for a "L\lo" vote, Motion by t1rs Ore to Table the Ordinance for two weeks until June 22, to receive a legal opinion from Mr Hayes; seconded by Mrs Cavarra; carried 5-3 with Councilmembers Davis, Lewis, and Aiello voting No DECISIONS, RESOLUTIONS, AND t'lOTIONS Item 5 Application for Transfer of Ownership of El Bandido Restaurant, located at 4715 Kipling Street, and Change of Name from El Bandiio to "!1y \<lay" Mr Gerald Ganatos, Mr Michael LaGuardia, and Mr David LaGuardia, were sworn in to testify They stated that there would be some interior modification, but that it would still remain a Restaurant and Lounge and they would have live entertainment Motion by Mr Bowman for the Transfer of Ownership and Request for Change of Name from El Bandido Cantina & Restaurant to r-1y Way Restaurant and Lounge, located at 4715 Kipling, for applicants Michael G LaGuardia, President, Gerald G Ganatos, secretary/rreasurer, and David G LaGuardia, Vice President, for a Class T -Tavern License- with extended hours with the condition that the occupation tax oe paid by June 15, 1981; seconded by Mrs Ore; carried 8-0 Item 6 Motion to SChedule a Public Bearing for July 13, 1981, for Ordinance 363, Series of 1979, a request for a change of Zone from H-2 to R-l (Case No ~Z-79-7) (Wheat Ridge Foundation) (Lutneran Hospital) Motion by Mr Aiello that Ordinance No 363, Series of 1979, a request for a change of zone from H-2 to R-l (Case No WZ-79-7) be scheduled for a public nearing on July 13, 1981, and that Case No WS-79-1, a request for an eight lot subdivision be also scheduled for a public hearing on July 13, 1981; seconded by Mr Davis; carried 8-0 CITY COUNCIL MI~UTES June 8, 1981 Page -3- Item 7 Proposal by Mass Transit Committee to 0rovide Summer weekend bus service (City Van) Paul Gulman, 11673 W 44th Ave, #2, of the Mass Transit Committee, spoke regarding the proposed Van Service He stated that one of the main purposes of the service was to aquire ridership data to encourage RTD to extend Route 44 service to Saturdays and Sundays; that this is a test to determine the ridership The Vans are to be driven by volunteers of the Mass Transit COlnmittee The estimated cost to the City for the SUl1uuer is $920; they estimate that the round-trip timing will be 1 hour Motion by Mrs Ore to approve the Mass Transit Committee project for bus service to residents of our City; seconded by Mrs Turner; carried 6-2, with Mr Lewis and Mr Merkl voting No [1AYOR Al-<D COUNCILMEt1BERS' t1ATTERS A "Thank you" was expressed to all who had worked during and after last week's storm, especially the Police Department, Public Works, Park Department, and the Fire Department Motion by Mrs Ore that t1r Palmer extend a memo from City Council to those-department heads to be given to their employees thanking them for their help; seconded by Mr Bowman; carried 8-0 Motion by Mr t1erkl to amend the previous I\lotion to allow Board and Co~~ission members to register for Municipal League and to include the city will also pay for their lunches; seconded by Mrs Ore; carried 8-0 Mrs Ore requested that the Mugele Open Space area be mowed and the paths cleaned of beer cans and glass Mr Stites stated that today Coors Company had delivered an extension on the lease on the Greenbelt, which runs out June 20 Motion by Mrs Cavarra that City Council allow the Mayor to sign this extension and bring it to City Council on June 22;
